E. Smith <DSMITH@brookspierce.com> Hi Greg, After doing a little research here is what I have found: 1. The facility has been in litigation for some time. 2. There are many unresolved issues related to the litigation. 3. Because of the litigation NCDEQ cannot process the permit request. 4. One available option: If the decision is to rescind the permit, (1) then the facility must be completely shutdown, (2) All lagoons and other treatment units must be cleaned out, and (3) the outfall(s) must be permanently plugged. However, because of the inflow to the system resulting in periodic discharge this cannot happen. Therefore, all permit conditions must be met before NCDEQ requirements are met for the NCDEQ to assess the viability of permit rescission.
