Accordingly, we are forwarding the attached NPDES permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.Environmental Protection Agency dated October 15,2007(or as subsequently amended). The following changes were made to the second draft permit sent to you on May 12,2022: • A footnote was added to the instream monitoring section [A. (8.)] to provide the Permittee a provisionary waiver for membership in a monitoring coalition. • Several numbering typos were corrected. • Based on detection of PFAS chemicals(including PFOA and PFOS) and the discharge into a WS- IV water,PFAS monitoring was increased to quarterly based on recently updated draft EPA Health Advisories. Attached is a listing of comments received and Division responses in the form of a Fact Sheet Addendum. This final permit maintains the following significant changes identified in the letter sent on May 12, 2022: • The system component list on the Supplement to Cover Sheet was revised based on communication with facility staff. • Based on your request and NPDES guidance regarding the reduction of monitoring frequencies in NPDES permits for exceptionally performing facilities, monitoring requirements for BOD5, Total Suspended Solids,Ammonia-Nitrogen and Fecal Coliform will continue reduced at twice per week [See A. (1.)]. • Based on the reasonable potential analysis (RPA) showing no reasonable potential to violate state water quality standards, the monitoring requirement for Chloroform, Bromodichloromethane, Dibromochloromethane, Total Copper and Total Zinc were removed from thepermit [see A. (1.) . (1.)]. • Based on the RPA showing reasonable potential to violate state water quality standards with a limited dataset (n < 8 samples) and two (2) values above the allowable effluent concentration, quarterly monitoring for Bis(2-ethylhexyl)phthalate and Nitrate-Nitrogen(NO3-N)were added to the permit [see A. (1.)]. • Based on Mercury TMDL evaluation showing no individual results exceeded the TBEL of 47 ng/L and no annual average exceeded the WQBEL of 12.0 ng/L,total mercury limits were removed from the permit. • Based on Mercury TMDL evaluation showing mercury detectable values reported at levels > 1 ng/L and since the permitted flow is greater than 2 MGD, a Mercury Minimization Plan special condition was added to the permit [see A. (1.)and A(11.)]. • The Division is implementing dissolved metals standards in all permits, per the 2016 revisions to State water quality standards.As such, the NPDES Permitting Unit will need site-specific effluent hardness data for each facility monitoring these metals in order to calculate permit limitations. Effluent hardness was added to the permit at a quarterly monitoring frequency [See A. (1.)]. • Based on the Jordan Lake nutrient strategy (15A NCAC 02B .0270), nutrient allocations are set among permitted dischargers; nutrient load allocations can be raised if a permitted source connects to another permitted source, thereby receiving that other source's allocation and thus raising its limits. Since the Triangle WWTP is receiving additional load from non-permitted sources, the additional load must fit within the facility's allocations to meet compliance. The allocated nutrient loads are maintained in the permit[see A. (6.)]. • Based on minimum monitoring requirements for domestic wastewater facilities (15A NCAC 02B .0508), instream (upstream and downstream) monitoring for Dissolved Oxygen, Temperature, Fecal Coliform and Conductivity are maintained in the permit,but reduced to a monthly frequency [See A. (2.)]. • Based on the facility treating industrial wastewater,conductivity effluent monitoring was added to the permit [See A. (1.)]. • Based on concerns over loss of instream monitoring efforts in tracking the progress of the Jordan Lake nutrient strategy (15A NCAC 02B .0262), instream monitoring for Total Phosphorus (TP), Orthophosphate (PO4), Total Kjeldahl Nitrogen (TKN), Nitrate + Nitrite (NO3+NO2), and Ammonia-N(NH3-N)were added to the permit at monthly frequencies [See A. (2.)]. • Based on detections of the emerging contaminant 1,4-Dioxane in the waste stream at levels < 10 µg/L from limited data (< 12 samples) in July-September 2019, monthly monitoring for 1,4- Dioxane was added to the permit. • A permit reopener special condition was added to modify 1,4-Dioxane monitoring,treatment and/or compliance [see A. (11.)]. • A special condition to monitor effluent PFAS chemicals was added to the permit, to be effective six (6) months after EPA has a final wastewater method in 40 CFR136 method published in the Federal Register. • Some of the wording has changed in Special Condition A. (3.), Chronic Toxicity Permit Limit, please review each paragraph carefully. • Special Condition A. (4.) was modified to include the specific three years in which the Effluent Pollutant Scan shall be performed (2024, 2025, and 2026). In addition, at the end of the Special Condition, 2nd species Toxicity Testing Requirements for municipal permit renewals per Federal Regulations [40 CFR 122.21(j)(5)] was added. • Federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and program reports. The requirement to continue reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR) internet application was added to the permit[See Special Condition A. (13.)]. (1.),A. (2.),and A. (4.)]. • Regulatory citations were added to the permit. • The map has been revised to show the instream monitoring"upstream"and"downstream"locations in relation to the Outfall. Pretreatment updates in response to NPDES permit renewal: • On February 28, 2023, 180 days after the effective date of this NPDES permit renewal, Durham County is required to submit to the Division a written technical evaluation of the need to revise local limits (i.e., an updated IWS/HWA-AT/L-STMP, or documentation of why is not needed). This action may include revising, updating, or adding to the list of SIUs regardless of timeframe. o Submit the updated Long-Term Monitoring Plan(LTMP) • Review pollutants of concern(POCs)and update the LTMP to reflect pollutants in industrial user permits(IUPs)and sludge management permit. • The specific PFAS parameters are to be determined upon EPA publishing a final wastewater method in 40 CFR 136 in the Federal Register. o As part of the local limits assessment, please submit the updated Headworks Analysis (HWA). If any parts,measurement frequencies or sampling requirements contained in this permit are unacceptable, you have the right to an adjudicatory hearing upon written request within thirty(30)days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh,North Carolina 27699-6714).Unless such demand is made,this decision shall be final and binding. The NPDES standard conditions (Parts II, III, and IV) are the same as in your current permit except that agency and division names have been updated. Bis(2-ethylhexyl) phthalate hits are typically due to sampler and/or lab contamination. Out of three results, the last two were less than detect which could lead one to believe the first was a contaminated sample." Response: Request considered;The reported Bis(2-ethylhexyl) phthalate concentrations are valid results certified by the laboratory and have been incorporated into the Reasonable Potential Analysis. As such, the monitoring requirements have been maintained. Comment:The County requests"1,4-Dioxane be removed from the permit as the three values used were influent results, but NCDWR used these results as if they were effluent results to suggest reasonable t potential to exceed a water quality standard that has not been adopted. NCDWR also used one half on the detection limit for the values that were less than when this method should only be used for pretreatment determinations. Per the DMR guidelines, less than values are considered zero which would have put the average under the allowable effluent concentration." Response: 1,4-Dioxane is completely miscible in water and resistant to degradation under conventional treatment. As such, detectible amounts in the influent indicate presence in the effluent. In evaluation, RPA uses half of the detection level for results below detection; the guidance referenced in the request pertains to calculating averages for DMR submittal, not RPA. Further, one of the non-detects is< 2 ug/L, which is above the Division's recommended level of 1 ug/L. 15A NCAC 2B .0505 (e) (4) requires that all test procedures must produce detection and reporting levels that are below the permit discharge requirements and all data generated must be reported to the approved detection level or lower reporting level of the procedure. If no approved methods are capable of achieving a detection level below the permit discharge requirement (or allowable discharge concentration) the method with the lowest detection level must be used.The County should use sufficiently sensitive test methods for all pollutants, including when performing Effluent Pollutant Scans. 1,4-Dioxane monitoring has been maintained in the permit. Comment:The County requests"PFAS only required to be monitored annually. From the last four analyses completed, Triangle Wastewater Treatment Plant (TWWTP) was below the allowable effluent concentration of 145.27 ng/L. Durham County staff has surveyed all industrial users,Significant and Local, and have notified them that PFAS is not allowed to be discharged. Page 15 of the Fact Sheet states that more results are needed for evaluation, and it is believed that annual sampling will provide that information. Also, there is no information to suggest reasonable potential to exceed a water quality standard that has not been adopted." Response:EPA has revised the draft Health Advisories for PFAS parameters PFOA and PFOS to levels below detection. Based on the detection of these and other PFAS parameters, monitoring for PFAS has been increased from 2/year to quarterly. To clarify, since an EPA method for sampling and analyzing PFAS in wastewater is not published in the Federal Register,the PFAS sampling requirement in the Permit includes a compliance schedule which delays the effective date of this requirement until the first full calendar DocuSign Envelope ID:72D4F5D6-EB4A-4F61-9CDA-5AC7B40D777A Triangle WWTP Fact Sheet Addendum NC0026051 quarter beginning 6 months after EPA has a final wastewater method in 40 CFR 136 published in the Federal Register.This date may be extended upon request and if there are no NC-certified labs. Comment: "Durham County is requesting that the in-stream monitoring requirements A.(2.) be revised to remove the nutrient monitoring. Currently, NCDWR has a Memorandum of Agreement with the Upper Cape Fear River Basin Association which samples downstream of the TWWTP, Station B367000 and upstream of the TWWTP, Station B3300000 for nutrients. Durham County believes this is redundant sampling and is an inefficient use of resources. Durham County may contest any stream sampling beyond the minimum required by 15A NCAC 02B .0500. Please note Durham County has in-house certifications for the tests required by 15A NCAC 02B .0500.The additional tests required in the draft permit requires the use of outside labs and considerable expense. Please recognize that Durham County voluntary submitted to the early application of the Jordan Lake nutrient limits, and as such believes it is most appropriate to use ratepayer's remittances for the treatment of wastewater and not for redundant stream monitoring. Furthermore, the In-stream Waste Concentration (IWC) is 100%, which caps our toxicity sampling requirements at 90%, and the 7010 flow is 0 cubic feet per second (cfs) for Northeast Creek making the creek makeup mainly our effluent discharge. Durham County is already required to monitor nutrients on the effluent.Again,this is redundant monitoring and inefficient use of resources." Response: The footnote to the instream monitoring table [A. (8.)] has been revised to include a provisionary waiver for membership to a monitoring coalition.To reiterate, based on concerns over loss of instream monitoring efforts in tracking the progress of the Jordan Lake nutrient strategy (15A NCAC 02B .0262)as a direct result of the removal of instream nutrient monitoring in the 2011 permit, instream monitoring for Total Phosphorus (TP), Orthophosphate (PO4), Total Kjeldahl Nitrogen (TKN), Nitrate + Nitrite (NO3+NO2), and Ammonia-N (NH3-N) was reinstated in this permit. The monitoring frequencies were adjusted to monthly to be consistent with those taken by monitoring coalitions so that if the Permittee chooses to join a monitoring coalition, instream monitoring may be waived with Division notification. Comment: "On page 7, the next to last paragraph states, "If the permittee monitors any pollutant more frequently than required by this permit,the results of such monitoring shall be included in the calculation & reporting of the data submitted on the DMR and all AT Form submitted." This should be modified to state "monitors any effluent pollutants more frequently than required" per 15A NCAC 02B .0506 as there is no regulation requiring reporting for additional influent or other location data not specified in the NPDES permit." Response: Comment received. As this language is standard language consistently applied to permits the language has been maintained. Comment: "The following typos need to be addressed" [a list of numbering typos is given]. Response:All typos have been corrected. (7.), Annual Limits for Total Nitrogen or Total Phosphorus. 7. Effluent hardness sampling should be performed in conjunction with testing for hardness dependent metals (cadmium, copper,lead,nickel, silver,and zinc). 8. Samples must be reported to a minimum of PQL< 1 µg/L using an appropriate 40 CFR Part 136 method. 9. See Special Condition A.12. 10. Samples must be collected once in summer(April 1 —October 31)and in winter(November 1 —March 31). 11. Chronic Toxicity(Ceriodaphnia)at 90%;February,May,August,and November;refer to Special Condition A. (3.). 12. The Permittee shall perform three Effluent Pollutant Scans and four second-species effluent toxicity tests during the term of this permit [see A.(4.)]. (b.) CHRONIC TOXICITY PERMIT LIMIT (Quarterly) [15A NCAC 02B.0200 et seq.] The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 90%. The permit holder shall perform at a minimum, Quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December 2010, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised December 2010) or subsequent versions. The tests will be performed during the months of February, May, August and November. These months signify the first month of each three-month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must be obtained during representative effluent discharge and shall be performed at the NPDES permitted final effluent discharge below all treatment processes. Total Nitrogen (TN) and Total Phosphorus (TP) allocations and load limits for NPDES dischargers in the Jordan Lake watershed are annual limits and apply on a calendar year basis. (b.) For any given calendar year, the Permittee shall be in compliance with the annual TN (or TP) Load limit in this Permit if: (i.) the Permittee's annual TN (or TP) Load is less than or equal to the effective limit, or (ii.) the Permittee is a Co-Permittee Member of a compliance association. If the Permittee is not a co-permittee member of a compliance association and the Permittee's cumulative annual TN (or TP) discharge exceeds the effective TN (or TP) Load Limit in this permit at any point during the calendar year, the Permittee is in violation of its TN (or TP) Load limit for the remaining days of that year, and each day of such continuing violation shall constitute a separate violation. (d.) The TN(or TP) Load limit in this Permit may be modified as the result of allowable changes in the Permittee's allocations. (i.) If the Permittee intends to join or leave a compliance association, the Division must be notified of the proposed action in accordance with the procedures defined in the association's NPDES permit. The TN and TP monitoring and reporting requirements in this Permit remain in effect throughout the term of the Permit and are not affected by the Permittee's membership in a compliance association. A.(8.) CALCULATION OF TOTAL NITROGEN OR TOTAL PHOSPHORUS LOADS [15A NCAC 02B .0270] (a.) The Permittee shall calculate monthly and annual TN (or TP)Loads as follows: (i.) Monthly TN(or TP)Load(lb/mo) =TN(or TP) x TMF x 8.34 where: TN or TP = the average Total Nitrogen or Total Phosphorus concentration (mg/L) of the composite samples collected during the month; TMF = the Total Monthly Flow of wastewater discharged during the month (MG/mo); 8.34 = conversion factor, from(mg/L x MG) to pounds. (ii.) Annual TN (or TP) Load (lb/yr)= Sum of the 12 Monthly TN (or TP) Loads for the calendar year. (b.) The Permittee shall report monthly Total Nitrogen and Total Phosphorus results (mg/L and lb/mo) in the appropriate discharge monitoring report for each month and shall report each calendar year's results (lb/yr)with the December report for that year. A.(9.) NUTRIENT MONITORING REOPENER [NCGS 143-215.1(b)] Pursuant to N.C. General Statute Section 143-215.1 and the implementing rules found in Title 15A of the North Carolina Administrative Code, Subchapter 2H, specifically, 15A NCAC 2H.0112(b) (1) and 2H.0114(a), and Part II, Sections B-12 and B-13 of this permit, the Director of DWQ may reopen this permit to require supplemental nutrient monitoring of the discharge. The additional monitoring will be to support water quality modeling efforts within the Cape Fear River Basin and shall be consistent with a monitoring plan developed jointly by the Division and affected stakeholders. MERCURY MINIMIZATION PLAN [NCGS 143-215.1(b)] The Permittee shall develop and implement a Mercury Minimization Plan (MMP) during this permit term. The MMP shall be developed within 180 days from the Permit Effective Date and shall be available for inspection on-site. A sample MMP was developed through a stakeholder review process and has been placed on the Division website for guidance (http://deq.nc.gov/about/divisions/water- resources/water-resources-permits/wastewater-branch/npdes-wastewater-permits, under Model Mercury Minimization Plan). The MMP should place emphasis on identification of mercury contributors and goals for reduction. Results shall be summarized and submitted with the next permit renewal. Performance of the Mercury Minimization Plan will meet the requirements of the TMDL (Total Maximum Daily Load) for mercury approved by USEPA on October 12, 2012, unless and until a Waste Load Allocation specific to this facility is developed and this NPDES permit is amended to require further actions to address the Waste Load Allocation. A. (11.)REOPENER FOR 1,4-DIOXANE [NCGS 143-215.1 (b)] Pursuant to N.C. General Statutes Section 143-215.1 and the implementing rules found in the North Carolina Administrative Code at 15A NCAC 2H.0112 (b) (1) and 2H.0114(a)and Part II, Sections B-12 and B-13 of this permit, the Director of DWR may reopen this permit to modify permit requirements to address 1,4-Dioxane monitoring, treatment and/or compliance. A. (12.) PFAS MONITORING REQUIREMENT [NCGS 143-215.1(b)] This reporting requirement for the per- and polyfluoroalkyl substances (PFAS) parameters listed under Table 1 of the Final Method 1633 takes effect the first full calendar quarter following six (6) months after EPA publishes a 40 CFR part 136 Final PFAS Method for wastewater in the Federal Register. Monitoringwill be at a quarterlyfrequency. The final NPDES Electronic Reporting Rule was adopted and became effective on December 21, 2015. Monitoring results obtained during the previous month(s) shall be summarized for each month and submitted monthly electronically using eDMR. The eDMR system allows permitted facilities to enter monitoring data and submit monthly DMRs electronically using the internet. The eDMR system may be accessed at: https://deq.nc.gov/about/divisions/water-resources/edmr. If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being physically located in an area where less than 10 percent of the households have broadband access, then a temporary waiver from the NPDES electronic reporting requirements may be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1.1, 2, 3) or alternative forms approved by the Director. Electronic Submissions In accordance with 40 CFR 122.41(1)(9), the permittee must identify the initial recipient at the time of each electronic submission. The permittee should use the EPA's website resources to identify the initial recipient for the electronic submission. Initial recipient of electronic NPDES information from NPDES-regulated facilities means the entity (EPA or the state authorized by EPA to implement the NPDES program)that is the designated entity for receiving electronic NPDES data [see 40 CFR 127.2(b)]. EPA plans to establish a website that will also link to the appropriate electronic reporting tool for each type of electronic submission and for each state. Instructions on how to access and use the appropriate electronic reporting tool will be available as well. How to Request a Waiver from Electronic Reporting The Permittee may seek a temporary electronic reporting waiver from the Division. To obtain an electronic reporting waiver, a permittee must first submit an electronic reporting waiver request to the Division. Requests for temporary electronic reporting waivers must be submitted in writing to the Division for written approval at least sixty (60) days prior to the date the facility would be required under this permit to begin submitting monitoring data and reports. The duration of a temporary waiver shall not exceed five (5) years and shall thereupon expire. At such time, monitoring data and reports shall be submitted electronically to the Division unless the Permittee re- applies for and is granted a new temporary electronic reporting waiver by the Division. Approved electronic reporting waivers are not transferrable. Only permittees with an approved reporting waiver request may submit monitoring data and reports on paper to the Division for the period that the approved reporting waiver request is effective. I am aware that there are significant penalties for submitting false information, including the possibility of fines and imprisonment for knowing violations." 5. Records Retention [Supplements Section D. (6.)1 The Permittee shall retain records of all Discharge Monitoring Reports, including eDMR submissions. These records or copies shall be maintained for a period of at least three (3) years from the date of the report. This period may be extended by request of the Director at any time [40 CFR 122.41].
