TATA SECRETARY Subject: Pre- Construction Notification for proposed replacement of Bridge No. 230330 over UT Cow Bog Branch on SR 1006 in Columbus County The North Carolina Department of Transportation ( NCDOT) proposes to replace the 19 -foot 4 -inch, single span Bridge No. 230330 with a 20 -foot 1 -inch by 6 -foot 6 -inch Corrugated Aluminum Box Culvert on the existing alignment. Traffic will follow an offsite detour during construction. Permanent impacts to jurisdictional resources cover approximately 0.01 acres resulting from placement of the Corrugated Aluminum Box Culvert. Please see enclosed copies of the Pre- Construction Notification (PCN), Preliminary Jurisdictional Determination Form, permit drawings, stormwater management plan and design plans for the above - referenced project. The State Minimum Criteria Checklist was completed on 6/25/2012 and copies were distributed shortly thereafter. Additional copies are available upon request. This project was let on 2/19/2013 and construction is due to begin 9/25/2014. Regulatory Approvals Section 404 Permit: All aspects of this project are being processed by the Federal Highway Administration as a "State Minimum Criteria Checklist" in accordance with 23 CFR 771.115(b). The NCDOT requests that these activities be authorized under a Nationwide 14 permit. Section 401 Permit: The NCDOT requests that these activities be authorized under Water Quality Certification Number 3886. We anticipate that written approval from the NC Department of Water Resources will be required. Williams North Carolina Department of Transportation Transportation Program Management Unit 1595 Mail Service Center Raleigh, North Carolina 27699 -1595 Dear Ms. Williams: 'This letter is in response to your request for comments from the U.S. Fish and Wildlife Service (Service) on the potential environmental effects of 15 proposed Year -2 Design -Build Bridge Replacement projects in Division 6, Columbus County. The following comments provide information in accordance with provisions of the National Environmental Policy Act (42 U.S.C. 4332(2)(c)) and Section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531- 1543). Specific Comments Columbus County Bridge #342: The federally threatened Waccamaw silverside (Menidia extensa) occurs in Lake Waccamaw. Also, Lake Waccamaw is designated Critical Habitat for the Waccamaw silverside. Bridge #342 is-located approximately 120 feet upstream of this Critical Habitat. It is unknown if Waccamaw silversides occur within this canal; however, the project could potentially affect this species and Critical Habitat. Of greatest concern would be sediment input into the canal flowing into Lake Waccamaw or any other degradation of water quality resulting from bridge replacement. To further discuss this project, the Service desires to attend the field scoping meeting for this bridge, preferably on the June 21 date. Columbus County Bridge #47 #49 #62 #212 #213 #217 #231 #232 #235 #240 #243 #245 #330 and #336: The Service does not have any specific concerns for any of these projects. General comments apply. We do not plan to attend any of these field scoping meetings.- General Comments The Service recommends the following general conservation measures to avoid or minimize environmental impacts to fish and wildlife resources: 1. Wetland, forest and designated riparian buffer impacts should be avoided andminimized to the maximum extent practical; 2. If unavoidable wetland or stream impacts are proposed, a plan for compensatory mitigation to offset unavoidable impacts should be provided early in the planning process; 3. Off -site detours should be used rather than construction of temporary, on -site bridges. For projects requiring an on -site detour in wetlands or open water, such detours should be aligned along the side of the existing structure which has the least and/or least quality of fish and wildlife habitat. At the completion of construction, the detour area should be entirely removed and the impacted areas be planted with appropriate vegetation, including trees if necessary; 4. Wherever appropriate, construction in sensitive areas should occur outside fish spawning and migratory bird nesting seasons. In waterways that may serve as travel corridors for fish, in -water work should be avoided during moratorium periods associated with migration, spawning and sensitive pre -adult life stages. The general moratorium period for anadromous fish is February 15 - June 30; 5. New bridges should be long enough to allow for sufficient wildlife passage along stream corridors; 6. Best Management Practices (BMP) for Construction and Maintenance Activities should be implemented; 7. Bridge designs should include provisions for roadbed and deck drainage to flow through a vegetated buffer prior to reaching the affected stream. This buffer should be large enough to alleviate any potential effects from run -off of storm water and pollutants; 8. The bridge designs should not alter the natural stream and stream -bank morphology or impede fish passage. To the extent possible, piers and bents should be placed outside the bank -full width of the stream; and 9. Bridges and approaches should be designed to avoid any fill that will result in damming or constriction of the channel or flood plain. If spanning the flood plain is not feasible, culverts should be installed in the flood - plain - portion of the approach to restore some of the hydrological functions of the flood plain and reduce high velocities of flood waters within the affected area. Section 7(a)(2) of the Endangered Species Act requires that all federal action agencies (or their designated non - federal representatives), in consultation with the Service, insure that any action federally authorized, funded, or carried out by such agencies is not likely to jeopardize the continued existence of any federally threatened or endangered species. To assist you, a county - by- county list of federally protected species known to occur in North Carolina and information on their life histories and habitats can be found on our web page at http://www.fws.gov/nc- es/es/countyfr.html .
