I was looking over the additional information you provided on July 28, 2022. Everything looks good except for a few
small issues:
Please correct the following:
- Prior Comment, Supplement-EZ Form, Stormwater Wetlands Page, Line 28 – It does not appear that the
forebay entrance elevation was revised from 268.9’ to 268.67’ on plan sheet C-9.01 (see attached).
- It was noted during review that the signing official on the Application was changed from William R. Barnacascel,
Jr. to Michael H. Hancock. While not required, it is recommended to have the signing official on the Application,
O&M Agreement Form, and Deed Restriction Form be the same person so there is a single point of contact for
the permittee (Boddie-Noell). I currently have an Application Form signed by both individuals, an O&M
Agreement Form signed by Mr. Barnacascel, and a deed restriction form signed by Mr. Hancock.
Please provide the following:
- 2x hard copies & 1x electronic copy of the revised plan sheet C-9.01.
- 1x original hard copy & 1x electronic copy of the revised O&M Agreement or Deed Restriction Form (as
needed/applicable).
- 1x hard copy (2x hard copies for plan sheets) & 1x electronic copy of any other items needed to address these
comments.
- NOTE: Please upload the electronic files (in response to these comments) through the following link:
https://edocs.deq.nc.gov/Forms/SW-Supplemental-Upload (I manually entered the files that were emailed to
me on 7/27/2022 to the electronic permit file for this project, but for future reference, this should be done by
you at the link provided).

Since these are really minor things, once I get the hard copies, anything else that may have changed from addressing

I was looking over the additional information you provided on April 8, 2022 and June 23, 2022. Everything looks good
except for a few small issues:

Please correct the following:
- Prior Comment 4 – It appears as though this project is being subdivided. Subdivided projects are required to
have deed restrictions per 15A NCAC 02H .1042(2)(k) so that the capacity of the SCM is not exceeded. Example
deed restriction language can be found on our website: https://deq.nc.gov/about/divisions/energy-mineral-
and-land-resources/stormwater/stormwater-program/post-construction-program/post-construction-forms
NOTE: We require an original, signed “& notarized hard copy of the deed restriction form but you may wish to
get a second original signed & notarized copy of that form for the Applicant’s records (they will need it to record
with the Register of Deeds).
- Supplement-EZ Form:
o Drainage Areas Page:
Entire Site Column – The entire site column should include all of the BUA that will exist within
the entire site, even if it does not drain to the proposed SCM. The provided drainage area map
indicates that a portion of the new BUA located by the west site entrance does not drain to the
SCM. This BUA should be included in the entire site column (since it is being added to the site)
but should not be included in the SCM drainage area (since it is not draining to the SCM). In
order to meet Runoff Treatment, the net increase in BUA must be captured and treated within
one or more primary SCMs. If it is not possible or practical to direct the net increase in BUA into
one ore more primary SCMs, the portions of the project area that do not drain to the SCM(s) can
be permitted as a low-density drainage area (provided that these areas meet the low-density
design requirements). If this option is also not possible/practicable and the amount of BUA is
minimized/justifiable we can allow it via a variance (we can set up a video call if this is the case).
o Stormwater Wetlands Page:
Line 27 – It is noted that the majority of the shallow water zone is graded to be 6” (and not 9”)
below the permanent pool surface elevation, but the shallow water zone extends to 9” below
the permanent pool surface elevation. Please revise this value to reflect this.
Line 28 – The provided calculations (Page 39 of the Stormwater Impact Analysis) show the
bottom of the forebay deep pool to be at elevation 268.67’ whereas the plans and Supplement-
EZ form show an elevation of 268.9’. Please revise as needed. It is noted that 268.67’ is 40”
below the permanent pool elevation, but if the forebay deep pool is only 37” deep at its deepest
point, the information in the calculations should reflect this (Stormwater Wetland MDC 6
requires the depth of the forebay to be between 24” and 40”, it does not require the deep pool
to go all the way down to 40” deep).
Line 30 – The provided calculations (Page 39 of the Stormwater Impact Analysis) show the
bottom of the non-forebay deep pool at elevation 268.67’ whereas the plans and Supplement-
EZ form show an elevation of 269.0’. Please revise as needed.
Line 42 – It is noted that the majority of the shallow water zone is graded to be 6” (and not 9”)
below the permanent pool surface elevation, but the shallow water zone extends to 9” below
the permanent pool surface elevation. Please revise this value to reflect this.
Lines 47 & 48 – The drawdown mechanism for the temporary pool is the drawdown orifice, not
the weir (the provided weir draws down volume in excess of the temporary ponding surface and
is not used to draw down the temporary pool). These items are not required. Please revise.
Line 50 – Please answer this item (since Line 51 indicates that a soil amendment specification
has been provided).
Please provide the following:
- 1x original signed & notarized hard copy & 1x electronic copy of the deed restriction document
- 1x hard copy & 1x electronic copy of the revised Supplement-EZ Form pages.
- 1x hard copy & 1x electronic copy of the revised pages of the calculations (as needed).
- 1x hard copy (2x hard copies for plan sheets) & 1x electronic copy of any other items needed to address these
comments.

