Waiver Request This NPDES permit application is for a new proposed discharge. Therefore, there is no existing effluent parameter monitoring data for the discharge and South End Charlotte Owner, LLC is requesting a waiver for providing effluent parameter data. However, Site groundwater data (discussed in Section 3.0 and summarized in Table 1)has been utilized to complete EPA Form 2C Tables B and C since effluent data will not be available until the groundwater treatment system is in operation. Note that the maximum concentration of a compound detected in Site groundwater was entered into the tables and is considered to be representative of maximum compound hart hickman SMARTER ENVIRONMENTAL SOLUTIONS https://harihicksharepoint.com/sites/MasterFiles-1/Shared Documents/AAA-Master Projects/Southern Land Company(SLC)ISLC-001 South Boulevard Assemblage/NPDES PermiuNPDES Application Cover Letter&Supporting Info.docx Mr. Wren Thedford August 4, 2022 Page 3 concentrations which may be present in treatment system influent instead of effluent data that EPA Form 2C requires. 2.0 Site Background Information The Site currently consists of three contiguous parcels of land that total approximately 0.9 acre and is developed with one approximate 4,400-square foot (sq ft) restaurant (1933 South Boulevard), one approximate 5,000-sq ft office building (1923 South Boulevard), and one approximate 4,500-sq ft multi-tenant office building(1919 South Boulevard). Remaining portions of the Site consist of asphalt-paved vehicle access and parking areas, concrete-paved sidewalks, and vegetated areas. A Site location topographic map is provided as Figure 1, and a Site map is provided as Figure 2. From the late 1930s until the early 1970s,the Site buildings were occupied by various businesses including grocery stores,various retailers,a construction company,a roofing supply company,and a chemical laboratory/manufacturing company. Residential and commercial use continued on the Site until the late 1980s,when the current restaurant and office building were developed in the northern and western portions of the Site,respectively. Since the mid-1980s,the Site buildings have been occupied by restaurants, various retailers, fitness companies, and various offices. South End Charlotte Owner, LLC plans to redevelop the Site with a multi-story retail and residential building with ground floor parking and leasing/amenities areas. To address environmental concerns associated with the Site (discussed below), South End Charlotte Owner, LLC elected to enter the Site into the DEQ Brownfields Program. A Letter of Eligibility to participate in the Brownfields Program was received on November 19, 2021, and the Brownfields project is referred to as Fulbright Laboratories (Brownfields Project Number 25073- 21-060). As part of the Site redevelopment, excavations below the shallow groundwater table are planned for construction of elevator shafts and a subgrade generator room in the locations shown in Figure 2. As such, this NPDES application is being submitted to allow for discharge of treated groundwater generated by the extraction wells. As discussed in Section 3.0, Site assessment activities have indicated the presence of groundwater impacts in the area of the planned excavations. 3.0 Summary of Groundwater Conditions A summary of Site groundwater sample data is presented in Table 1, and temporary monitoring well locations are depicted in Figure 2. Laboratory analytical reports for groundwater samples collected at the Site are provided as Attachment D. A discussion of Site groundwater data is presented below. August 2021 Phase II ESA H&H performed initial groundwater sampling activities at the Site during a Phase II Environmental Site Assessment (ESA) in August 2021. The Phase II ESA was conducted to evaluate potential environmental impacts associated with a former on-Site chemical mixing facility (Fulbright Laboratories), an on-Site gasoline underground storage tank (UST), an off-Site former manufacturing facility (Parks Cramer) to the west of the Site, and an existing automotive service garage (H&H Auto) to the northeast of the Site. Three temporary monitoring wells (identified as TMW-1 through TMW-3) were installed as part of the Phase II ESA, and groundwater samples collected from the wells were submitted for laboratory analysis of volatile organic compounds (VOCs), semi-VOCs(SVOCs), and Resource Conservation and Recovery Act(RCRA) 8 metals. Results of analysis of the samples indicate the VOCs tetrachloroethene (PCE), trichloroethene (TCE), and the PCE/TCE degradation