The said letters were given before Mr. Conner's filing for judicial hearing with the State, as I explained before we had objected the calculated sum. Mr. Conner while I was out of U.S. had obtained a settlement with the DWQ which unfortunately I am not in position thereof. Please allow me to come back to U.S. and check my hard copy info and see what Mr. Conner agreed and I go from there to DWQ. We will definitely pay whatever amount we are required to pay by law. It can be updated when the owners are ready to make their payment. The fee per square foot of mitigation (currently $1.05) is subject to change in the future- it typically gets updated on an annual basis in January. This is why there is an expiration date on the invoice- just ask me for a new one when you know more about whether they will be moving ahead on construction. I would also recommend contacting the Division of Water Resources (copied on this email) to verify any other regulatory requirements and to provide them notification of any changes in the project or updates to the schedule so that they are aware of it when you have more details. I can keep the file on hold as long as the project has a possibility of going to construction (that is under current DENR procedures), but I would recommend requesting renewal of the acceptance letter and keeping it up -to -date if you wish to use EEP as a mitigation provider. Obviously significant changes has happened to EEP, the authorization which made by DWQ is grandfathered and the EEP mitigation is driven based on those authorization and additional agreement reached in 2009/2010 with the State. It would be more appropriate that I would review the file and since only one phase of the 3 phase project will be going into construction, and how this effects the EEP based on 2002 authorization and the 2009/2010 agreement which had to do with the same is not clear to me at this time. I would try to see if I can get copies of all agreement and then if you would not mind I would have a conference call from overseas before my arrival to see what needs to be done. It would be very helpful if you would give me a reference bookmark to the complete state law regarding EEP. I thank you again for your detailed info.
