David,
We are working with Water and Land Solutions to provide credits at a 2:1 ratio from their WLS Catawba 01 Umbrella
Mitigation Bank. The do not currently have the credits available, but they do expect them to be released before May 15,
2023. We would not begin work until the mitigation has been released, and the credits have been transferred. If the
credits are not released on time, our contract with them would become void and we would purchase the credits from
DMS or another bank if it is available at the time. Is there a way the permit could be issued with some flexibility in
mitigation, or do we need to state specifically that we will be purchasing from them?
Also, we plan to get a response to you this week.
