Public Notice Number DHEC-08-C-001 (Revised) July 30, 2014
The South Carolina Department of Health and Environmental Control (SCDHEC) has received a
revised application for a Water Quality Certification (WQC) pursuant to Section 401 of the
Clean Water Act (33 U.S.C. 1341). Duke Energy Carolinas, LLC (Duke) operates the Catawba-
Wateree Hydroelectric Project (Project), which is licensed as Federal Energy Regulatory
Commission (FERC) Project No. 2232. Duke is required to obtain a new license from the FERC
in order to continue operating the Project, as the license expired in 2008. The Application for a
new license was submitted to the FERC in 2006, and Duke also applied for a WQC in 2008 as
required; however, SCDHEC denied certification for the application in 2009.
On July 11, 2014, a Settlement Agreement was reached between American Rivers, South
Carolina Coastal Conservation League, Duke and SCDHEC resolving the dispute concerning the
WQC. Subsequent to the Settlement Agreement, Duke has reapplied for a WQC with SCDHEC.
The subject of the revised WQC application remains the continued operation of the Project under
a new license consistent with the CRA.

through the FERC e-library web page.
This public notice is being distributed to interested persons and agencies to gain comments,
which will aid the SC DHEC in making a final decision regarding the project. All comments and
data in support or opposition to the project should be submitted in writing to:
