I have not yet reviewed the application submitted by Mr. Bunting. However, variances can only be issued to the
property owner or with the property owner's authorization. Thank you for the property ownership information. It will
be very helpful as we work through the variance process.

Jennifer — I am the manager for the Arlington Hills Subdivision and we are concerned about the process
requested by Chris Bunting to get a variance for a small deck he has already constructed and a new deck he is
wanting to construct in the common area of our subdivision. Our covenants do not provide provision for any
structures to built in the common area and we have not given permission for the existing deck to be built nor
for them to build the new deck. We understand that this area is also governed by the Neuse Rive buffer. Our
questions are: Does the association own this land and can permission be given for a variance without HOA
permission. We want to understand how the process works. Mr. Bunting is convinced that the association
cannot deny him the privilege of building on the common area if he can get a variance. We don't see how that
is possible if the Association actually owns the land.
Any help you can give us would be greatly appreciated. We have a responsibility to all owners in the
neighborhood. Thanks!
