addition, there is an existing aerial utility-fine bisecting the property on the south side. and an existing pump stat►on,and

The proposed project includes one impact area to a stream associated with an 8" sanitary sewer line and 30' wide
easement. 'The, proposed Impact Area #1 'includes 34 linear feet of temporary stream impact necessary for a
connection to an existing manhole and Durham County sanitary sewer easement located to the west and off
property.
The applicant is aware of the regional conditions associated with the Nationwide Permits 29. With respect to
residential development conditions (NWP 29- Regional Conditions sectionA0) the applicant does not anticipate any
impacts to streams or wetlands associatedWith stormwater facilities, there'are no impact associated with single -
family recreation facilities, there are,no permanent wetland or stream fills proposed within the floodway/floodpla►n
and,the stream classification for this °project is WS -IV, NSW (i.e. not Outstanding Resource Waters, High Quality
Waters, Coastal Wetlands.or wetland,adjacentrto these waters).

the project engineer, A 30'sewer easement through the buffer is required by Durham,, the site contractorwill make every
effort to minimize disturbance for the sewer installation. The sewer in this location will be installed at minimum depth,

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certif►cation,and Isolated
Wet/ands,Programs" document prepared by the.NC Division of Water Quality on April 10, 2004, version 2 1. The draft
states that,many private developments are unlikely to cause cumulahve,impacts „ including projects such as urban in -fill,
most residential subdivisions and small commercial, developments as well as agricultural and s►Ivicu/tura/ operations. The
Oaks-at Lyon's Farm project is a residential development. The property has been annexed into the City of Durham,
therefore the adjacent "properfies that have potential for development will have the following =,regulations to protect
downstream waters. 1) the Water Supply, Watershed Protection Program which limits development densities as
well as requires protective riparian buffers, 2) the Jordan Watershed Riparian Buffer,Protection regulations, these
regulations require limited development within the riparian buffer area in addition to "diffuse flow" requirements, at'a
minimum and could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved,
and finally 3) the Phase /l'NPDES Stormwater Permit Program, this,program includes permitting requirements for
Municipal Separate Storm Sewer Systems (MS4s) in addition to post - construction stormwater management
requirements We anticipate that the DWR will advise us if any additional information is needed.

This office has "reviewed the subject Sedimentation and Erosion Control Permit
Application. We find the application to be acceptable and hereby issue this letter of
approval. If any stipulations or recommendations are applicable, ,a list is attached and is
incorporated as a part of this letter of approval. Pursuant to Section 3.8.5 of the Durham
City - County Unified Development Ordinance, plans for which no permit has been issued
shall expire one year from the approval date.
Please be advised that a copy of the approved plan must be on file at the job site, and a
land- disturbing permit must be obtained and prominently displayed. Pursuant to G.S
113A -61 (d) and Section 15.5.1 of the Durham City -County Unified Development
Ordinance, you are hereby notified that the Sedimentation and Erosion Control Office
has the right to inspect the site over the life of the project to insure compliance with the
approved plan and ordinance.
The Sedimentation and Erosion Control Program is performance oriented, requiring
protection of the natural resources and adjoining properties. If following the
commencement of this project it is determined that the sedimentation and erosion control
plan is inadequate to meet the requirements 'of, the Durham City- County Unified
Development Ordinance, this office may require revisions in the plan and its
implementation to insure compliance with the Ordinance.

NPDES:
Since this project will disturb one or more acres, stormwater runoff must be permitted
pursuant to the National Pollutant Discharge Elimination System (NPDES) administered
in North Carolina by the Division of Water Quality (DWQ). You are responsible for
complying with the General Permit requirements and are subject to enforcement' by DWQ
for- any violations of the General Permit. Enclosed is a copy of the General Stormwater
Discharge Permit for Construction Activities, NCG010000 covering your activity. The
Permit will be considered valid ,as -long as your submitted plan meets the requirements of
NCQ010000. Further information regarding the General Construction Permit introduced
