This has become an issue during the application process for a Nationwide Permit requested by Mr. Don Oden for a residential homesite that I am also working on. A portion of the proposed driveway crosses a portion of land that is currently in the Protective Covenant related to compensatory mitigation to offset impacts for the Ocracoke Community Park. The actual mitigation for that project is coastal wetlands restoration in a portion of an existing pond and the Covenant is way to legally protect the restoration that will occur. The subject driveway crossing does traverse a portion of the 20 ft wide strip that is meant to serve as an access corridor to the pond. To accurately address this, we now propose to modify the protective covenant to specifically refer to the 20 ft strip as an access corridor to the protected or restoration area. This strip is intended to always be available to access the pond during and after mitigation work there is completed. This has always been the intention, but it was not conveyed exactly as intended. This would reduce the protected area from 2.82 acres to 2.70 acres (by taking out the area of the access corridor), but please understand that the size of the restoration area remains exactly the same (0.72 acres). The Access Corridor will remain as an easement so any regulatory agencies, etc. can access the restoration area in the future. I have attached the following: 1.Existing recorded easement 2.Proposed Changes (easement document and Exhibit A) 3.Updated Nationwide Plan for Don Oden Please note that the 2 attached maps include the updated coastal wetlands line extension and no coastal wetland impacts are proposed with Mr. Oden’s Nationwide permit request.
