NOTIFICATION of Conditional Stormwater Management Plan (SMP) Approval —
Low Impact Development (LID), a.k.a. "Runoff Volume Match"
Dear Ms. Kiser and Mr. Garner:
On or about March 19, 2021, Orange County Erosion Control and Stormwater Management staff
received an initial application for a Stormwater Management Plan (SMP) for The Preserve at
Tallulah Springs, a proposed 7-lot residential development located within the Cedar Grove
Township of Orange County (hereafter, the `project'). The project proposes the utilization of Low
Impact Development (LID) stormwater criteria (a.k.a. "Runoff Volume Match") for meeting
applicable stormwater management requirements in conformance with Section 6.14.6(A)(5) of
the Orange County UDO.
The project involves the following:
Utilization of Low Impact Development (LID) stormwater criteria (a.k.a. "Runoff
Volume Match") for meeting applicable Stormwater Management Plan (SMP)
requirements for the project in conformance with Section 6.14.6(A)(5) of the Orange
County Unified Development Ordinance (UDO).
• Total project site area of 76.23 acres;
• Total impervious area of 198,340 square feet (5.97% of total project site);

• Total land disturbance of *4.90 acres of land area
*NOTE: Up to 4.90 acres of Land -Disturbing Activity is currently permitted as part of this SMP
(LID) approval. This approved disturbed area is specific to construction of the proposed private
entrance roads (i.e. Carpenter Lane and Minta Way) located west of Eno Cemetery Road. The
future owner(s) of any/all of the proposed seven (7) lots must assume Financial Responsibility
for the lot(s) owned and must obtain separate Land Disturbing Permits from Orange County, as
applicable, prior to commencement of land -disturbing activity for any/all of the proposed seven
(7) lots contained within the proposed subdivision. The potential maximum (future) land
disturbance within the entire 76.23-acre project site is 54.61 acres of land area — as defined by
the change of land covers and runoff fates included in the Post -Development Hydrologic Balance
Calculations as contained within the approved LID analysis. Separate LDPs will be required from
Orange County, as applicable, prior to commencement of any future land -disturbing activities in
excess of the approved 4.90 acres of total land disturbance (for construction of the proposed
private entrance roads) as defined and approved herein.
Should any of the seven (7) proposed residential lots exceed the lot -specific allocated
impervious surface areas as defined in the Summary of Impervious Surface Limits chart
shown below, a lot -specific Stormwater Management Plan (SMP) may be required at the lot
owner's expense. Lot -specific SMPs may result in the required construction and perpetual
private maintenance of appropriately designed, approved and constructed Stormwater Control
Measures (SCMs) at the lot owner's expense.

Per applicable Orange County regulation(s), development of the property requires:

of land area; and

• An SMP application/permit application when land disturbance exceeds 21,780 square
feet of land area.
On March 30, 2021, Orange County issued written comments on the SMP package originally
submitted for the project. Orange County received revised construction drawings and revised
stormwater calculations on March 18, 2022, and additional SNAP calculations were received on
April 4, 2022. Orange County subsequently received revised construction drawings on April 6,
2022. Based on our review of the revised SMP package, the LID submittal is in compliance with:
1. Orange County written comments issued on March 30, 2021;
2. Applicable stormwater management requirements as outlined in Section 6.14 of the
Orange County UDO; and
3. Chapter 2 of the most recent version of the North Carolina LID Guidebook.
The LID submittal (SMP) for the project is hereby approved. This SMP approval is only valid
for the purpose and design described in the approved construction drawings sealed by Phil Koch,
P.E. on April 6, 2022, the approved stormwater management calculations sealed by Phil Koch,
P.E. on March 17, 2022, and the approved SNAP calculations sealed by Phil Koch, P.E. on April
4, 2022. Any change to the project requires notification to our office and may require submittal
of a new application. If ownership of any of the proposed seven (7) lots is transferred to another
person or entity, the new lot owner(s) will be responsible for complying with the approved SMP.
This SMP approval also grants agents, officials, or other qualified persons authorized by Orange
County the right to inspect the project site to determine compliance with the approved SMP, the
Orange County UDO, and the State Stormwater Design Manual.
NOTE: For final acceptance of the approved SMP and subsequent issuance of a
Stormwater Compliance Certificate (specific to each lot) by Orange County, the following
steps must be completed by the lot owner(s):
• Submit to our office a PE sealed As -Built Drawing and/or A PE sealed Engineer's
Certification Letter specific to the owned lot(s), verifying that LID criteria have been met
for the respective owned lot(s) according to the approved SMP. The lot -specific LID
criteria are defined with the Proaosed Land Use Chart herein.
• Submit to our office a copy of the recorded Conservation Area(s) for the proposed 12.72
acres of "UNDISTURBED WOODS" that have been identified and designated within the
Post -Development conditions of the approved SMP.
