Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: * The -38 acre tract is located on Packing Plant Road west of Smithfield in Smithfield's ETJ, in a rural area. The existing conditions are row crop and pasture land. An intermittent stream runs from the northwest corner of the property to the south of the tract running through a small pond. Wetlands are located around the intermittent stream. A non jurisdictional farm ditch runs through the field from the northeast to the southwest draining to the intermittent stream.The general land use in the area is row crop farming and pasture for cattle. 4b. Explain the purpose of the proposed project:* The purpose of the project is to supply single family housing in a subdivision setting for the growing needs of Johnston County. 41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: * The subdivision will provide paved streets, water and electric hookups for each homesite. The septic will be onsite on each individual lot. The streets will be rough graded with bulldozers and fine graded with motor graders. The streets will be paved with asphalt. The utility lines will be buried in the streets right of way. The permitted impact will be a necessary stream crossing impacting stream, wetland and buffer. A trackhoe will be used to install the 48"culvert. A headwall and steeper side slopes will be used to minimize impacts. I don't know of any indirect impacts. 5. Jurisdictional Determinations 5a. The planned crossing could not be located in the gap between wetland A & B. Thye engineer states "The location of the crossing was chosen based knowing that we needed to meet NCDOT standards for roadway design as well as reduce the impacts to streams and wetlands as much as practical. There is only one location where there would be no stream or wetland impacts to access the western side of the property and this is just north of the pond. Although this location provides a no impact location it fails to meet NCDOT criteria for roadway design in that we immediately run into an adjacent property line on the western side of the stream. The centerline curve requirements for NCDOT can not be met in this location and stay within our property boundaries. The only other option to access the western property without impacts would be to access directly onto Packing Plant Road. However, NCDOT will only allow one access to the property in this short of a distance. Great concern for the reduction of impacts was taken into account with the location selected. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: To preserve lot count and make the S/D a viable project the stream had to be crossed to access property on the west side. The side slopes of the ditches were reduced to 2:1 and headwalls are used to minimize impact. The crossing could not be placed in the gap between wetland A and B because it would result in curves being to not the allowable radius for DOT acceptance. Also, Johnston County requires each lot to have a minimum of 30 sqft of a area. The location of quality septic soils also dictated the crossing ne located in this area to maximize the number of lots and help make this a viable project. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: An approved sediment and erosion control plan will be followed helping to minimize impacts by keeping sediment out of wetlands and stream. A pump around will be used when the culvert is installed if the intermittent stream has water. The crossing will not be installed in periods of higher than normal flow or when rainfall is forecasted. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. This stream is a first order intermittent stream at best, (see attached photos below), no habitat, no affect. 3) Carolina Madtom -"Prefer clean water with permanent flow and are not tolerant of siltation and turbidity." No habitat, no affect. 4) Atlantic Pigtoe - "Is dependent on clean, moderate -flowing water with high dissolved oxygen content in creek and riverine environments. " No habitat, No affect. 5) Monarch Butterfly - "Are found in meadows, roadsides, and sandy areas where milkweed plants grow." The crossing area is in the shade in a cow pasture, I did not see any milkweed on the project, no habitat, no affect. 6. Essential Fish Habitat (Corps Requirement) 6a. Occurrences that Must be Reported Permittees shall report the following occurrences: (a) Visible sediment deposition in a stream or wetland. (b) Oil spills if: • They are 25 gallons or more, • They are less than 25 gallons but cannot be cleaned up within 24 hours, • They cause sheen on surface waters (regardless of volume), or • They are within 100 feet of surface waters (regardless of volume). (c) Releases of hazardous substances in excess of reportable quantities under Section 311 of the Clean Water Act (Ref: 40 CFR 110.3 and 40 CFR 117.3) or Section 102 of CERCLA (Ref: 40 CFR 302.4) or G.S. 143-215.85. (d) Anticipated bypasses and unanticipated bypasses. (e) Noncompliance with the conditions of this permit that may endanger health or the environment. 2. Reporting Timeframes and Other Requirements After a permittee becomes aware of an occurrence that must be reported, he shall contact the appropriate Division regional office within the timeframes and in accordance with the other requirements listed below.
