The layout and design of the recreational area is designed to minimize wetland and stream impacts, while at the same time maximizing the potential of
the project. Proposed road crossings will occur at low areas minimizing impacts. The route of the road was designed so that it minimizes the total
number of crossings as well. Leaving the vast majority of the stream area untouched. New River itself remains untouched

We limited disturbance areas to minimal needed for equipment and installation. Work to be done in periods of dry weather. Work to be completed in
minimal time necessary. Headwalls have been designed for the culvert crossings to minimize impact length. Silt fence and other erosion control
measures are proposed to minimize sedimentation runoff.

Construction Sequence:
4. No construction of the drainage for the wetland impact shall commence until all materials
needed for the impact are staged on site, and the temporary dams are installed to impede flows.
5. Establish clearing limits per approved plans. Clear and grub impact area as needed. Immediately
install the temporary dams upslope of the headwall. Temporary seed and mulch disturbed area.
Do not clear or disturb any unpermitted areas.
6. Install drainage. Fill, compact and finish grade area.
7. Install permanent ground cover (sod) on slopes near the headwall or end treatments and pipe outlet.
8. Install silt fence at toe of fill slope and as needed to prevent erosion.
9. See wetlands permit for additional requirements.
Stream and Wetlands Impact Notes:
1. Stream crossing: initial disturbance of this area shall be limited to only that area minimally needed to
allow passage of construction equipment to prepare for the installation of the crossing and to execute
upland construction on the opposing side of the crossing. Clearing, grubbing or land disturbance of the
subject area shall not be performed until all equipment, water, sewer, storm drain and erosion and
sediment control materials or devices sufficient to substantially complete the construction and
stabilization of the crossing are staged or stockpiled at the location. Due consideration shall be given
to impending inclement weather conditions that may adversely affect the completion of the crossing in
the shortest time practicable.
2. Establish clearing limits per approved plans. Clear and grub area as needed. Immediately install silt
fence at the wetlands line, and along existing creek top of bank. Install erosion control fabric along
ditch banks. Do not clear or disturb any unpermitted areas.
3. No construction of the crossing shall commence in the wetlands until all materials needed for the
crossing are staged on site. Storage shall be at least 50' Wetlands.
4. When possible, work in the wetlands shall be done during periods of dry weather.
5. Work in the wetlands shall be completed in the minimum time necessary.
6. Contractor shall install temporary sand bags and/or sheet pilings in the stream prior to construction
and bypass water as needed via a pump around. Pump around shall discharge into a rip rap lined basin
or a sediment bag to act as dissipation device.
7. During excavation, stockpile the top 12"± of topsoil, and reuse topsoil as the top layer of soil when
backfilling.
8. Install water under stream then storm drain pipe. See Plan and Profile for Additional Information.
Backfill, compact and regrade area to original contours, or to grades shown on plan.
9. Install silt fence at top of ditch bank and at wetlands line to prevent erosion.
10. If wetland or stream areas are disturbed, outside of the impact areas, they shall be regraded to
original contours using topsoil for the top layer, and the stream banks shall be seeded, with annual
seed, then lined with coil fiber matting then staked with live willow stakes at 3' on
center to stabilize the banks to 5' beyond the top of bank.

Background
On April 6, 2022, the United States Supreme Court issued an order staying a lower court's vacatur of the
Trump Administration's 2020 "Clean Water Act Section 401 Certification Rule" ("Federal Rule"). As a result
of the United States Supreme Court order, the Trump Administration's Federal Rule has sprung back into
effect.
The Trump Administration's Federal Rule imposes additional procedural requirements on applicants for 401
Certifications and on DWR's processing of those applications. One requirement is that 401 applicants must
request a pre -filing meeting request at least 30 days prior to submitting their 401 application. [40 C.F.R.
§121.4] In turn, the Federal Rule requires that applicants include documentation of their pre -filing meeting
request in their 401 Certification application. [40 C.F.R §121.1; 40 C.F.R. §121.5]. Please refer to
the Federal Rule for more information.
Per 40 CFR §121 and §121.5, a 401 Certification application that does not include the required pre -filing
meeting request documentation does not constitute a "certification request" As a result of the
reinstatement of the Trump Administration's Federal Rule, all 401 applications received after April 6, 2022
that do not have documentation that a pre -filing meeting request was submitted at least 30 days prior to
submittal of a 401 Certification application will be returned as incomplete.
