Dear Mr. Ausband:
Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9,
1994 (or as subsequently amended).
Please be aware of the following dates as indicated within section A.(1.) of the permit:
■ The Enterococci limits (monthly average and daily maximum) take effect on February 1, 2008.
Please note the daily maximum limit was added subsequent to the draft permit as a result of
comments received from US EPA; and
• The Total Residual Chlorine limit takes effect on February 1, 2009.
Until these limits become effective, you are still required to monitor and report the data results for
each parameter as required by the subject NPDES permit.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within
thirty (30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, the Coastal Area Management Act or any other
Federal or Local governmental permit that may be required.

revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under

Wastewater Permit
On the basis of thorough staff review and application of NC
General Statute 1,13.21, Public law 92-500 and other. !awful
standards and regulations, the North Carolina
Environmental Management Commission proposes to issue
a National Pollutant Discharge Elimination System
(NPDES) wastewater discharge permit to the person(s)
listed below effective 45 days from the publish date of this
notice.
Written comments regarding the proposed permit will be
accepted until 30 days after the publish date of this notice.
All comments received prior to that date are considered in
the final determinations regarding the proposed permit. The
Director of the NC Division of Water Quality may decide to
hold a public meeting for the proposed permit should the
Division receive a significant degree of public interest.
Copies of the draft permit and other supporting information
on file used to determine conditions present in the draft
permit are available upon request and payment of the costs
of reproduction. Mail comments and/or requests for

Snug Harbor Management, LLC (PO Box 150, Sea Level,

permit NC0026327 for Snug Harbor on i also:: Say ir,
Carteret County. This permitted facility currently discharges
20,000 gallons per day treated wastewater into Salters
Creek in the White Oak River Basin. Currently, BOD
and total residual chlorine are water quality limited. This
discharge may affect future allocations in this portion of
the White Oak River Basin.
West Carteret Water Corporation (PO Box 849, Newport,
NC 28570), has applied for renewal of NPDES permit
NC0077143. This permitted drinking water treatment
facility discharges treated wastewater to the East Prong
Sanders Creek in the White Oak River Basin. Some
parameters may be water quality limited, which may affect
future allocations in this portion of the White Oak River
Basin.
The Town of Pine Knoll Shores (100 Municipal Circle, Pine
Knoll Shores, NC 28512) has applied for renewal of NPDES
permit NC0082520 for the Pine Knoll Shores WTP in
Carteret County. This permitted facility presently is not in
operation and has 0 MGD of treated wastewater
discharging to Pine Knoll Shores canal to Bogue Sound in

The treatment plant consists of one aerated flow equalization tank, dual train 12,000 gallon
aeration basins, two 4,416 gallon hopper type clarifiers, two tertiary filters with combined
capacity of 4.0 gpm/ft2, 3,600 gallon chlorine contact chamber and 6,000 gallon aerated sludge
holding tank.

Residuals handling and utilization/disposal scheme:
The permittee had used Lewis Farms of Burgaw in the past for sludge disposal, however the
application and additional information letter did not identify the contractor hired to dispose of
sludge. Prior documentation from a compliance evaluation inspection in September indicated
that the facility utilized Lewis Farms of Burgaw, Permit No. WQ0000455, for the disposal of
wastewater treatment residuals. A review of the current permit for Lewis Farms of Burgaw
does not include Snug Harbor WWTP. The facility must provide current documentation
showing acceptance by Lewis Farms of Burgaw, Inc. for the disposal of residuals from the
facility.
Compliance history for this facility within the past permit cycle is as follows:
Eight (8) violations have occurred in the past permit cycle, five (5) for Fecal Coliform
bacteria exceedances, in some cases as high as 1293% over permit limitations. The
violations resulted in three (3) enforcement penalties and three (3) notices of violation.
Please see the attached NPDES Permit Violation Summary for details.

