To All
Attached is a complete PCN application and DWR application fee for the ASHBURY, Ph.2 project in
Mebane, NC (Orange Co. portion, not Alamance Co.). Paper copies will be hand delivered today.
Permanent impacts have been minimized of < 1 /10th acre of wetlands and 148 feet of stream. They
also realigned and redesigned the road crossing of the stream so as to avoid a nice, bedrock
cascade. Stormwater will be reviewed and approved by the City of Mebane and is proposed to be
directed to an existing stormwater pond originally sized in anticipation of this phase.
Please contact me if you need any additional information or have questions.
Sincerely,
Bob Zarzecki

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Lots adjacent to wetland were designed with the least amount of depth needed to construct a home to minimize wetland impacts to < 1 /10th acre.
Mockingbird Lane crossing of Mill creek was designed with steep 2:1 slopes with concrete slope protection to enable the pipe to stop below an existing
natural rock cascade. The temporary check dam needed for the pump around bypass during construction will be installed just above this cascade. An
upstream rip -rap dissipater was eliminated from the design to avoid impacts to the cascade. The downstream rip -rap dissipater will be set at grade.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
A land disturbance permit and erosion control plan will be approved to included temporary erosion and sediment control measures during construction
to minimize sediment loss to the streams and wetlands. All post- construction, permanent stormwater runoff will be directed to the existing wet
detention pond located on the north side of Mill Creek. The wet pond was originally designed to treat this area.
2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State

E. Stormwater Management and Diffuse Flow Plan (required by DWQ)
1. Diffuse Flow Plan
1a. Does the project include or is it adjacent to protected riparian buffers identified
❑X Yes ❑ No
within one of the NC Riparian Buffer Protection Rules?
1 b. If yes, then is a diffuse flow plan included? If no, explain why.
Mill Creek is within the Haw River / Jordan Lake basin and subject to the Jordan Buffer Rules. The City
Yes No
of Mebane will review for compliance with these rules. A diffuse flow plan is not provided because all
❑ ❑X
stormwater from this project will be treated by the existing wet pond with an existing outlet. No new
stormwater conveyances are proposed through the buffers.
2. Stormwater Management Plan
2a. What is the overall percent imperviousness of this project?
27%
2b. Does this project require a Stormwater Management Plan?
❑X Yes ❑ No
2c. If this project DOES NOT require a Stormwater Management Plan, explain why:
2d. If this project DOES require a Stormwater Management Plan, then provide a brief, narrative description of the plan:
The stormwater management plan will be reviewed and approved by the City of Mebane a DWR certified local government. All stormwater runoff from
this project will be directed to an existing wet detention pond on the north side of Mill Creek. The wet pond was sized to handle and treat this area. No
new stormwater conveyance will be constructed through the buffer to the stream. We ask for a conditional 401 approval to provide the Town approved
SMP once received. They want to make sure that they will obtain the 401 prior to completing the SMP design, the concept of which has already been
accepted by the Town.
2e. Who will be responsible for the review of the Stormwater Management Plan?
