Per our conversation today, the above-referenced bond monitoring bond was reduced from $100,00.00 to $80,000.00 as
a result of the approval of the Year I Monitoring Report for the Hatley site, submitted by EBX and approved by DWR in
October 2013.
We have not gotten any updates on the status of the site, but have no reason to believe at this time that the site is not
progressing satisfactorily, based onEBX's performance history inNC. VVe anticipate receiving the year 2 Monitoring
Report in October of 2014, at which point we can attest to the progress of the site and the satisfaction of the Year 2
monitoring requirements.
As we discussed, please enter into your file that the bond will generally be updated in November of each year until the
anticipated completion of the project (2017).
