Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: S&EC completed a wetland delineation and Neuse River Buffer evaluation for the entire property so that natural resources could be identified and impacts minimized to the maximum extent practicable. Impact 1 is proposed permanent wetland, stream, and buffer impacts for road crossing/lot fill. Per the project engineer, "Note the lack of elevation change from one end of the wetland to the other compared with the storm drain system that is proposed at minimum slope. There is no way to achieve proper drainage without affecting the wetland. In addition, the outlets for the bioretention areas (set based on the seasonal high water table elevations and site grades - which are raised to get drainage to the bioretention areas) are below the elevation of the wetland and east -west stream. With regards to the rip rap to stabilize the channel, in the upper portion of the stream, due to the elevation constraints, the stream bed will be lowered prior to adding riprap. The portion of the stream inside of the perennial stream buffer would be left at its current elevation (with the exception of the excavation for the rip rap installation with the top at the current stream bed elevation to stabilize the channel) but the slopes will be laid back". "By piping the upper portion of the wetland ditch we are able to design sanitary sewer so as to minimize affects/encroachments into the north -south stream buffer. Piping the wetland allows the units from the south end of the site to drain by gravity to tie to an existing manhole on the north end of the site. This may not be possible if the wetland isn't piped as the grading may not allow this to be done. This would require the sewer to tie an existing manhole on the south side of the site that is on the east side of the stream. This would require a stream crossing of the perennial stream and clearing of the buffer for the required sewer easement". "An alternative plan was developed showing what would have been possible if the right of ways for Drake Ave and Sovereign St. had not been abandoned. The client and the engineer believed that avoiding the impact to the perennial stream for Sovereign St. would be preferable to the Corps as well as making certain that Drake Ave would never have to be built so they pursued and were granted approval to abandon these right of ways if they agreed to reduce their unit counts for the project. This plan would have required a road crossing of the perennial stream, two wetland crossings, and additional buffer impacts for the stormwater BMP outlets. The impacts would be more than the proposed plan. With regards to the unit count, the city requires two points of access for more than 90 units. The alternative layout had 92 units. The proposed plan only has 81 units. So, it would have been a benefit to the developer to cross the perennial stream rather than to avoid impacting it". lb. The draft states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural and silvicultural operations. The 1700 Hillandale Road project is a residential development. Additionally, the project is located within the City of Durham ETJ, therefore the adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Neuse River Basin Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area, in addition Best Management Practices may be required that control nitrogen if diffuse flow cannot be achieved; 2) the Phase II NPDES Stormwater Permit Program, this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction stormwater management requirements. (Axiom) is pleased to provide you with this summary letter of the results of a federally protected species survey at the Hillandale Road Multi-Family Development Site (hereafter referred to as the Site, see attached figure). The survey was conducted by Axiom biologists Allison Keith and Jack Lawson on June 25, 2021. Site Description The Site is in the Piedmont physiographic region of the state and is within the Neuse River basin. The Site is an approximately 11.5-acre property in the City of Durham and is located in the southeast quadrant of I-85/US 70 and Hillandale Road. The Site is primarily forested, with residential development along the fringes and mature forest within the interior (see attached figure). The Site contains two unnamed tributaries to Ellerbe Creek: an ephemeral ditch flows from west to east across the middle of the Site, and a perennial stream flows from north to south along the eastern side of the Site. The ephemeral feature carries water only immediately following precipitation events. The perennial feature receives runoff from residential/commercial development and an interstate highway. This feature is characterized by signs of scouring following rainfall events (incision below the root layer into relatively impenetrable saprolite), much trash, and no aquatic life. The residential yards are dominated by mature hardwood trees such as willow oak (Quercus phellos), white oak(Q. alba), tulip tree(Liriodendron tulipifera), red maple(Acer rubrum),pignut hickory (Carya glabra), scarlet oak (Q. coccinea), eastern red cedar (Juniperus virginiana), and sourwood (Oxydendrum arboreum). Under the tree canopy, yards are primarily maintained grass (Festuca sp.) with ornamental shrubs and saplings such as Japanese holly (Ilex japonica), hydrangeas (Hydrangea macrophylla), boxwoods (Buxus sempervirens), Chinese privet (Ligustrum sinense), and flowering dogwood (Corpus florida). Trees in the central forest include loblolly pine (Pinus taeda), red mulberry (Mores