Dear Mr. Bsfnger,
This letter is in response to NOV-2022-LV-0447, the County has understood for approximately two years
that Grassy Branch has and would continue to struggle to meet its permit limitations. From the beginning,
the County has worked closely with the Division of Water Resources on the correct plan of action moving
forward. The County and the Division of Water Resources both agreed to enter into a Special Order by
Consent (SOC). The SOC was received by the County on June 21, 2022.
The weekly BOD5 exceedance that we experienced the week of May 10, 2022 is a result of two issues, a
mechanical issue that was realized after the recent replacement of the diffusers in aeration basin #2 and
higher loadings from the increased flows. The plant is currently back in compliance and we are confident
that now working under the SOC, the plant will remain in compliance.
