Dear Mr. Allen:
In accordance with your request for modification of a downstream
monitoring station and frequency of instream color monitoring, the NPDES
staff has reviewed the permit and accordingly, we are forwarding herewith this
modification to the subject permit.
Please find enclosed the amended NPDES permit pages and the old pages
should be discarded. The old "D 1" downstream sampling location near NCSR
1960 has been changed due to safety concerns. The new "D 1" site is located
approximately 2620 feet below the discharge point of the Albemarle WWTP and
is near an old monitoring well site located on Albemarle city property. In
addition, the permit will now reflect instream color monitoring will be
conducted twice per month to coincide with effluent color monitoring. This
permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina
and the U.S. Environmental Protection Agency.
If any parts, measurement frequencies or sampling requirements
contained in this permit are unacceptable to you, you have the right to an
adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be in the form of a written petition,

addresses the requirements to be followed in case of change in ownership or
control of this discharge.

with the permit. However, the Permittee shall continue to record and submit all values reported by a North
Carolina certified laboratory (including field certified), even if these values all below 50 ug/L.
5. Chronic Toxicity (Ceriodaphnia) at 90%: March, June, September, & December (see Part I. A. (3.)).

Subject: RE: Albemarle instream monitoring sites
Holly called me last week and said that her staff had gone out to check the sites recommended in the Sept. 11 email.
Their findings were as follows:
1) Scenic View Road — They couldn't see the creek. It was private property with "no trespassing" signs.
2) End of Mabry Road - They couldn't see the creek at the end of the road. There were "no trespassing" signs and
the area "looked rough", not a good area to be in.
From the Scenic View Road site, they were able to see the city property. They went to that spot which was around 3200
feet from Albemarle's outfall. They are wondering if this site would be acceptable. You will probably have to talk to
their staff person, Brandon, to see exactly where this accessible site is.
Albemarle is also going to clarify the location of site D3 (approximately 200 feet below the outfall). There should be
color monitoring done at site D3.

Today I talked with Holly Overcash of Albemarle and we reviewed their proposed downstream site on Hartsell Road. 1
told her that it appeared to be downstream of the existing D2 Sides Road site and would not be accepted as a new D1
site. She said they had already looked for an alternate entrance on the Efrids Rifle Range site and none was accessible.
I gave her the proposed sites we found on Mabry Rd (farm property area) and Scenic View Road and she said she would
have her people check them out. She will contact me with the results of their search.

City of Albemarle submitted a request to change one of the downstream sampling sites for the facility.
The request in June 2012 asked that the sampling site for D1 be changed because its location near a
rifle range. Their employees were concerned for their safety because the access to the sampling site
was behind a bunker that was used to stop ammunition. Albemarle recommended a new site, Long
Creek Bridge on Hartsell Road, however the proposed site appeared to be further downstream, below
another downstream site D2. This new site would not provide data close enough to the discharge as
the existing D1.
Existing D1 — State Road 1960 — Mabry Road (per M. Parker 8/28/2012)
Proposed D1 — State Road 1968 - Hartsell Road
Existing D2 — State Road 1967 — Sides Road
Consulted with Mike Parker of MRO and we reviewed the Albemarle and Long Creek area online via
Google maps. We saw the probable sampling site behind the Efrids Rifle Range and also looked for
other possible accesses to the creek. Potential accesses per our review:
1) Mabry Road through a farm area
2) Scenic View Dr.
3) through Efrids Range but another entrance other than behind the ammo bunker.
After talking with the City, will contact MRO again and they will have staff go out and verify the access
points.
Called the City (Holly Overcash, 704-984-9630, and discuss whether they have looked at access to Long
Creek from other sites, perhaps on the other side of the river.

12/17/2012 Telecon with Wes Bell, MRO
Wes had gone out with Albemarle staff to look at sampling sites and Albemarle is proposing a site
approximately 2600 feet below the discharge point. Its very accessible, they can get to the creek safely
and it's on Albemarle's property. The site is near an old monitoring well that Albemarle had when they
land applied their sludge. Wes concurs with the site.
Also, Albemarle is requesting that permit reflect that they sample instream for color twice a month, the
same as when the permit requires effluent color sampling. I will make this frequency change for
instream color sampling on the effluent page.

I am writing to request one of our creek sample points be moved. Currently, the sample point
"D1" is located at Efrid's Rifle Range (State Road 1968) at N35°30.1852", W80°23.5901". It
has been brought to my attention that this sampling location poses a major safety issue to
employees taking samples at this location. In order to sample the creek at this location,
employees must travel down a treacherous path and go behind a small "earthen bunker" used
to stop ammunition being fired at the rifle range.
I would like to request that the sampling point be moved to the Long Creek Bridge on
Hartsell Road at N35°16'0.1756", W80°15'24.7913". This location is a much safer place to
obtain samples from the creek due to the absence of the rifle range and gun fire. The path to
the creek is also less treacherous in this area.
