Dear Ms. Karoly and Mr. McMillan:
This letter is in response to your letter dated August 31, 2007, which requested additional
information for the proposed Panther Rock Subdivision development. The following
restates your questions/comments and is then followed by our response.
Additional Information Requested
Please provide the letter from the Town of Knightdale stating they are
reviewing stormwater for all phases of this subdivision. Additionally,
please be aware the proposed impacts may not occur until a copy of
the stormwater approval letter on official letterhead from the Town of
Knightdale for all phases of the project is received in the DWQ
Central Office.
The supplemental information supplied to DWQ on August 23, 2007 stated that the Town
of Knightdale was in the process of supplying the Stormwater Management Plan
Approval letter for the Pather Rock Subdivision project. Additionally, the supplemental
information also provided the plans and calculations that were supplied to the Town of
Knightdale for review under the Phase II stormwater requirements. Per the August 20,
2007 memorandum from Coleen Sullins, Director of the NC Division of Water Quality,
"If the necessary local approval of the SMP has not yet been obtained a the time of
application, the application should indicate that a SMP has been, or will be, submitted

for local government approval, indicate the local government that approval is being
requested from, and indicate under what State stormwater program the activity will be
covered by. Any 401 Certification approved under this scenario shall be conditioned so
that the proposed activity shall not commence until such time that the appropriate local
approval has been granted." All of the above requirements were satisfied with the
additional information provided to DWQ on August 23, 2007. The Town of Knightdale
stormwater Management Plan Approval letter was forwarded to DWQ on September 10,
2007.
2. The level spreader should be shown on the large plan sheet that will
be used by the construction crew onsite and not just on the small
attachment included with your additional information. Please revise
your C-4 plan sheet dated August 21, 2007, to reflect this information.
Please find the attached full sized plan sheet with associated level spreader details.
We assume that there are no other outstanding questions with regards to the issuance of
the requested 401. We are therefore respectfully requesting that DWQ issue a 401
Approval for the Panther Rock Subdivision development.
