THIS DEED, made and entered into this day of April, 2021, by and between JOEL
LAYTON WINSTON and wife, NANCY L ROBBINS, 10723 Candlewood hive, Houston,
TX 77042; JOEL LAYTON WINSTON, Executor of the ESTATE OF ROBERT WARD
WINSTON, JR., deceased and JOEL LAYTON WINSTON, Trustee under the Last Will
and Testament of Robert Ward Winston, Jr., dated November 5, 2015 and Sled in the
Harnett County Clerk Owe in file number 19 E 441, (Grantors, sometimes re*n-e i to as
parties of the first part); and McDOUGALD ROAD DEVELOPERS, LLC, a North Carolina
Limited Liability Company, 341 Kilmayne Dr, Suite 201, Cary, NC 27511, (Grantee,
sometimes referred to as patty of the second part);
WITNE_SSETH:
THAT WHEREAS, Robert Ward Winston, Jr., deceased, and Joel Layton Winston
acquired the hereinafter described real estate located on McDougald Road as tenants in common
by deed recorded on September 17, 2010 in Book 2785, Page. 727 and Book 1451, Page 626,
Harnett County Registry, each owning a one-half (1i2) undivided interest therein; and
submitted electronically by "Gwynn & Edwards, PA"
in compliance with North Carolina statutes governing recordable documents
and the terms of the submitter agreement with the Harnett county Register of Deeds.
WHEREAS, Robert Ward Winston, Jr., died testate on May 25, 2019, leaving a will and
codicil thereto which was duly probated in the Superior Court of Harnett County, and which
appears in estate file number 19 E 441 in the Office of the Clerk of Superior Court of Harnett
County; and
WHEREAS, Joel Layton Winston is the duly appointed and acting Executor of said
Estate; and
WHEREAS, pursuant to ITEM VII, of the Last Will and Testament of Robert Ward
Winston, Jr. the hereinafter described real estate was devised to Joel Layton Winston as Trustee
with the authority to determine the appropriate sale and the appropriate time of such sale of the
hereinafter described tract of real estate.
THEREFORE, in consideration of the premises and the sum of SEVEN HUNDRED
SIXTY-FIVE THOUSAND AND NO/100 DOLLARS ($765,000.00), the receipt of which is
hereby irrevocably acknowledged, the said grantors have individually and under the authority
granted in the Wi11 of Robert Ward Winston, Jr., bargained and sold and by these presents do
grant, bargain, sell and convey unto the said Grantee, its successors and assigns, that certain tract
or parcel of land lying and being in Lillington Township, Harnett County, North Carolina and
more particularly described as follows:

BEGINNING at an iron stake in the north margin of the McDougald Road, a
corner with Hester, and runs theme North 34 degrees 30 minutes West 1493 feet
to an iron stake with pointers an a hill; thence North 31 degrees mat 2229.1 feet
to an iron stake with pointers near a branch, a corner with Moss; thence South 60
degrees 15 minutes East 1411 feet to an iron stake, another corner with Moss;
thence North 30 degrees 10 minutes East 305 feet to an iron stake with pointers, a
cornea with Hester in the Moss line; thence South 26 degrees 10 minutes East
1991 feet, corner with Bullock; thence South 45 degrees 10 minutes West 2124.2
feet to an iron stake a short distance North of the McDougald Road; thence North
62 West 78 feet to an iron stake in the north margin of the McDougald Road;
thence South 44 degrees 10 minutes West 831 feet to an iron stake corner in the
line of Bullock; them: South 54 degrees 40 minutes West 263 feet to an iron
stake in a path, corder with Smith; thence North 8 degrees 45 minutes West 1284
feet to the BEGINNING, and containing 185.84 acres, more or less, according to
a map by G. R. Johnson in November — December, 1961, entitled "J. G. Layton
Est. Gravel Pit Farm."
There is EXCEPTED from the above described tract of land a tract of land
containing 14.46 ages which was conveyed to EM Development, Inc., by deed
dated December 8, 2004 and which appears of record in Book 2026, Page 434-
437, Harnett County Registry.
For reference, see Book 2785, page 727 and Book 1451, Page 626, Harnett
County Registry.
TO HAVE AND TO HOLD the aforesaid tracts or parcels of land together with all
privileges and appurtenances thereunto belonging to the Grantee, the said Grantee, its successors
and assigns, in fee simple forever.
And the said Grantors do covenant that they are seized of said lands in fee and have the
right to convey the same in fee simple, that the same are free and clear of all encumbrances and
that they will warrant and defend the title herein conveyed against the lawful claims of all
persons whomsoever.
