On May 27, 2014, the Division of Water Resources (Division) received an application, dated May
23, 2014, requesting a 401 Water Quality Certification from the Division for the subject project.
On May 28, 2014, the Division sent a letter requesting additional information.
On June 16, 2014, the Division received a letter from you, however, all of the requested
information was not provided. On June 16, 2014, after receiving the letter, Shelton Sullivan with
the Division called you and left a message regarding the missing information. On June 19, 2014,
the Division sent you an email showing that Realty Investments, Inc. was not listed on the NC
Secretary of State's website as a current and active company.
On July 30, 2014, the Division searched the NC Secretary of State's website and found that Realty
Investments, Inc. was listed with the status of "Problem Report", and without any of the required
contact information for the company. See the enclosed print out from that search.
The Division has determined that the application is incomplete and cannot be processed at this
time. The application is on-hold until the following items are addressed:
1, The owner is listed as Realty Investments, Inc. According to NC General Statute 55-15-01
(a) A foreign corporation may not transact business in this State until it obtains a certificate
of authority from the Secretary of State. See this website for reference:
