Provide a detailed description of the proposed activity including its purpose: * 1) A two foot drainage area surrounding the retaining wall for drainage.(picture below) There is very little evidence of drainage into the lake or erosion after storms so the drainage in combination with the retaining wall drainage allows for the water to be slowly dispersed. (picture below) 2) There are 2 patio sections: a. A 20 by 14 section (280 square feet) behind the drainage area and to the left of the dock. This is a b. A 29'/2 by 44 section (1298 square feet) 32 feet to the right of the dock. c. The patio is made of mortared flagstone. 3) No trees were disturbed or removed when completing the project. 4) The rest of the shoreline is undisturbed with rip rap as the retaining wall and grass behind the rip rap. 5) To remove the patio would create significant disturbance to the area and may impact the sustainability of nearby trees. 6) The remaining lakefront is undisturbed. 7) Below is the area of the patio. 2. Demonstration of Need for a Variance The variance provision of the riparian buffer rules allows the Division or the Environmental Management Commission to grant a variance when there are practical difficulties or unnecessary hardships that prevent compliance with the strict letter of riparian buffer protection. 1. Explain how complying with the provisions of the applicable rule would prevent you from securing a reasonable return from or make reasonable use of your property. Merely proving that the variance would permit a greater profit from the property shall not be considered adequate justification for a variance. The Division will consider whether the variance is the minimum possible deviation from the terms of the applicable Buffer Rule that shall make reasonable use of the property possible.* The project makes the waterfront more useable for aging parent and family visits. It also reduces maintenance a the waterfront. 2. Explain how the hardship results from application of the Buffer Rule to the property rather from other factors such as deed restrictions or other hardships (e.g. zoning setbacks, floodplains, etc).* The area in question is in the buffer zone. The project was completed without understanding that a patio is a structure. The drainage, stormwater runoff an erosion was taken into account with the project plan. 3. Explain whether the hardship was caused by the applicant knowingly or unknowingly violating the applicable Buffer Rule.* The buffer rule was unknowingly violated but without realizing the extent of the rule at the time the project was completed. The project was completed to better utilize waterfront and reduce maintenance. 4. Explain how the hardship results from physical nature of the property, such as its size, shape, or topography, which is different form that of neighboring property. * The property has a large amount of waterfront to care for. Utilization of the patio allows for utilization of the property lakefront and reduces the amount of lakefront maintenance. 5. Explain how the hardship is rare or unique to the applicant's property, rather than the result of conditions that are widespread. * Large amount of waterfront to take care of the previous erosion that was repaired with the wall repair created holes and erosion in the lawn. The patio and drainage allow for a level surface without stormwater erosion on the lakefront. I. As the official Bank Sponsor, EBX, attests to the fact that mitigation is available for reservation at this time. These mitigation credits are not considered secured, and consequently are eligible to be used for alternate purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation obligation requiring the credits/units. The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the purchase price.
