PROJECT SUMMARY: The applicant has an existing pier, platform, boathouse, and two slips. He is proposing new dredging of the two existing boat slips and new construction of a third slip with a finger pier and boat lift for private use. ti Field Investigation Report: Charles Willis page 02 ,; - ~. i°:arr~five ~e~~~Ei~~~~: The property is a 0.682-acre private residential property on the northwest end of Harkers Island. The owner, Charles Willis, wishes to dredge two existing slips and construct a third slip with a boat lift and finger pier, and is applying for a permit to do so. The parcel lies at 109 Maxwell Drive in the Harkers Point subdivision on Harkers Island in Carteret County. The property fronts the north side of Brooks Creek, a tributary of North River. Brooks Creek is approximately 259' wide at the project location. There is 86' of shoreline on this property. The current vegetation on the tract mainly consists of well-established lawn grasses and coastal wetlands (marsh). None of the project area has submerged aquatic vegetation or other wetlands present. The elevation of the tract is +4' msl. Man-made features on the parcel include a bulkhead and private residence. The Carteret County Land Use Plan classifies the project area as Conservation by virtue of its location within the AEC. The waters of Brooks Creek are not designated as Primary Nursery Area and are closed to shellfish harvesting. These waters carry a water quality classification of SA. The bottom substrate is fine sand. 10. Proposed Development: The request is for a third boat slip with a new finger pier, new boatlift, and new dredging of the two existing slips. The proposed excavation and construction activity is to take place waterward, to the south, of the existing bulkhead, and within the footprint of the existing docking facility on the property. The proposed dredging of the two existing slips by dragline or barge mounted excavator is of approximately 50 cubic yards of bottom substrate, with one section being 25' long by 10'wide and the other section being 25' long by 13' wide, to depths of -4.5' nlw to be disposed of at an upland location requiring the prior approval of the DCM. Current soundings in the slips range from -1.0' nlw on the landward edge, down to -4.5' nlw waterward. This development will take place approximately 8.5' from the coastal marsh. The existing decked area is approximately 225 sf. The proposed finger pier would be 23 feet long and 3 feet wide and would consist of a boat slip with a lift 20 feet long and 10 feet wide both of which would connect to the existing pier and platform. All of the proposed development would be within the footprint of the existing structure. The dock would then have three boat slips. The proposed development would remain outside of the 15' riparian corridor as it is drawn perpendicular to the existing channel. At the terminus of the structure, there is -4.5' of water at nlw. The proposed structure is to be used for private boat docking of a small skiff. No SAV were observed in the area and this waterbody is closed to shellfishing. Turbidity impacts should be short term relating to the dredging and removal of 50 cubic yards of fine sand and driving of the pilings. The intended uses include private dockage of marine vessels resulting in a third boat slip. The excavation of the area should prevent scarring. The proposed structure should not be a hazard to navigation by staying within the footprint of the existing structure, or exceed the established pier length within this creek. Small scale excavation of this type produce only minimal, short-term water quality impacts. Proper dredging of the two existing boat slips will have little impact due to the less productive biological strata, and the fine sand disturbance to water quality will be short-lived in nature. The proposed finger pier and boatlift are within the footprint of the existing structure and pose no threat to navigation. This proposal is not in conflict with the current usage of this tributary of North River, and this waterbody should not be deleteriously affected. There is no submerged aquatic vegetation, the waterbody is not a PNA and is closed to shell fishing. Assuming that state and federal agencies concur with the proposal, I recommend the project be authorized as proposed, contingent upon the following conditions: 1) That the disposal area of the excavated material be pre-approved by DCM before any dredging is to take place; 2) That the structure be strictly for private, non-commercial use; 3) No vegetated wetlands/marsh grass will be excavated or filled; 4) Excavation will not exceed 4.5 feet below the normal low water level. On behalf of Charles Willis, we are applying for a CAMA Major Permit for dredging of approximately 50 cubic yards of material and installation of a third boat slip, which will be consist of a finer pier and boat lift adjacent to the existing dock. The purpose of the proposed project is to attain pre-existing depths at the existing mooning site located and to provide (1) additional boatlift and finger pier to access the proposed boat lift. The use will remain to moor recreational boats, and provide access to these boats. Daily operations will include ingress and egress from mooring site. c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type of equipment and where it is to be stored. .1) The dredging is proposed to be conducted utilizing (1) bucket dredge on a floating barge, and spoil is to be contained on the barge and disposed of on approved upland (non-jurisdictional) location. 2) The boat lift and finger pier are to be installed usinig approved marine grade pillings and decking. The piles are to be driven into the silt from a floating barge. d. SITE DESCRIPTION: The project site is located at 109 Maxwell Drive, at the Harkers Point subdivision in Harkers Island, NC. The proposed project is located in the waters of Brooks Creek, which is under the Section 10 authority of the U.S. Army Corps of Engineers (Corps), section 401 authority of the NC Division of Water Quality (DWQ), and in an area of environmental concern (AEC) under the NC Division of Coastal Management (DCM). Brooks Creek has been given a stream index number of 21-35-1-13 and is classified as Shellfish Waters (SA) and High Quality Waters (HQW) by DWQ. Brooks Creek has been a harbor of refuge and used for mooring the commercial fishing fleet at Harkers Island of a number of years, prior to the development of Harkers Point (Aerial Photo - 1994). Only a few oyster shells have been observed within the benthic layers of the project area and there has been no evidence of sea-grasses at this location. * The project area is currently closed to shell-fishing, and is not located within a Primary Nursery Area (PNA), as confirmed by Mr. Connell in a phone conversation with the NC Division of Marine Fisheries, during the on- site visit on June 15, 2007. PROPOSED PROJECT: Dredging: The proposed project is located adjacent to the dock previously permitted and approximately 9 feet from the coastal marsh at 109 Maxwell Drive (Figure 1). The applicant proposes to dredge two mooring locations at the dock to the approximate existing depths when the dock was built. The mooring sites ("A" and "C") have accumulated silt that has left the dock sites navigable only at high tides, as shown in Figure 2 (Depths at MLW). The applicant wishes to dredge locations A and C to the 4.5 foot contour -Mean Low Water (MLW), adjacent to the dock in order to utilize the mooring sites during all tidal cycles. Proposed dredging of site "A" has been calculated to equal approximately 29 cubic yards and site "C" would equal approximately 21 cubic yards, totaling 50 cubic yards for the entire project. The spoil material will not be de-watered and placed back in to jurisdictional waters. Proper sedimentation and erosion control practices will be implemented during construction. Finger Pier/Boat Lift: A finger pier and boat lift are also proposed to accommodate a small skiff adjacent to the existing dock as depicted in Figure 1. The boat lift is to be 1 I' wide and 20' in length and will be located above mean high water. The finger pier is proposed to be 23' in length by 3' in width.
