On July 28, 2014, the Division of Water Resources (Division) received your application dated June
6, 2014, requesting Major Variance from the Division for the subject project. The Division has
determined that your application is incomplete and cannot be processed. The application is on-
hold until all of the following information is received:
1. According to the lot survey provided in the application, the existing deck is located and a
portion of the proposed deck would be located on property owned by the Arlington Hills
HOA. Variance application forms must be signed by the owner of the property. Please
submit the signature page of the Variance application form with the owner's signature for
proper consideration of your application.
2. Please provide the height of the existing and the proposed deck.
3. Please locate all of the protected riparian buffers as overlays on the site plan, clearly
showing Zone 1 and Zone 2.
4. Please enumerate all Zone 1 and Zone 2 riparian buffer impacts on the site plan and clearly
label impacts (Buffer Impact 1, etc.).
5. Please list the Zone 1 and Zone 2 buffer impact and required mitigation in square feet in
the table in Part 2, question 2.
6. Buffer mitigation is required for the proposed buffer impacts. Please submit a mitigation
plan detailing how the impact will be mitigated.
7. This Office believes that the existing deck and the proposed deck can be moved or
reconfigured to avoid or minimize the impacts to the riparian buffer. Please revise the
plans to avoid or minimize the impacts or provide a detailed explanation of why this plan
for the activity cannot be practically accomplished, reduced or reconfigured to avoid or
minimize impacts to the riparian buffer.

8. Stormwater treatment must be provided for an area equal to the entire amount of deck
area added within the riparian buffer. We will accept treatment of the same amount of
area from existing impervious surfaces located outside the riparian buffer in lieu of treating
stormwater from the deck area proposed within the riparian buffer.
Pursuant to 15A NCAC 02B .0233, the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information is
not received in writing within 30 calendar days of receipt of this letter, the Division will be unable
to approve the application and it will be returned. The return of this project will necessitate
reapplication to the Division for approval, including a complete application package and the
appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending four copies of
all of the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service
Center, Raleigh, NC 27699 -1617.
Please be aware that you have no authorization under the Buffer Rules for this activity and any
work done within the Neuse River Basin riparian buffer or waters of the state may be a violation of
North Carolina General Statutes and Administrative Code.