compounds cis-1,2-dichloroethene (cDCE), trans-1,2- dichloroethene (tDCE), and vinyl chloride (VC) were detected above NCAC 2L .0202 Groundwater Standards (2L standards) in one of the wells (TMW-2). The PCE, TCE, and VC concentrations detected in TMW-2 also exceed NCAC 2B Surface Water Standards(2B standards) for Class C surface waters, and the cDCE concentration detected in TMW-2 exceeds the NC In- Stream Target Value for Class C surface waters. In addition,total chromium was detected slightly above the 2L standard in an unfiltered sample collected from TMW-3, but was detected below the 2L standard in a filtered sample from the well (indicating that the elevated chromium detection in the unfiltered sample is likely attributable to sediment in the sample and not dissolved chromium in groundwater). There were no other analytes detected above 2L standards or 2B standards in the samples. March and April 2022 Additional Groundwater Assessment During March and April 2022, H&H conducted additional groundwater assessment at the Site to evaluate the potential for shallow groundwater infiltration into excavations which will be completed as part of Site redevelopment activities for construction of elevator shafts and a subgrade generator room, and to evaluate groundwater quality in the proposed excavation areas. As part of the additional groundwater assessment activities, temporary monitoring wells TMW-4 and TMW-5 were installed in the location of the proposed subgrade generator room in the southeastern portion of the Site, and temporary monitoring wells TMW-6, TMW-7, and TMW-8 were installed in the proposed locations for three elevator shaft pits in the central portion of the Site. The temporary well locations and approximate locations of the proposed subgrade generator room and elevator shaft pits are depicted in Figure 2. TMW-4 and TMW-5 were installed to a depth of 5 ft below ground surface(bgs),which is the anticipated depth below current grade of the proposed subgrade generator room. It is anticipated that the proposed elevator pits will extend to approximately 15 ft below current grade. Therefore,TMW-6 was installed to approximately 20 ft bgs, and TMW-7 and TMW-8 were installed to approximately 15 ft bgs. Groundwater samples were collected from TMW-4, TMW-6, TMW-7, and TMW-8 for analysis of VOCs, SVOCs, and RCRA 8 metals. A sample was not collected from TMW-5 because the well was dry. Results of analysis of the samples indicate PCE was detected above the 2L standard and 2B standard in TMW-6. There were no other VOCs detected above 2L standards or 2B standards in the wells. The data indicate that elevated metals concentrations in the unfiltered samples(with the possible exception of chromium in TMW-6)are likely attributable to sediment in the samples and not dissolved metals in groundwater. Dissolved lead was detected above the 2B standard in the filtered samples collected from TWM-6 and TMW-7, and dissolved chromium was detected above the 2B standard established for hexavalent chromium (but, not above the 2B standard established for trivalent chromium) in the filtered sample collected from TWM-6. Note that the 2B standards for hexavalent chromium and lead are dissolved metal standards and it is therefore appropriate to compare only the filtered sample data to the 2B standards. There is no 2B standard established for total chromium. There were no other metals detected above 2B standards in the groundwater samples. Summary of Groundwater I m pacts Based on the results of groundwater assessment activities completed at the Site, it appears that groundwater in the area of the proposed elevator pits is impacted with relatively low concentrations of PCE above the 2L standard and 2B standard, dissolved lead above the 2B standard, total and dissolved chromium above the 2L standard for total chromium,and dissolved chromium above the 2B standard for hexavalent chromium (but, not above the 2B standard for trivalent chromium). In addition, it appears that elevated concentrations of metals detected in unfiltered samples are likely attributable in part to sediment in the samples and not dissolved metals in groundwater. Maximum concentrations of VOCs in Site groundwater are present in the downgradient area of the Site in the location of the former chemical mixing facility and proposed subgrade generator room. As such, these groundwater impacts are located downgradient of the proposed elevator shaft locations and are deeper than the anticipated depth of the proposed generator room. Note that there were no compounds detected above 2L standards or 2B standards in a groundwater sample collected from the anticipated excavation depth within the area of the proposed generator room. hart hickman SMARTER ENVIRONMENTAL SOLUTIONS https//harthick sharepoint.condsites/MasterFiles-I/Shared Documents/AAA-Master Projects/Southern Land Company(SLC)/SLC-ool South Boulevard Assemblage/NPDES Permit/NPDES Application Cocer Letter&Suppomng Info.dots Mr. Wren Thedford August 4, 2022 Page 7 4.0 Proposed Groundwater Treatment System and NPDES Discharge Information As previously discussed, excavations below the shallow groundwater table are planned for construction of elevator shafts and a subgrade generator room as part of Site redevelopment activities. The anticipated locations of these structures are shown in Figure 2. During construction of these structures,groundwater will be extracted from newly-installed extraction wells to prevent infiltration of groundwater into the excavations. This NPDES application is being submitted to allow for discharge of treated groundwater generated by the extraction wells. As discussed in Section 3.0 above, Site assessment activities have indicated the presence of groundwater impacts at the Site. In order to manage groundwater extracted during construction activities, South End Charlotte Owner, LLC proposes use of a groundwater treatment system to address VOC and metals impacts in the extracted groundwater and direct discharge of the treated groundwater effluent from the system under a NPDES permit into a storm water catch basin located on the Site. The catch basin location is depicted in Figures 2 and 3. As shown in Figure 3, storm water from the on-Site catch basin flows through the City of Charlotte municipal storm water system to an outlet(the proposed NPDES outfall) which discharges to surface water (Dairy Branch) approximately 1,400 ft southeast of the Site. In a letter dated June 27,2022,Charlotte-Mecklenburg Storm Water Services (CMSWS) approved discharge of treated groundwater from the Site to the storm water system under a NPDES permit. A copy of the letter is provided as Attachment B. Dairy Branch generally flows to the southeast and converges with Little Sugar Creek. The length of Dairy Branch from the proposed NPDES outfall to Little Sugar Creek is approximately 1.5 miles. Dairy Branch and Little Sugar Creek are classified by DWR as Class C surface water bodies. Based on a review of the North Carolina 2022 Integrated Report, it does not appear that Dairy Creek or Little Sugar Creek are impaired in the area of the Site. Proposed groundwater extraction and treatment includes extraction of groundwater from the extraction wells using submersible pumps to transfer the water into an equalization tank. The proposed treatment system is designed for an operational flow rate of approximately 16 gallons per minute (gpm), which is conservatively higher than anticipated groundwater extraction rates of 8 to 12 gpm. It is anticipated that groundwater extraction and treatment will be conducted continuously; however,treatment may be intermittent depending if extraction rates are lower than anticipated. A groundwater treatment system schematic for the proposed groundwater treatment system is included in Attachment C. Drawings/information sheets for the major groundwater treatment components included in the system and for the organoclay and GAC anticipated to be utilized in the systems are also included in Attachment C. As shown in the treatment system schematic, the proposed treatment system will include the following major components: • An approximately 6,000-gallon to 21,000-gallon equalization tank. The size of the tank will depend on actual groundwater extraction rates. The tank will generally be operated at approximately 80 percent capacity(to allow for solids settling and volatilization of VOCs), resulting in detention times ranging from approximately 5 to 18 hours (for the 6,000 and 21,000-gallon tanks, respectively) at 16 gpm. The tank will include low, high, and high- high level switches to actuate pumping from the tank through the treatment system and to shut down extraction well pumps (in the case that the tank is filled above 90 percent capacity). Sediments which accumulate in the equalization tank will periodically be emptied by an appropriately licensed waste management company and transported off-Site for disposal in accordance with applicable regulations. • A Rain For Rent BF100 bag filter unit, or equivalent alternate. The bag filter unit is rated for a maximum flow rate of 100 gpm. Spent bag filters will be disposed off-Site in accordance with applicable regulations. • A Enviro-Equipment HPP-1000 vessel (or, equivalent alternative) filled with Hydrosil International LTD's HS-200 liquid phase organoclay(i.e.,zeolite)product will be used for filtration of heavy metals. The unit has a bed volume of 33 cubic feet(cf)and will be filled with approximately 1,900 lbs of HS-200 organoclay. The organoclay vessel will provide an empty bed contact time of approximately 15.5 minutes at 16 gpm,which is higher than the organoclay vendor's(Hydrosil International LTD)recommended contact time of 10 to 15 minutes for effective reduction of metals concentrations in groundwater. Spent organoclay media will be disposed off-Site in accordance with applicable regulations. • A Enviro-Equipment HPP-1000 vessel (or, equivalent alternative) filled with reactivated liquid phase GAC will be used for filtration of VOCs. The unit has a bed volume of 33 cf and will be filled with approximately 1,000 lbs of GAC. The GAC vessel will provide an empty bed contact time of approximately 15.5 minutes at 16 gpm, which is higher than Enviro-Equipment's recommended contact time of 10 to 15 minutes for effective reduction of VOC concentrations. Spent GAC media will be disposed off-Site (or, recycled) in accordance with applicable regulations. Contaminant breakthrough time assuming continuous operation of the treatment system at 16 gpm is greater than 90 days. The estimated breakthrough time is based on Enviro-Equipment's experience with similar projects and calculations performed using analytical data for samples collected from the temporary wells installed in the areas of the proposed elevator shafts(discussed in Section 3.0). Samples of influent and effluent from the GAC unit will be collected on a weeklybasis p (at minimum) to monitor for organoclay (metals) and GAC (VOCs) breakthrough. The evaluated alternatives are listed below. • Connection to a municipal publicly owned treatment works(POTW) sewer system; • Subsurface disposal (including nitrification field, infiltration gallery, injection wells, etc.); and, • Spray irrigation Our evaluation of these alternatives to direct discharge under a NPDES permit is presented below. Connection/Discharge to a POTW Sewer System Charlotte Water does not allow discharge of groundwater to the POTW sanitary sewer system; therefore, this alternative is not a potential option for management of extracted groundwater generated at the Site. Subsurface Disposal Because the groundwater table beneath the Site is shallow(approximately 5 ft bgs),there is a small volume of unsaturated soil that would quickly become saturated if extracted groundwater were applied via drain fields or infiltration galleries to the unsaturated subsurface. In addition, significant portions of the discharged water would infiltrate back into the aquifer beneath the Site, ultimately resulting in an inefficient and ineffective dewatering/disposal process. Furthermore, saturation of shallow soil and continued addition of groundwater to the subsurface could result in daylighting of the water at the ground surface followed by overland flow and direct discharge to the storm water system and/or off-Site properties. Similarly, disposal of extracted groundwater into injection wells installed on the Site has the potential to result in groundwater mounding and increased groundwater extraction rates required for preventing infiltration of groundwater into the excavations. Based on the information presented above, subsurface disposal is not considered a feasible alternative for management of extracted groundwater, and costs for the alternative were therefore not evaluated. Spray Irrigation The Site is located in a developed area within the City of Charlotte,and land in the area of the Site is not available for spray irrigation of extracted groundwater. Furthermore, South End Charlotte Owner, LLC does not own off-Site property in the area of the Site which could be used for spray irrigation. Based on this information, spray irrigation is not considered a feasible alternative for management of extracted groundwater, and costs for the alternative were therefore not evaluated. Alternatives Analysis Summary As presented above, our evaluation of three options for management of extracted groundwater generated as part of Site redevelopment activities indicates that alternatives to direct discharge of treated groundwater under a NPDES permit are not allowable or feasible. Therefore, direct discharge of treated groundwater effluent from the proposed treatment system via a NPDES permit is appropriate.
