A review of the April 2022 Division of Water Resources (DWR) database, which tracks the
monthly submittal of Non -Discharge Monitoring Reports (NDMRs) revealed that the Non -
Discharge Monitoring Reports (NDMRs), NDMR and NDAR-1 was not filed with the Division for
April 2022. Submission of these monthly reports is required within the thirty (30) calendar days
after the end of the reporting period, for which the report is made [per 15A NCAC 026.0506].

A Notice of Violation/Intent to Issue Civil Penalty is being issued for the noted violation of
North Carolina GeneralStatute (G.S.) 143-215.1 and the facility's Non -discharge Permit.
Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars
($25,000.00) may be assessed against any person(s) who violates or fails to act in
accordance with the terms, conditions, or requirements of any permit issued pursuant to
G.S.143-215.1.
If you wish to provide additional information regarding the noted violations and prevent further

action, please respond in writing within ten (10) days of receipt of this notice.
Please ensure that the missing NDMRs are sent to the Division. A review of your response will
be considered, and you will be notified of any civil penalties that may be assessed regarding
these violations. If no response is received in this Office within the 10-day period, a civil
penalty may be assessed.
