Notice of Violations and Assessment of Penalty: NOV-2022-LV-0482
Mr. Tankard,
Sandler Utilities at Mill Run, LLC ("Sandler Utilities") appreciates the opportunity to respond to the Notice of Violation
dated July 19, 2022, for the below -referenced violations for the month of May 2022. This letter shall serve as Sandler
Utilities' response, and it is our hope that the information provided will result in no further action by the Division.
Limit Violations: Effluent
■ Coliform, Fecal 5/24/2022 25 61 Daily Maximum Exceeded
■ Nitrogen, Ammonia Total 5/24/2022 6 33 Daily Maximum Exceeded
■ Nitrogen, Ammonia Total 5/26/2022 6 24.3 Daily Maximum Exceeded
■ Nitrogen, Ammonia Total 5/31/2022 4 28.65 Monthly Average Exceeded
■ Solids, Total Suspended 5/31/2022 5 7.8 Monthly Average Exceeded
After a thorough investigation we have concluded that the high ammonia was due to a lack of DO in the aeration basin.
Adjustments were made to the blower timers to ensure proper aeration. TSS and Fecal exceedances were due to a faulty
filter system and an extremely high biological count in the aeration basin. Steps have been taken to rectify the situation.
Permit conditions violation
5/25/2022 — 5/30/2022 - Facility did not meet fecal limits and did not transfer effluent to high -rate pond
as required in condition III. 21 of the permit.
The transfer was made; however, the technician/operator did not inform DWQ. The valve was manually
turned to send effluent to the high -rate infiltration basin.
As DWR is no doubt aware, Sandler Utilities has expended substantial resources in improving the wastewater collection
and treatment systems at Eagle Creek and continues to work on improvements. We will continue to work with our
operator to ensure that these violation do not recur.
