UPDATE: North Carolina Division of Water Resources (NCDWR): After review of the submitted Pre -Construction Notification (PCN)/application for the above referenced project, dated 6/22/2022, and Nationwide Permit (NWP) 39 Water Quality General Certification No. 4263, dated 12/18/2020 (https://saw-reg.usace.army.mil/NWP2021/NWP39 StateWQC.pdf), it appears an Individual 401 Water Quality Certification (WQC) is required from the NCDWR for the proposed activities. A re -submission of the PCN, received on 7/20/2022, provided the 9 required elements for an individual WQC and constitutes the Corps initial receipt of the WQC application. The reasonable period of time (RPOT) for you to act on this WQC request is 120 calendar days from the date of the complete WQC request. Unless NCDWR is granted a time review extension, the date upon which a waiver of the WQC will occur if you do not act on the certification is 11/17/2022. Applicant/Consultant: Please note, should we finalize our review prior to receiving the WQC, you will receive a provisional general permit notification from the Corps. Once a WQC is issued or waived by the NCDWR, the Corps will provide you with a final general permit verification. Your proposed work SHALL NOT commence until after the WQC has been issued or waived AND the final general permit verification has been provided to you. Please let me know if you have any questions. It has come to my attention that the email I sent below was sent in error as the 9 required elements for an individual WQC were not included in your submittal on 6/22/2022. Specifically, an application has not been submitted to NCDWR for this project as of yet. As such, the reasonable period of time (RPOT) for NCDOT to act on this request has not started yet, and will not until a complete application has been submitted to NCDWR. Once the Corps is notified that this has occurred we will notify all parties of the RPOT. Please let me know if you have any questions. -Dave Bailey David E.
