Field Investigation Report: Maxey Page 2 Narrative Description: The property is located adjacent to the Neuse River at 1516 Green Springs Road near New Bern, Craven County. This property is currently developed with a residential dwelling and docking facility. The existing pier is 5' wide by 350' long, the existing "L" platform is 10' wide by 16' long, the existing boathouse is 14' wide and 26' long with a 4' by 42' supporting finger pier, and two adjacent tie pilings to support a wet slip. This docking facility has two defined boat slips (wet slip & boat house). The adjacent riparian properties are similarly developed. The elevation of the adjacent high ground of the parcel is approximately 12' above the normal water level (NWL). Vegetation on the parcel mainly consists of lawn grasses, trees, and landscape plantings. The parcel has 257' of continuous shoreline along the Neuse River. Immediate offshore water depths adjacent to the parcel range from —0.5' to —5' NWL. The subaqueous substrate is firm without shell. This proposal is located over 1,200 feet from the nearest Federal Channel. There is not a cultural resource in the project area. This waterbody is approximately 1 mile across at this location. These estuarine waters are not classified as a Primary Nursery Area. Submerged aquatic vegetation (SAV) was not observed at this location due to elevated wave action during the site visit, however historical data of this area suggests the potential presence of SAV habitat. This section of the Neuse River is closed to shellfish harvest and is classified as SC; Sw, NSW. Proposed Development: The applicant is proposing to expand a private docking facility within the Neuse River, near New Bern. The proposed development would take place adjacent to 1516 Green Springs Road, Craven County. This proposal is for private use in a residential setting. The applicant is proposing to expand the north side of the docking facility by replace the existing finger pier with a 5' by 40' access with two 5' by 30' finger piers in order to access the existing boat house, a proposed boat house, and the proposed relocation of the existing wet slip. This would result in a total of three defined boat slips. The proposed boat house would be 16' wide and 25' long. The proposed boat slips would be at the -4' NWL depth contour. Anticipated Impacts: This proposal should not pose a hazard to traditional navigation. The proposed docking facility expansion would usurp an additional 1,750 square feet of Public Trust Area. Traditional marine construction methodology would be utilized during the construction of this project. Turbidity impacts are not anticipated during the construction activities within the Neuse River. This waterbody is not classified as a Primary Nursery Area. Maxey 1516 Green Springs Rd New Bern NC 28560 The Purpose for applying for this major development permit is to seek permission for the improvement and expansion of the existing dock located at 1516 Green Springs Rd. in New Bern INC along the Neuse River. This dock is for private/ personal usage for the docking of small open runabout boats. This project is approx. 2.2 miles southeast of the Alfred Cunningham Bridge, which is the entrance to the Trent River, approx.1.3 miles southwest across the Neuse River from the mouth of Duck creek and approx. 4.2 miles northwest across the Neuse River from the mouth of upper Broad creek and Northwest Creek. The current existing dock has a 5' wide x 350' long concrete style main access walkway with a 10' x 16' concrete platform along with an existing 14' x 26' boat house roof with boat lift on the left side of the platform and a wooden 4' wide x 42' long finger pier on the left side of the boat house roof with two outer mooring pilings beside the finger pier creating two slips, one covered and one wet. The proposed project includes removal and disposal of the existing wooden finger pier at the end of the existing dock. Installation of a new 5' x 40' concrete walkway extending off the left side of main walkway with 2- 5' x 30' long finger piers alongside the boathouse roofs for access, and a new 16' x 25' Boat House roof with boat lift on the left side of existing boat house roof. We will pull and relocated the two existing mooring pilings beside the new roof structure. The dock will have three dedicated boat slips, two covered and one wet slip. The pilings for this dock will be marine treated southern yellow pine timber pile. We will install them with the use of an excavator with vibratory hammer that will be stationed upon a steal barge. Pilings will have a minimum of 10' embedment into the river bottom. Equipment and material will both be stored upon this barge as well. Other dock framing materials and concrete decking will set with the use of gas -powered saws, drills and hand tools. All materials will be attached with 5/8" hot dip galvanized timber bolts. The project proponent hereby certifies that all information contained herein is true, accurate, and complete to the best of my knowledge and belief. Background On April 6, 2022, the United States Supreme Court issued an order staying a lower court's vacatur of the Trump Administration's 2020 "Clean Water Act Section 401 Certification Rule" ("Federal Rule"). As a result of the United States Supreme Court order, the Trump Administration's Federal Rule has sprung back into effect. The Trump Administration's Federal Rule imposes additional procedural requirements on applicants for 401 Certifications and on DWR's processing of those applications. One requirement is that 401 applicants must request a pre -filing meeting request at least 30 days prior to submitting their 401 application. [40 C.F.R. §121.4] In turn, the Federal Rule requires that applicants include documentation of their pre -filing meeting request in their 401 Certification application. [40 C.F.R §121.1; 40 C.F.R. §121.5]. Please refer to the Federal Rule for more information. Per 40 CFR §121 and §121.5, a 401 Certification application that does not include the required pre -filing meeting request documentation does not constitute a "certification request" As a result of the reinstatement of the Trump Administration's Federal Rule, all 401 applications received after April 6, 2022 that do not have documentation that a pre -filing meeting request was submitted at least 30 days prior to submittal of a 401 Certification application will be returned as incomplete.