rubra), tulip tree, red maple, and sweetgum Axiom Environmental, Inc. Shrubs in the central forest include American holly (Ilex opaca), southern magnolia (Magnolia grandifolia), Chinese privet (Ligustrum sinense), and devil's walking stick (Aralia spinosa). A dense layer of vines blankets the shrub and herb layer in the central forest and includes English ivy (Hedera helix), wisteria (Wisteria spp.), muscadine grape (Muscadinia rotundifolia), poison ivy (Toxicodendron radicans), Virginia creeper (Parthenocissus quinquefolia), and common greenbrier(Smilax rotundifolia). Protected Species The U.S. Fish and Wildlife Service(USFWS)has identified the following species with ranges that extend into Durham County: • Bald eagle (Haliaeetus leucocephalus) • Rusty-patched bumble bee (Bombus affinis) • Neuse River waterdog (Necturus lewisi) • Carolina madtom (Noturus furiosus) • Dwarf wedgemussel (Alasmidonta heterodon) • Smooth coneflower(Echinacea laevigata) • Michaux's sumac (Rhus michauxii) Bald Eagle • Habitat Description: Habitat for bald eagle primarily consists of mature forest in proximity to large bodies of open water for foraging. Large, dominant trees are utilized for nesting sites, typically within 1.0 mile of open water. • Biological Conclusion: Suitable habitat for bald eagle does not occur within the Site. Three open-water areas occur within 1.0 mile of the Site: two ponds within Croasdaile Country Club northwest of the Site and the Williams Water Treatment Plant southwest of the Site. An investigation of these open waters on June 25 found no evidence of bald eagles. A June 21, 2021 review of the N.C. Natural Heritage Program (NCNHP) records indicates no occurrence of this species within 1.0 mile of the Site. This project is therefore anticipated to have No Effect on bald eagle. Rusty-patched bumble bee • Habitat Description: The rusty patched bumble bee (RPBB) has been observed and collected in a variety of habitats, including prairies, woodlands, marshes, agricultural landscapes, and residential parks and gardens. This species requires areas that support sufficient food(nectar and pollen from diverse and abundant flowers), undisturbed nesting sites in proximity to floral resources, and overwintering sites for hibernating queens. RPBBs live in temperate climates and are not likely to survive prolonged periods of high temperatures (over 95 degrees Fahrenheit). Axiom Environmental, Inc. Mr. Jared Rice June 30, 2021 Page 3 • Biological Conclusion: The USFWS does not and will not require surveys for RPBB in North Carolina because the USFWS assumes the state is unoccupied by RPBB. Neuse River waterdog • Habitat Description: Found in rivers and large streams of the Neuse and Tar River basins where they inhabit leaf beds in quiet waters of streams and swampy floodplains. They are also found in reaches with hard clay or soil beds and in areas characterized by logjams. • Biological Conclusion: Suitable habitat for the Neuse River waterdog does not occur within the Site. A June 21, 2021 review of NCNHP records indicates no occurrence of this species within 1.0 mile of the Site. This project is therefore anticipated to have No Effect on Neuse River waterdog. Carolina madtom • Habitat Description: Found in riffles, runs, and pools in moderate-gradient, medium to large streams and rivers of the Neuse and Tar River basins. They inhabit predominantly silt-free, stable, gravel and cobble bottoms. • Biological Conclusion: Suitable habitat for the Carolina madtom does not occur within the Site. A June 21, 2021 review of NCNHP records indicates no occurrence of this species within 1.0 mile of the Site. This project is therefore anticipated to have No Effect on Carolina madtom. Dwarf Wedgemussel • Habitat Description: Found in hydrologically stable areas of streams less than 15 feet wide to large rivers more than 300 feet wide; it is found in a variety of substrate types including clay, sand, gravel, and pebble, and sometimes in silt depositional areas near banks. • Biological Conclusion: Suitable habitat for dwarf wedgemussel does not occur within the Site. A June 21, 2021 review of NCNHP records indicates no occurrence of this species within 1.0 mile of the Site. This project is therefore anticipated to have No Effect on dwarf wedgemussel. Smooth coneflower • Habitat Description: This species grows in calcareous, basic, or circumneutral soils on forest edges, roadsides, clear cuts, and power line rights-of-way where there is abundant light and little herbaceous competition. Fire-maintained woodlands also appear to provide potential habitat for the coneflower. Shading of roadsides by adjacent forest trees and routine mowing reduce the suitability of these habitats. A June 21, 2021 review of the NCNHP records indicates no occurrence of this species within 1.0 mile of the Site. Therefore, the proposed project will have No Effect on smooth coneflower. Michaux's sumac • Habitat Description: Habitat for Michaux's sumac consists of rocky, open, upland woods on basic, well -drained sands or sandy loam soils, particularly where disturbance (such as mowing, grazing, clearing, or periodic fire) maintains an open habitat. • Biological Conclusion: Systematic surveys performed within areas of suitable habitat (forest edges, open shrubland, and areas of the forest with relatively open understory) identified no individuals of this species. A June 21, 2021 review of the NCNHP records indicates no occurrence of this species within 1.0 mile of the Site. Therefore, the proposed project will have No Effect on Michaux's sumac.