process generally take 30 – 45 calendar days, but can take up to 90 calendar days per statute (our other reviewer, Corey
Anen, no longer works for the State, so this review will probably be closer to 45 days than 30). Please upload all
documents that you mailed into our office through the link provided below. Be sure to choose the Central Office as the
Primary Contact office.

Good Morning,
We received your application for a new post-construction stormwater permit on 12/21/2021. At this time, the
submission is not administratively complete and cannot be accepted for review in its current condition. Please provide
the following submittal items within 30 calendar days (by close of business on 1/27/2022) so that we may accept the
project and begin the review process, otherwise, the project will be returned as administratively incomplete.
- If the future development portion of the property will be sold off or subdivided, please provide original signed &
notarized deed restriction documents limiting the BUA (https://deq.nc.gov/about/divisions/energy-mineral-and-
land-resources/stormwater/stormwater-program/post-construction-program/post-construction-forms).
- Please provide a phone number and email address for the property owner (Section III, 2b of the Application). We
use this information to get a hold of the property owner if we need to with regard to the permit and we also
send an electronic version of the final permit to the property owner for their records.
- 1x hard copy of the pending sales agreement. This item is required per Section III, 1c of the Application and 15A
NCAC 02H .1042(2)(c).
- 2x hard copies of a full-sized plan sheet showing the following (NOTE: Only updated plan sheets need to be
provided, we do not require brand new sets of plans):
o Drainage area map for the proposed wet pond. This item is required per Section VI, 8o of the Application
and 15A NCAC 02H .1042(2)(g)(iv). It is noted that drainage area maps are provided in the stormwater
report, however this requirement specifies that the drainage area maps should be provided as part of
the full sized plan set.
o Please sign the plans. This item is required per Section VI, 8 of the Application and 15A NCAC 02H
.1042(2)(g).
NOTE: This is an administrative completeness review, not a detailed engineering review. The following items were noted
during this review, but do not need to be addressed for this submission to be administratively complete and accepted
for review (but these issues, and possibly others, will probably be brough up during the engineering review):
- Section I, 4 – The provided coordinates do not correspond to the project location.
- For future reference, please do not send these submissions to the Raleigh Regional Office, but rather to the
Central Office (address below). Sending the submission package to the wrong address can delay the review
process (for example, the Raleigh Regional Office received this submission on December 16, 2021 but it did not
get sent over to me until 12/21/21).
If these items are received within the stipulated timeframe, we can accept the project and begin the review process.
Once accepted, reviews under the standard permitting process generally take 30 – 45 calendar days, but can take up to
90 calendar days per statute (one of our two reviewer positions is currently vacant so this review will probably be closer
to 45 days than 30).
