We have already proceeded with repairs and clean ups to most of the problem areas listed in the NOV and, we are in the process of preparing the formal response. I have a question concerning the requirement listed to perform the wetland delineations at the two locations where the sediment was lost off-site onto private property. We have encountered some reluctance from the property owners in gaining access to their property. The contractor has had some productive communications with the property owner associated with the deposition from Sta. 325+00. It is my understanding that the property owner has requested a specific method of clean-up at his pond. It is our intention to have all of the sediment depositions removed to an acceptable level per the directions previously given to us by your agency. We intend to do this at all of the sites listed in the NOV that we are given access to. My question is; will it be necessary to perform a wetland delineation at sites that are temporarily impacted and won’t require mitigation? We are willing to concede that the area impacted at sta. 325+00 is jurisdictional. As always, we are willing to pay for mitigation when the impacts were permanent. However; we would like to avoid the time and expense involved with having a formal delineation done, along with the survey work that would be needed to document and map those locations if, the impacts are temporary. We believe that the sites can be effectively cleaned and, would ultimately be considered as temporary impacts.