PART V - EVALUATION AND RECOMMENDATIONS
It is strongly recommended that a special condition be placed in the permit requiring the facility to
hire a North Carolina licensed professional engineer to conduct a structural integrity evaluation as
well as a diagnostic investigation to ensure that all components of the facility area in good working
condition considering the age of the system and the compliance history. The facility has some
significant leaks in the basin side walls between the tertiary filter and mudwell.
This facility has had problems with high copper in the sludge. It has posed a problem with Lewis
Farm's ability to land apply the sludge. Lewis Farms has continued to haul their sludge (although
they no longer have Snug Harbor on their permit) but has relied upon mixing the sludge with another
facility's sludge in order to dilute the copper concentration. The Surface Water Protection Section
has notified the Aquifer Protection Section regarding this situation (see attached letter dated March
1, 2007). The facility investigated every possible source of copper including medicines, copper
plumbing and cleaning agents. Influent sampling for copper was conducted in an attempt to identify
the source. Influent results proved negative for copper. It is theorized that the concrete used for
casting the aeration, clarifier and sludge holding basins may contain copper and zinc. The slow
deterioration of the tank walls may be releasing copper and zinc into the treatment system. Since
copper concentrations are high in the sludge, it may be possible that copper concentrations above the
water quality standard action levels may be present in the effluent, potentially posing toxicity issues
for aquatic life. It may be prudent to include monitoring for either copper or include whole effluent
toxicity monitoring.
The draft permit has been received by the Wilmington Regional Office. The draft included total
residual chlorine limitations and Enterococci Bacteria monitoring with limits.
The Wilmington Regional Office recommends reissuance of the permit in accordance with the White
Oak River Basin Plan permitting strategy provided no significant adverse public comment is
received. The Wilmington Regional Office also requests that the recommendations provided herein
are considered in the reissuance of Permit No. NC0028827.

EPA (Marshal Hyatt and Joel Hansel) agreed to our proposal to use 276/100 ml as a
weekly average or daily maximum for enterococci. Publicly owned treatment works will
get the 276/100 ml as a weekly average and non publicly owned will get it as a daily
maximum
They also commented on the language we are using in letters that says that the EMC is
adopting the bacteria criteria, they want us to say that is based on the EPA's
promulgation of the criteria in November 2004. The reason is that EPA has to give
final approval to the triennial review and they haven't done so yet. I understand
they haven't received the package yet and they have 90 days to approve it.
They question the schedule of compliance we are using but did not object to continue
using it. They are going to send us a memo that has more information about schedules
of compliance, we did not go into much detail here. I'm sure we will hear more about
this latter.

Dear Ms. Bryant:
As requested in your letter dated January 19, 2007, we are supplying the additional
information that your office has requested to process our permit renewal.
An outside contractor is hired to remove the sludge from our plant. After removal, the
sludge is treated and disposed of per the contractor's permit requirements. Our sludge is, on
average, removed once a year.

214000 gpd dual train, extended aeration package plant, consisting of two 12,000 gallon
aeration chambers, two 4,416 gallon, hopper type, settling chambers, and two tertiary
filters with a combined capacity of 4.0 gpm/sq, ft. The plant also includes a 3600 gallon
chlorine contact tank and a 6000 gallon sludge holding. tank.
Plant designed for 96% BOD reduction at an influent measurement of 240 mg/1, 95%
TSS reduction at an influent measurement of 240 mg/1, 50% nitrogen reduction at an
influent measurement of 20 mg/1, and 0% phosphorus reduction at an influent
measurement of 10 mg/l.

Following an inspection of Snug Harbor WWTP (NPDES Permit No. NC0028827) located in
Carteret County, I determined the facility was dropped from the Lewis Farms permit sometime
between June 2003 and June 2004. They were originally added to the permit in July 2000.
Lewis Farms decided to drop the facility from the permit due to high copper concentrations in the
sludge. The facility was never notified they had been dropped and continued to have sludge
picked up and land applied by Lewis Farms. Since June 2004, Lewis has continued to pick up
sludge from the facility. Three pickups have been made on 4/1/04, 2/16/05, and 3/28/06 since
removing the facility from the permit.
The facility has been notified of this situation as they were unaware they had been removed from
the Lewis Farms permit. Please take a look at this situation, as the facility must resolve this issue
in order to be compliant with the residuals management requirements of their NPDES discharge
permit.
