For Line 021B —
the client has relented — 30' permanent with 10' for workspace. They would prefer 20' additional but if it's going to slow
things down — I suggested to them to do the 40-feet. Is it possible to get a total of 50-feet disturbed area (30-feet
permanent maintained) 40-feet is crowded during construction and I understand that we would need to mitigate for it.
I will get to work on a letter and update those pertinent impact maps — it only mattered there in the vicinity of S6
through ST

On behalf of our client, Energy Management Services (EMS), S &ME, Inc. (S &ME)
hereby submits this revision request to update a currently authorized NWP 12 and a
WQC No. 3884 and Riparian Buffer authorization that is currently under review by the
Division of Water Resources (DWR). S &ME previously submitted an application to
authorize impacts to Waters of the U.S. (June 25, 2014, SAW Action ID: 2014 -00846 ) in
accordance with project requirements under Section 404 and 401 of the Clean Water Act
and in accordance with Jordan Lake Riparian Buffer requirements.
On August 1, 2014, Ms. Sue Homewood (DWR) issued a "Request for Information"
letter placing the project on hold pending receipt of additional justification regarding the
need for a 50 -foot wide permanent maintained ROW (Copy attached). On August 11,
2014, S &ME responded to the aforementioned Request for Additional Information and
provided the requested additional justification for a 50 -foot permanently maintained
Right -of -Way (ROW). S &ME additionally provided revised impact maps and
information related to additional re- routes requested by landowners. The revised impacts
to wetlands, as a result of the re- routes resulted in a combined temporary and conversion
impacts of 2.94 acres and 2,4271f of temporary impacts to streams. Of the 2.94 acres,
0.064 acre would be permanent conversion as a result of the 50 -foot maintained ROW, an
overall net decrease in conversion impacts from the June 2014 application. The USACE
authorized the revision of impacts on August 15, 2015, attached. Impacts to wetlands
regulated by the USACE will not change from the currently authorized totals as a result
of this submittal.

Line T -021 B Pipeline Project - Alamance and Orange Counties, N.C. August 22, 2014
With respect to the Jordan Lake Watershed riparian buffers, the re- routes resulted in an
overall decrease in impacts from the original June 2014 application to 11,604 square feet
(sf) in Zone 1, and 11,529 sf in Zone 2. The remaining areas of construction are located
in existing maintained ROW and, as such, are exempt of Jordan Lake Riparian Buffers.
In an August 15, 2014 telephone conversation between our Ms. Crystal Fox and Ms. Sue
Homewood (DWR), Ms. Homewood indicated that she had spoken with management and
the submitted justification for the 50 -foot permanent maintained ROW did not satisfy a
"No Practical Alternatives" analysis when compared with other applications where a 10-
foot or 30 -foot permanent ROW was approved. Therefore, the pipeline alignment has
been revised to reflect a 30 -foot permanent ROW where riparian buffers are impacted in
areas of "virgin" ROW, in accordance with this response. One exception is Stream 1
which is being installed via Horizontal Directional Drill and the additional workspace is
not necessary. In all other areas, where the pipeline is located within existing easement
or parallel to existing easement, impacts remain as previously submitted.
PSNC requested a 20 -foot temporary workspace through the "virgin" ROW areas, to
facilitate construction, which was approved via email on August 20, 2014 (attached). For
this project, temporary workspace is aligned to the working side of the corridor where
equipment, matting etc. will be placed and limits impacts to Zone 1 and wetlands. The
reduction of the permanent maintained corridor is depicted on Approximate Jurisdictional
Boundaries Maps 301, 306, and 307 (attached). Please note, overall permanent impacts to
Jordan Lake Buffers are also reduced to 11,087sf in Zone 1 and 10,066sf in Zone 2.
Please note that temporary impacts associated with this revision on Stream 7 have been
included in mitigation totals. As such, this area will be reseeded in accordance with the
previously submitted Restoration plan and allowed to re- vegetate naturally. An updated
Jordan Lake Riparian Buffer Impact Table, listing impacts to each feature is attached.
MITIGATION
Per the USAGE, mitigation for permanent conversion of wetlands is not required.
PSNC plans to purchase the buffer mitigation credit from North Carolina Ecosystem
Enhancement Program (EEP) as there are no private mitigation banks within the Jordan
Lake Watershed. Areas where temporary workspace is required, mitigation will be
provided for temporary impacts and will be seeded with a customized riparian seed mix,
submitted previously. Because mitigation is being provided, these areas will not be
replanted with woody vegetation.

On June 25, 2014, the Division of Water Resources — Water Quality Programs (Division) received
your application dated June 24, 2014, requesting a 401 Water Quality Certification and Buffer
Authorization from the Division for your project. The Division has determined that your
application is incomplete and cannot be processed. The application is on -hold until all of the
following information is received:
The Table of Uses within the Jordan Buffer Rules (15A NCAC 02B .0267(9)) states that
"Utility, non - electric, perpendicular crossings of streams and other surface waters
subject to this Rule; [that] Disturb greater than 40 linear feet but equal or less than 150
linear feet of riparian buffer with a maintenance corridor greater than 10 feet in width"
are categorized as "Allowable with Mitigation ". 15A NCAC 02B .0267(10)(c) states that
"Uses designated as allowable with mitigation may proceed provided that there are no
practical alternatives (see 15A NCAC 02B .0267(11) to the requested use...."
A file review of a similar PSNC project application submitted to the Division and subject
to the Jordan Buffer Rule indicates that PSNC has previously determined that a 10 foot
maintenance corridor is practical. In addition, a file review of similar utility project
applications submitted by other corporations subject to the same regulations has
indicated that a 30 foot maintenance corridor is practical.
Please provide additional information which clearly justifies the necessity for a 50 foot
wide permanent maintenance corridor for this project.

Location description: This natural gas pipeline will originate at PSNC's existing take -off station located west of NC Highway 54
near Graham, North Carolina (approximately 36.0453N, - 79.3656W) then run generally east /southeast, parallel to or within an
existing combination of PSNC and Cardinal gas line easements, crossing NC Highway 119, Mebane Oaks Road, Bradshaw
Ouarry Road and terminating at Old Chapel Hill Hillsborough Road near Chapel Hill, North Carolina (approximately

Description of projects area and activity: Proposed is the construction of approximately 15 miles of 16 inch natural gas pipeline
(Line T- 021B), primarily within an existing easement and running adiacent to an existing nineline. This Verification allows
for: 2,427 linear feet of temporary stream impacts resulting from open cuts to place pipe; 2.874 acres of temporary impacts to
wetlands from construction activities associated with the installation of pipe; and the permanent conversion of 0.064 acre of
wetland from forested wetlands to maintained emergent wetlands in order to provide a maintenance corridor. These impacts
are summarized on the two tables entitled: Line T -021B Pipeline Proiect Stream Impact Table and Wetland Impact Table.
Applicant is required to restore areas of temporary impacts in accordance with the Approved Restoration Plan.
THIS IS A RE -ISSUE OF PERMIT ISSUED ON JULY 15, 2014 and reflects the lowered impacts due to the re- routing of a
portion of the pipeline. Because of the lowered impacts, no mitigation will be required and there are no special conditions
associated with this permit.
