This letter is provided to serve as the "Agent Authorization Letter" and provide North
Carolina Wildlife Resources Commission (NCWRC) signature authority for the
owner/applicant, that being Duke Energy Carolinas, LLC, for upgrade work proposed at
Black Bear Access Area. The work includes the installation of a new fishing pier in Day
Use Area. This construction work is proposed to occur within 2022. The upgrades will
improve fishing opportunities for the general public. It is understood this work will take
place after all the permits are acquired.
This authority is granted to assist the NCWRC in acquisition of necessary permits to
satisfy Section 404 and/or Section 10 Nationwide, Regional and General Permits,
Section 401 general Water Quality Certifications, and Riparian Buffer and Watershed
Buffer Rules.

INSTALLED IN WETLANDS OR WATERS EXCEPT WITHIN THE FOOTPRINT
OF TEMPORARY OR PERMANENT IMPACTS OTHERWISE AUTHORIZED BY
THIS PERMIT.
• EROSION CONTROL MATTING THAT INCORPORATES PLASTIC MESH
AND/OR PLASTIC TWINE SHALL NOT BE USED ALONG STREAMBANKS
OR WITHIN WETLANDS.
• ALL WORK IN OR ADJACENT TO STREAMS AND OPEN WATERS SHALL
BE CONDUCTED SO THAT FLOWING STREAM AND/OR OPEN WATRS
ARE ISOLATED FROM THE DISTURBED AREA. TURBIDITY DUE TO
ACTIVITIES IN RECEIVING LAKE WATER SHALL NOT EXCEED 25 NTU OR
BE EXISTING TURBIDITY LEVELS SHOULD NOT BE INREASED IF
NATURAL BACGROUND CONDITIONS EXCEED 25 NTU.
• IF ACTIVITIES MUST OCCUR DURING PERIODS OF HIGH BIOLOGICAL
ATIVITES (FISH SPAWNING OR BIRD NESTING), THEN BIOLOGICAL

• ANY RIPRAP REQUIRED FOR PROPER SHORELINE STABILIZATION OR
RESTORATION OR RESTORATION OF TEMPORARILY DISTURBED AREAS
SHALL BE RESTRICTED TO THE AREA DIRECTLY IMPACTED BY THE
APPROVED CONSTRUCTION ACTIVITY. ALL RIPRAP SHALL BE OF A SIZE
AND DENSITY TO PREVENT MOVEMENT BY WAVE, CURRENT ACTION,
OR STREAM FLOWS, SHALL CONSITST OF CLEAN ROCK OR MASONRY
MATERAIL FREE OF DEBRIS OR TOXIC POLLUTANTS. PLACEMENT OF
STABILIZATION MATERIALS SHALL NOT RESULT IN DESTABILIZATON OF

• ALL MECHANIZED EQUIPMENT OPERATED NEAR SURFACE WATERS
SHALL BE INSPECTED AND MAINTAINED REGULARLY TO PREVENT
CONTAMINATION OF SURFACE WATERS FROM FUELS, LUBRICANTS,
HYDRAULIC FLUIDS OR OTHER TOXIC MATERIALS. CONSTRUCTION
SHALL BE STAGED IN ORDER TO MINIMIZE EXPOSURE OF EQUIPMENT
TO SURFACE WATERS TO THE MAXIMUM EXTENT PRACTICABLE.
FUELING, LUBRICATION AND GENERAL EQUIPMENT MAINTENANCE SHALL
BE PERFORMED IN A MANNER TO PREVENT, TO THE MAXIMUM
EXTENT PRACTICABLE, CONTAMINATION OF SURFACE WATERS BY
FUELS AND OILS.
• IN ACCORDANCE WITH G.S. 143-215.85(b), THE PERMITTEE SHALL
REPORT ANY PETROLEUM SPILL OF 25 GALLONS OR MORE; ANY

WATERS; ANY PETROLEUM SPILL REGARDLESS OF AMOUNT OCCURING
WITHIN 100 FEET OF SURFACE WATERS; AND ANY PETROLEUM SPILL
LESS THAN 25 GALLONS THAT CANNOT BE CLEANED UP WITHIN 24
HOURS. CONTRACTOR MUST CONTACT PERMITTEE OR OWNER
REPRESENTATIVE IMMEDIATELY FOLLOWING ANY SUCH OCCURANCE.

