The following restates your requests with a response to each below. 1. Please re-submit your site plans on full plan sheets at a scale of no smaller than 1 "=50'. This permit application is only for the two individual, existing lots illustrated on the previously submitted PCN Application and on the attached BMP design sheets. Impacts for the remainder of the subdivision were previously permitted through separate PCN Applications. Per a telephone conversation with Mr. Ian McMillan, the maps as previously submitted should suffice since this application is only for the two identified lots. These maps are at a scale no larger than 1"=50'. Z. Please indicate the diffuse flow provision measures on the site plan and submit diffuse flow provision measure worksheets and signed and notarized Operations and Maintenance Agreement. Both of these lots discharge stormwater runoff into wide, flat, forested valleys that contain no streams or Neuse Riparian Buffers within several hundred feet of the proposed homes. We have NCDWQ confirmation that no Neuse Riparian Buffer exists downstream of lot 23 for approximately 2,000-feet (Letter & Map are Attached). Additionally, both of these sites are in the upper coastal plain and are covered by coarse grained soils that have a relatively high permeability. It is reasonable to expect that a significant portion of stormwater runoff from the first 1-inch of rainfall will be absorbed by the soils in this area. This expectation is supported by the fact that no streams currently exist in these valleys. The remaining stormwater that is not absorbed into the soil will travel as sheetldiffuse flow, a minimum of several hundred feet through the forested valley detailed above, before entering any stream or Neuse Riparian Buffer. For these reasons, we believe it is unreasonable to require additional diffuse flow measures on these properties. The attached basin designs will capture the runoff from the first inch of rainfall and release it through an underdrain that will promote percolation into the soil while reducing the instantaneous flowrate from this I- inch rainfall event. No BMP worksheets or Operations and Maintenance Agreements are attached because we hope that upon your review of the supporting information, you will agree that diffuse flow measures are not warranted on these lots. Sullins, Director Division of Water Quality DWQ EXP# 07-1189 Wake County On-Site Determination for Applicability to the Neuse Riparian Area Protection Rules (15A NCAC 2B .0233}EXPRESS REVIEW PROGRAM On July 13, 2007, at the request of Mr. Scott Mitchell of Mitchell Environmental, P.A., an on-site determination was conducted to review five stream features located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC 2B .0233). The features are labeled as "A" through "E" on the attached map, initialed by Lia Myott on July 13, 2007. The Division of Water Quality (DWQ) has determined that the following: • Feature "A" is subject to the Neuse Buffer Rule on the property at the flag labeled by DWQ as "A 1 ". Feature A is an intermittent stream. • Feature "B" is subject to the Neuse Bu„tfer Rule from the flag labeled "B 1" to the flag labeled "B2" (isolated stream). At the DWQ flag labeled "B3", the feature again becomes an intermittent stream and is therefore subject to the Neuse Buffer Rule. • Feature "C" is subject to the Neuse Buffer Rule on the property at the flag labeled "C 1 ". The stream was determined to be intermittent at "C 1 ". • Feature "D" is subject to the Neuse Buffer Rule on the property from the flag labeled "D6" to "D7" and from flag "D8" to "D9" (isolated intermittent streams). Downstream from flag "D6" the feature becomes a wetland and is therefore not subject to the Neuse Buffer Rule. • Feature "E" is a wetland with no stream features and is therefore not subject to the Neuse Buffer Rule. This on-site determination shall expire five (5) years from the date of this letter. This letter only addresses the intermittent/perennial status of the stream features listed above according to current DWQ standards and does not approve any activity within the streams or address features that were not observed during the site visit.
