There is one wetland, a stream, and one RPW ditch on site. The general land use in the vicinity of the site is commercial and industrial. Some residential land use is located to the east. 4b. Explain the purpose of the proposed project: * The proposed project consists of the construction of a 200,000 sf transload facility and associated infrastructure (roads, parking, utilities, stormwater management, etc.). 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: * The purpose of the proposed project is to construct the Wilmington Transload Facility. The location of the proposed transload site is within one mile of the Port of Wilmington. The purpose of the proposed facility is to increase efficiency in moving Twenty Foot Equivalent Containers (TEU) into and out of the port. The project consists of the construction of the following: • A 200,000 square foot transload facility • Access roads from existing River Road and Raleigh Road to provide a circular travel pattern for deliveries and shipments. An additional access to Raleigh Road is dedicated for the employee parking area so as not to comingle large trucks and employee passenger vehicles. • Truck and employee parking areas • Construction of infrastructure (utilities, stormwater management, etc.) The proposed entrances on either side of the proposed facility are designed to facilitate intemal circulation of large trucks for shipments/deliveries and other vehicle traffic throughout the site. The design of the internal roads allows for circular traffic patterns which are more efficient and safer for large truck traffic. The western access road to River Road will require one RPW ditch crossing which will be constructed with a 48" RCP culvert. One permanent wetland (Wetland A) and one permanent stream impact (Stream 1) is proposed for site grading and transload building construction. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. Proposed permanent wetland and stream impacts for the Wilmington Transload facility and infrastructure have been minimized to only those necessary for construction of one driveway crossing to access developable uplands within the site and those required for grading to accommodate a proposed transload facility. The proposed driveway crossing has been designed to cross a RPW Ditch perpendicularly to minimize impacts. The crossing must be wide enough to support heavy truck traffic necessitating its length. Due to the location of onsite wetlands and Stream 1, large footprint of the transload building, and necessary truck parking areas, wetland impacts are unavoidable. Wetland A extends over halfway across the site. Wetland impacts were minimized to the greatest extent possible by locating the proposed building and parking in such a way to avoid the larger wetland area. Stream 1 originates offsite and is currently piped to a location within the center of the site where it daylights. There are no impacts proposed for stormwater SCMs or utilities. Additionally, there are no impacts to wetlands adjacent to tidal waters. The culvert proposed for the RPW ditch crossing will be buried one foot below grade allowing for the passage of aquatic life. lb. Comments WithersRavenel contacted mitigation banks that service the Cape Fear 03030005 basin to determine availability of stream mitigation credits. The only stream credits available are in the Northeast Cape Fear bank. Technically the project is in the Lower Cape Fear basin; however, the project site is just downstream of the confluence of the Northeast and Lower Cape Fear rivers and the Northeast Cape Fear bank site is just upstream in Pender County. As a result, it is our opinion that the stream mitigation from the Northeast Cape Fear bank would be suitable for the project. Brad Shaver, USAGE, concurred on July 20, 2022, that this mitigation proposal is appropriate for the project and the USACE is willing to accept it. The letter of acceptance from the Northeast Cape Fear Umbrella Mitigation Banks for the 610 If of stream mitigation has been provided as an attachment. The applicant proposes to mitigate for the 0.22 acres of proposed permanent wetland impacts through the purchase of offsite mitigation credits at a 2:1 ratio, resulting in the provision of 0.44 acres of wetland mitigation credits. WithersRavenel contacted mitigation banks that service the Cape Fear 03030005 basin to determine availability of wetland mitigation credits. A letter of acceptance from the Lower Cape Fear Umbrella Mitigation Bank for the 0.44 ac of wetland mitigation has been provided as an attachment. 6. WR reviewed the NC Natural Heritage Program (NCNHP) database, located at https://ncnhde.natureserve.org/, as well as NCNHP GIS data to identify if there were any known occurrences of endangered species on or near the proposed project. The review of the NCNHP data identified recent occurrences of federally listed threatened or endangered species within 1.0 miles of the project, see attached NCNHP project review letter. There are known occurrences of two federally endangered species (Shortnose Sturgeon and Atlantic Sturgeon), one federally listed proposed endangered species (Northern Long -Eared Bat), and one threatened species (West Indian Manatee) within 1.0 mile of the review area, as documented in the attached letter from NCNHP dated 7/14/2022. Site reviews did not identify any potential habitat for any federally protected species known to occur in New Hanover County except for the Northem Long -Eared Bat. Potential habitat for the northem Long-eared bat (NLEB) is listed as mature forest with trees over 3" dbh, which is used for roosting during the day. The proposed project area contains forested areas with trees over 3" DBH, and therefore is considered potential northern long eared bat habitat. The proposed project is located outside of a red HUC and there is no pile driving, blasting or percussive activities proposed. Additionally, the site of the proposed facility was largely cleared at some point in the past. Therefore, WR concludes that the project "may affect, but is not likely to adversely affect" the northern long-eared bat and the SLOPES ALP Situation 1 is applicable to this project. WR reviewed the USFWS IPAC data, located at: https://ecos.fws.gov/ipac/, to identify the federally listed species and critical habitat known to occur within the vicinity of the project. The IPaC identified that RCW, Northem Long -Eared Bat, West Indian Manatee, Eastern Black Rail, Piping Plover, Red Knot, Green Sea Turtle, Kemp's Ridley Sea Turtle, Leatherback Sea Turtle, Loggerhead Sea Turtle, Magnificent Ramshorn, Cooley's Meadowrue, Rough -Leaved Loosestrife, and Seabeach Amaranth have ranges that extend into the project area. The IPaC specified that there are no critical habitats within the project area. The IPaC species list has been provided as an attachment to this application. Site reviews did not identify any potential habitat within or immediately adjacent to the review area for RCW, West Indian manatee, Atlantic sturgeon, Shortnose Sturgeon, Eastern Black Rail, Green Sea Turtle, Kemp's Ridley Sea Turtle, Leatherback Sea Turtle, Loggerhead Sea Turtle, Magnificent Ramshorn, Cooley's Meadowrue, Rough -Leaved Loosetrife, Seabeach Amaranth, Piping Plover, or Red Knot. Therefore, WR concludes that the proposed project will not adversely affect federally listed species or their designated critical habitat. 6. Essential Fish Habitat (Corps Requirement) 6a. Project History WithersRavenel delineated the site on 7/11/2017 and reestablished delineation flagging for the northern portion of the wetlands on 4/1/2022. On 9/28/2017 the USACE sent a concurrence email regarding the delineation exhibit. Proposed Impacts The proposed impacts consist of: Impacts from Construction: • 0.22 acres of permanent wetland impacts • 0.04 ac (305 If) of permanent stream impacts • 0.02 ac (107 If) of permanent RPW ditch impacts The permanent wetland impacts are necessary for construction of the proposed transload facility building and some portion of large truck parking areas. The large footprint of the building is necessary for the efficient function of a transload facility which requires some storage facility. The transload facility building must provide large interior travel lanes for safe transportation of ingoing and outgoing products using forklifts. The proposed facility operational focus is on moving TEU containers in and out of the port efficiently. The transload facility site adjacent to the port is designed as a high velocity facility. Containers from the port will be unpacked, sorted, and loaded into road trucks. The conceptual layout includes up to a 200,000 sq. ft. transload facility with dock doors on each side with sufficient parking to support the operations of the facility. The facility will also be the site of some staging, stacking, and organizing of products. The proposed permanent ditch impacts are necessary for construction of the western access road across the ditch. The northern access road from Raleigh Road in conjunction with the western access road across the ditch is designed to work in conjunction to facilitate internal circulation of large trucks. No impacts to aquatic resources are proposed for the northern connection to Raleigh Road or from the employee parking lot connection to Raleigh Road. Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. Proposed permanent wetland and stream impacts for the Wilmington Transload facility and infrastructure have been minimized to only those necessary for construction of one driveway crossing to access developable uplands within the site and those required for grading to accommodate a proposed transload facility. The proposed driveway crossing has been designed to cross a RPW Ditch perpendicularly to minimize impacts. The crossing must be wide enough to support heavy truck traffic necessitating its length. Due to the location of onsite wetlands and Stream 1, large footprint of the transload building, and necessary truck parking areas, wetland impacts are unavoidable. Wetland A extends over halfway across the site. Wetland impacts were minimized to the greatest extent possible by locating the proposed building and parking in such a way to avoid the larger wetland area. Stream 1 originates offsite and is currently piped to a location within the center of the site where it daylights. There are no impacts proposed for stormwater SCMs or utilities. Additionally, there are no impacts to wetlands adjacent to tidal waters. The culvert proposed for the RPW ditch crossing will be buried one foot below grade allowing for the passage of aquatic life. Access during construction will occur within uplands. Additionally, sediment and erosion control measures will be installed prior to construction. M itigation Stream Mitigation The proposed project will result in 305 If of permanent stream impacts and 107 If of permanent RPW ditch impacts. The proposed 0.04 ac (305 If) of permanent stream impacts is above the mitigation threshold and therefore mitigation is required. The applicant proposes to mitigate for the 305 If of permanent stream impact at a 2:1 mitigation ratio, resulting in the provision of 610 If of stream mitigation. WithersRavenel contacted mitigation banks that service the Cape Fear 03030005 basin to determine availability of stream mitigation credits. The only stream credits available are in the Northeast Cape Fear bank. Brad Shaver, USACE, concurred on July 20, 2022, that this mitigation proposal is appropriate for the project and the USACE is willing to accept it. The RPW Ditch is fed by an offsite pond, as depicted in the attached exhibit. Additionally, Stream 1 begins at the outlet of a subsurface drainage pipe. The drainage pipe appears to run southeast from the stream towards the Vertex facility. We were unable to find the upstream end of the drainage pipe in the field. Reviews of available historic aerials also does not identify the location of the end of the drainage pipe. I contacted Todd Walton with NC Ports (owner) and they do not know where the drainage pipe originates either. So at this point, we cannot determine the origin of the drainage pipe. Regardless, Stream 1 is a jurisdictional intermittent stream. 1 The attached exhibit depicts the jurisdictional wetland, stream and RPW ditch, as verified at our site visit on 9/20/17. We understand that due to current workloads, it may be several months before the Approved JD will be issued.
