West Wendover Ave. and Sapp Rd. Property. Dear Mr. Mustin: In accordance with the State of North Carolina's Rule 15A NCAC 0213.0250- Randleman Lake Water Sully Watershed; Protection and Maintenance of Riparian Areas, any applicant that intends to disturb Zone 1 and Zone 2 of the stream buffer must show that there is "No Practical Alternative" than to impact the stream buffer. The applicant submitted a "No Practical Alternative Request" on August 18, 2014 stating that the stream buffer disturbances in Zone 1 and Zone 2 were necessary for the access driveways for the proposed development. It was determined that the permanent impacts of 18,081 square feet in Zone 1 and 15,801 square feet in Zone 2 of the Randleman Watersupply Watershed stream buffer were necessary to install the two access driveways required for the proposed development. The required mitigation after including the ratios is 77,944.5 square feet. Per 15A NCAC 02B.0252(6) the mitigation determination may be met through payment of a compensatory mitigation fee to the Riparian Buffer Restoration Fund pursuant to the rule. The City of Greensboro believes that the applicant for the Sapp Rd. Development has met the regulatory requirement by providing an acceptance letter from NC EEP. In addition, the applicant should secure any other required federal, state, and local certifications before the project proceeds. This approval is valid only for the purpose and design that was described in the application. No disturbance is allowed until the receipt of payment for the mitigation is received by the City of Greensboro. If any modifications are made to the project a written notification describing the changes, must be submitted to the City of Greensboro Water Resources Department, Engineering Division. If the property is sold, the new owner must be given a copy of the certification and approval letter and is thereby responsible for complying with all conditions. This letter completes the review of The City of Greensboro, Water Resources Department, Engineering Division (Stormwater Engineering Section) under the Determination of No Practical Alternative.
