Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of \Xtater Quality or permits required by the Division of Land
Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be
required.

This permit shall become effective April 1, 2001.
This permit and authorization to discharge shall expire at midnight on December 31, 2005.

This letter is in regards to the residual chlorine limits for Cane Creek Middle School. Your most
recent inspection of this facility with our operator, Mr. Henson, revealed that the 28 ug/I is
awfully low for a plant of this size. Mr. Henson has monitored this effluent problem very closely
since the opening of the plant and has had difficulty in maintaining this limit.
I would like to request that the residual chlorine limit for this plant be raised to 700 ug/l, which
mirrors our sister WTP at Fairview Elementary. Your assistance with this matter would be
greatly appreciated. If you have questions or require more information, please contact me at the
above numbers.

Dear Ms. Jackson:
The following is in reference to your request for a narrative description of the sludge management
plan for the subject wastewater treatment facilities.
There are no sludge handling treatment units on -site, or is the sludge discharge to the receiving
waters.
RPB Systems Inc., our contracted wastewater operator, contracts the pumping of excess solids as
indicated by the increasing MLSS (mixed liquor suspended solids). The ORC or on -site operator
makes this assessment based on MLSS lab results. As the MLSS increases beyond the
recommended concentration, solids are wasted from the activated sludge system. The contract
hauler takes the waste activated sludge to a local municipality, which accepts such wastes, or to
another wastewater treatment plant that has experienced an upset and is in need of reseeding.

7. This agreement may be terminated by either party by
giving thicty (30) days written notice to the other;
and, further, the City may immediately terminate this
agreement upon seventy-two (72) hours written notice to
the Septage Hauler should the Septage Hauler be found in
non-compliance with any provision of this agreement or
should the Septage Hauler's discharge to the
Pretreatment Facility be determined to jeopardize or
violate the! City's NPDES Permit by which it operates its
Sewer System. The City reserves the sole and absolute
right and discretion to terminate this agreement.
8. This agreement shall be controlled and governed by the
laws of the State of North Carolina and the Code of
Ordinances of the City of Brevard.
9. The discharge of septage into the City's Pretreatment
Facility shall be limited to such wastewaters which
originate from within the State of North Carolina ar..d no
other such wastes will be permitted for disposal from
any other place.
