Good morning All,
The DWR has reviewed the additional information submitted and continues to have concerns
regarding impacts to surface waters and aquatic resources. The DWR conducted a follow-up site
visit on July 7, 2022, to further evaluate the site in response to the additional information received.
In accordance with 15A NCAC 02H .0506 the DWR is required to evaluate if a proposed activity "has
avoided and minimized impacts to surface waters and wetlands to ensure any remaining surface
waters or wetlands, and any surface waters or wetlands downstream, continue to support existing
uses during and after project completion;". The application is on hold until information to address
the concerns listed below has been received by our office.
Based on the review of the plans and the site evaluation, the DWR believes the impacts associated
with this activity can be further minimized. The plans received with the DRG additional information
fails to identify the existing shellfish resources waterward of the existing bulkhead and the impacts
to those resources. The live shellfish bed consists of oyster clusters in the soft bottom and clusters
established on old pier pilings that were encased in concrete and cut off when the platform was
repaired. The attached photos show the old round pilings encased in concrete as well as newer
square pilings that support the existing platform. The DWR, DMF and WRC recommended a docking
facility configuration that supports and maintains the viability and integrity of the existing shell fish
bed. The information received fails to demonstrate how the facility has been designed to
accomplish this and it is unclear what the impacts to the existing resources will be from the driving
of pilings associated with the docking facility. If the remnant pilings are to be removed, the impacts
associated with the removal of the concrete encased pilings will need to be detailed and any
excavation quantified.
The additional information received states that the 4 foot alignment is necessary to tie into the
existing bulkhead sheathing to the east. The existing eastern bulkhead has been constructed with a
45 degree angle that would allow for a tie-in at an outboard alignment of approximately 2.2 feet (see
attached photos). A 2.2 foot alignment would also avoid impacts to the existing shellfish resources
that are present in the area. The DWR would support this alignment.
During my site visit yesterday construction was ongoing at the existing residence, however no details
nor the existing house footprint have been shown on the plans provided. CAMA major permit
applications are distributed to the post -construction stormwater group at DEMLR for review. It is my
understanding that water dependent structures are excluded from the requirements for
stormwater. However, the exclusion does not apply to future highground development. You may
want to contact a representative at DEMLR and/ or DCM for clarification.

Attached you will find comments provided by NCDMF and NCWRC detailing concerns with the
proposed bulkhead and docking facility at 18 Pelican Drive in Wrightsville Beach.
I have also included the DWR hold letter for reference. As a result of the DWR hold, the Division of
Coastal Management is also placing this project on hold pending the applicant's response to the
Request for Additional Information (RFAI).
