A review of the new permit by personnel in the Asheville Regional Office noted a typographical error in the permit. This permit modification also corrects the error on the Effluent Limitations and Monitoring Requirements page (correctly identifying the frequency of toxicity testing as Quarterly, not twice per month). Please find enclosed the revised permit page. The revised page should be inserted into your permit. The old page may then be discarded. All other terms and conditions contained in the original permit remain unchanged and in full effect. This permit modification is issued under the requirements of North Carolina General Statutes 143- 215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental Protection Agency. If any parts, measurement frequencies or sampling requirements contained in this permit modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be a written petition conforming to Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. I can't remember if I asked you this before or not. If so, just disregard. This facility's permit is a little screwed up and they are testing according to what is on their limits page for tox. Which is doing tox tests twice a month as seen in the effluent characteristics. The condition page and footnotes on the limits page has quarterly but for some reason they are testing 2 times a month. Which is rather expensive, especially if they fail. ARO wanted me to write them a letter and tell them to test quarterly, but Matt said we cannot do that out here. He said that would have to come from you all's group. Talk to Dave and see what he thinks. The permit expires 2002. Steve Pellei was the writer and I guess he's not with you guys anymore.
