Dear Mr. Williams:
Mr. Alan Johnson of this Office conducted a site inspection of your facility on March 29, 2001.
Based on the review of your records, this letter is being issued as a Notice of Violation (NOV) for applying
waste to fields not included in your waste utilization plan. Failure to comply with the certified farm plan is a
violation of North Carolina General Statute 143-215.10 (c) and North Carolina Administrative Code 15A
2H. 0217 (d).
It addition to the above violation, the IRR-2 forms need to be clearer regarding the acreage receiving
waste. It was not clear whether the total acres, wetted acres, or the acreage covered for each pull (by the
traveling gun) was used without recalculating the information on the form (see the inspection report). A
general drawing and/or diagram of the irrigation system might have been useful in the review of the records.
A drawing/diagram should be available during inspections.
It is requested that a written response be submitted to this Office by April 15, 2001 indicating the
actions taken to correct the noted violation. Please address your response to the attention of Mr. Johnson. It
is also requested that your response reference the date and subject of this NOV, as well as the facility
number.
By copy of this letter to the Division of Soil and Water Conservation and your local District Soil and
Water Conservation, DWQ is referring this facility for technical assistance, if appropriate. If you have any
questions concerning this matter, please do not hesitate to contact Mr. Johnson or me at (704) 663-1699.

Thank -you for your response to the inspection report for the inspection conducted by Mr.

utilization plan regarding tract 54434. We apologize for the oversight. The Notice of Violation
(NOV) issued on April 3, 2001 is hereby rescinded.
By copy of this letter to the Non -discharge Compliance/Enforcement Unit, we request that

Dear Mr. Williams:
The year 2002 is the beginning of the fifth year of the animal operation inspection program. Given this,
there should be no misunderstanding as to what is required. However, as a reminder, the following information is a
partial list of what is required:
• A copy of the Permit, Certified Farm Plan, and Certification form(s) must be available for review.
The certified farm plan must be followed (application rates, fields used for waste
application, and crops grown to receive waste must be adhered to). You are in violation if you do
not comply with any aspect of your farm plan or permit.
• Annual soil analysis (properly documented) is required. The soils lab states that the preferred time (for
efficiency) to process samples for analysis is between May and September.
• Waste analyses must be conducted within 60 days of the waste application date. If the results are
irregular, this should give adequate time to collect/analyze a new sample.
• Waste application records. The records should be complete and legible. Errors should not be erased, but
marked through and the correct information written on the following line. Remember, although the
information may be clear to you or the operator, the information must be understandable to the person(s)
performing the review.
Weekly freeboard records must be maintained. The "pump marker" must be clearly marked and visible at
all times. There should be no question as to what is the pump marker during an inspcetion.
A certified operator must be designated. By completing a form and mailing to DWQ.
The facility must be maintained and operated according to the operation and maintenance information
enclosed in the farm plan. This includes maintaining the area (mowing) around buildings and the
lagoon/storage pond embankments.
The list above comprises the majority, but certainly not all, of the requirements that must be followed. If
permitted, the conditions of your permit should be review by you and your operator. Failure to have the necessary
information available for inspection or to comply with the conditions of your permit could result in a Notice of
Violation or further enforcement actions. If there is any uncertainty on your part regarding compliance with the
permit, please feel free to contact Rocky Durham with the Division of Soil and Water or me at (704) 663-1699.

This is to acknowledge receipt of your request that your facility no longer be registered as an animal waste
management system per the terms of 15A NCAC 2H .0217. The information you provided us indicated that your
operation's animal population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not
require registration for a certified animal waste management plan.
Under 15A NCAC 2H .0217, your facility is deemed permitted if waste is properly managed and does not
reach the surface waters of the state. Any system determined to have an adverse impact on water quality may be
required to obtain a waste management plan or an individual permit. You are reminded that a discharge of wastes to
the surface waters of the state will subject you to a civil penalty up to $25,000 per day.
Should you decide to increase the number of animals housed at your facility beyond the threshold limits
listed below, you will be, required to receive approval from the Division of Water Quality prior to stocking animals
to that level. Threshold numbers of animals are as follows:
Swine 250

A letter dated January 15, 1999 was sent to advise you about concerns associated with Certified Animal
Waste Management Plans and the method by which the irrigated acres within the plans were calculated. Only
the acres that are wetted can be credited in the waste management plan as receiving waste application. Any
acreage within the plan that can not be reached by waste application equipment can not be used as part of your
plan.
An evaluation by Rocky Durham on 6/21/99 was made to review the actual number of acres at your
facilitythat receive animal waste during land application. The evaluation of your facility has yielded one of
the following two results as indicated by the box marked with an "X".
Category 1:
❑ The evaluation of your facility could not be completed due to a lack of information. Please
contact your Technical Specialist to assist in providing Rocky Durham the necessary
information to potentially exempt your facility from undergoing a complete wettable acre
determination. Please submit this information to Rocky Durham, at 919 North Main Street,
Mooresville, NC 28115, within in 90 days of the receipt of this letter. If you have any
questions please contact Rocky Durham at (704) 663-1699. If within 90 days you. are
unable to provide Rocky Durham with the information you are automatically required
to complete a Wettable Acre Determination as described by Category 2 below, within
180 days of receipt of this letter.

Category 2:
Your facility has been identified by the Department of Environment and Natural Resources
as a facility that may have overestimated the number of acres actually receiving animal
waste. Therefore, some or all of your fields may be exceeding the allowable loading rates
set in your Certified Animal Waste Management Plan.
In order to resolve this issue, please contact a designated Technical Specialist to have him
or her conduct a Wettable Acre Determination for your facility. The Technical Specialist must
be one that has been approved by the Soil and Water Conservation Commission to conduct
Wettable Acre Determinations. Many Technical Specialist with the N.C. Cooperative Extension
Service, the Soil and Water Conservation Districts, the Natural Resources Conservation
Service, and _the Division of Soil and Water Conservation have received this special
designation. You may also contact a private Technical Specialist who has received this
designation, or a Professional Engineer.
All needed modifications to your Animal Waste Management System must be made and
the Wettable Acres Determination Certification must be returned to DWQ within the next
180 days. If the needed modifications are not made and if the form is not returned within the
required time, DWQ will be forced to take appropriate enforcement actions to bring this facility
into compliance. These actions may include civil penalty assessments, permit revocation,
and/or injunctive relief.
Once a Wettable Acre Determination has been completed, a copy of the attached Wettable
Acre Determination Certification must be submitted to the address listed on the form. Please
note that both the owner and the Technical Specialist must sign the certification. A copy of all
the Wettable Acre Determination documentation that applies to your Waste Utilization Plan
must be kept at your facility. DWQ and the Division of Soil & Water Conservation Staff will
review all documentation during their annual visit of your facility. An additional copy must by
kept on file at the local Soil & Water Conservation District Office. Please note that if you install
or modify your irrigation system, a designated Irrigation Specialist or a Professional Engineer
must also sign the Wettable Acre Determination Certification.
Please be advised that nothing in this letter should be taken as removing from you the responsibility or
liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting
requirement.