The letter serves as notification of the issuance of a McDowell County Major Shoreline
Protection Permit Start Work Letter. In accordance with the 2020 Lake James Protection
Ordinance, this permit is issued for building, land disturbance, and allowed vegetation removal
only.
Development standards as submitted by lot owner:
• 164 acres per construction drawings
• Temporary/Current Disturbance Area: 21.7 Ac
• Project is part of FERC relicensing agreement
• Sediment and Erosion control plan in place
• All other required permits obtained and/or in place
It is the responsibility of the contractor to notify McDowell County Planning should any changes
be made to the plan regarding placement of structures, vegetation removal other than that for the
home, septic, driveway, and accessory structures, or any additional land disturbing or vegetation
removal not noted in the submitted plans.
Those found doing work not noted on the site plan or not notifying McDowell County Planning
of scope of work change, with be in violation of Section 205 of the 2020 Lake James
Protection Ordinance. The offender will be subject to a fine of not more than $500.00.
The removal of each protected tree will be considered a sperate violation. Working without a
permit or the wrong permit will not be tolerated.

Before a Shoreline Protection Permit will be issued the following information must be submitted to
Planning Staff for any work occurring with 250 feet of the Duke Energy Project Boundary. Property
Owners/Agents are responsible for evaluation of their respective parcels, thereby placing the burden on
the homeowner/agent to comply with the Ordinance.

plantings. Protected Trees are 2 inches in diameter and greater.

(x) Location of the proposed area of disturbance for any shoreline stabilization and description or plan of
proposed stabilization measures

(x) Home site, septic system, and any accessory buildings must be staked prior to staff making a site visit.
(x) Total parcel coverage by impervious surfaces - including building footprint, impervious roads, or other
impervious cover shall not exceed twenty-four (24) percent of the parcel. This coverage % of the property
covered must be certified by a land surveyor.
(x) A description of the scope of work to be done on the lot under this permit. Examples: clearing of home site,
shoreline stabilization, dock, pathway to water's edge, driveway, etc. If the scope of work changes during the
process it is the responsibility of the owner/contractor to update this permit and allow staff to check for
compliance. Any work that is found to be done and not part of the permitted scope will be subject to a fine.
*Failure to complete/provide the items on this check list will result in the application being rejected.
*A Shoreline Protection Permit shall expire if a Building Permit or Certificate of Occupancy is not
obtained within 12 months from the date of issuance. Expired Permits will require new application and
fee.
*A Start Work Letter will be issued once staff makes a site visit to determine if all rules and regulations
of the Ordinance have been met.
*No work may begin within 250 feet of the water prior to issuance of a Start Work Letter. This
application does not grant permission to begin work. (WORK THAT BEGINS WITHIN 250 FEET OF
THE WATER PRIOR TO ISSUANCE OF A START WORK LETTER WILL RESULT IN FINES AS
LEVIED BY THE BOARD OF COMMISSIONERS, AS WELL AS A STOP WORK ORDER.)

Description of work:
The Black Bear Access project includes a campground and day use area. This is a recreation project
funded by Duke with the anticipation of turning the park over to McDowell County once the project is
complete. (See sheet L3.0 of plan set for reference)
Campground: There are no disturbances or site elements from the campground planned within the 50'
buffer. There are some natural surface trails planned within the 100' buffer.
Day Use Are: The day use area consists of a picnic area, natural surface trails, a path to a proposed
fishing pier and a pavilion and parking area.
Items within the 50' buffer include:
- Fishing pier access path (concrete)
- Picnic table and pad
- Split rail fence for safety
- Natural surface path
Items within the 100' buffer include the above items plus:
- Portions of an open-air pavilion
- Stormwater discharge and inlets
- Vault toilet and concrete pad
- Access stairs

7. Describe proposed work (include discussion as to how hardening of shoreline has been avoided, or
why it is necessary):
The NC Wildlife component of day use area development is limited to
construction of a fixed, universally accessible fishing pier. The pier will
extend approximately 90' over the lake from the shoreline to reach
fishable water depth at year-round target lake levels. The pier will be
supported by driven timber piles. An 8'x8' concrete abutment will be
installed just above the full pond level (1200' MSL NGVD29) to connect
the pier to the shoreline and is a component of the water dependent fishing
pier structure. Geotextile and rock riprap will be installed along the front
face (lakeward) and sides of the proposed abutment to protect the
abutment base from being eroded by wave action. The attached permit
drawings show details of the overall site plan, extents of the impact area
and proposed shoreline stabilization at the pier abutment.
Construction of the pier, abutment and shoreline stabilization at the
abutment will be done during the fall -winter season when lake levels are
at their lowest. The sites of the abutment and near shore pilings will be
above the lake level at the time of construction and will be installed from
land. Piling locations near the end of the proposed pier will be below the
lake level and will be driven from a water -based barge. Sediment fence is
to be installed along and above the surface water level across the width of
the proposed area of disturbance for equipment activities associated with
pile driving on the lakebed.
An accessible route path and steps connecting the proposed parking area
and the pier abutment are components of Duke Energy Corporation's day
use area development project. Design and construction of these features
are by Duke Energy contractors. These, and all other buffer impacts
excluding the fishing pier, pier abutment and shoreline stabilization at the
abutment, have already been approved under a McDowell County Major
Shoreline Protection Permit (attached).
