Project Setting
The project is located at 975 East Pantego Street adjacent to Boat Harbor Canal, Baker
Canal, and Battalina Creek in the town of Belhaven, Beaufort County and is accessed via a
gravel driveway near the intersection of East Pantego Steet and East Street. The site consists of
three parcels totaling 4.1 acres located directly across Baker Creek from TJ's Marina and
Boatyard authorized under active CAMA Major Permit #115-18 authorizing the development of
a marina and boatyard including 13 defined slips, finger piers, pier landward of the bulkhead,
upland excavation, maintenance excavation within Baker Creek and Battalina Creek to a depth of
-6' below NWL. The property is bordered on the east side by a separate canal, Sargent Canal, off
Battalina Creek with an active CAMA Major Permit#35-22 issued to Sargent Investments, LLC
which included excavation in the canal to -6' below NWL. The property consists mainly of
uplands with a strip of wetlands on Tract B. The Division of Coastal Management has
determined the wetlands on the site to be non-coastal due to Phragmites spp. being the dominant
species present. The US Army Corps of Engineers has confirmed the wetland delineation. The
site was previously used as a commercial fishing/crabbing operation with unimproved docking
and gravel parking/crabpot staging area.
The purpose of this development is to establish a transient vessel marina to attract boats
traveling on the Intercoastal Waterway (ICW) located in the Pungo River approximately 2 miles
from the project site. The marina will offer mooring with 40 formal slips with power, bathhouse,
laundry room and marina store. The proposed development includes excavation below NWL in
Battalina Creek, Baker Creek, Boat Harbor Canal, and the Sargent Canal; upland excavation to
widen all three canals and creek, an open water marina adjacent to Battalina Creek; bulkheading
of the shoreline around the property, piers, and walkways, as well as a 40' x 240' building. All
excavation proposed is bucket to barge and will be either used on site or taken to the approved
upland disposal area owned by the applicant.
Battalina Creek, Baker Creek, Boat Harbor Canal, and the Sargent Canal are designated a
Primary Nursery Area by the Division of Marine Fisheries and are classified as SC; HQW,NSW
by the Environmental Resources Commission. Tract "C" along Sargent Canal is not subject to
the 50' Tar/Pamlico River Buffer per the Division of Water Resources.
Project Description
Excavation Below NWL
Starting near the entrance to the property along Boat Harbor Canal excavation below
normal water level will extend approximately 500' towards Baker's Creek from the center line of
the canal 30' in width on average. The excavation will then extend around the property to the
northeast following the shoreline 400' x 40'avg. towards Battlina Creek; the excavation will then
extend to the east in Battalina Creek covering the area between the shoreline and the previously
approved dredge channels in Battalina Creek and the Sargent Canal measuring 400' x 80' avg.
Maintenance excavation within the Sargent Canal will extend the entire 420' x 10' on average.
All excavation will be to a final depth of-6' at normal water level.
Upland Excavation
Upland excavation will be conducted around the entirety of track "A" from the head of
Boat Harbor Canal to the upland/wetland interface where track"A"meets Track"B". Along
Boat Harbor Canal and Baker Creek upland excavation will extend 5' to 40', average of 20'.
Along Battalina Creek upland excavation will measure 295' x 50'avg. Sargent Canal will be
straightened and widened an average of 13' along the entire 420 length of the canal. All upland
excavation will have a final project depth of-6ft. below NWL.
Bulkhead/Retaining Wall and Fill
Along the uplands and the new proposed shoreline of the property on tracts "A"and "C"
1,592' of vinyl sheeting pile will be constructed. All bulkhead except for the head of Boat
Harbor Canal will be installed on uplands or directly along the upland/wetland interface prior to
excavation. Along the head of Boat Harbor Canal the bulkhead will be placed waterward of
normal water level a maximum of 12' waterward across the 60' span of the existing canal. This
fill is to allow a wider and safer access to the property. Upland fill totaling 75,831ft2 using
material on the site is proposed on tract"A"to raise the elevation of the property and provide
positive drainage. On tract"C" along the Sargent Canal bulkhead will run the length of the canal
and around the end of the peninsula that is fill material from when the Canal was dug, and no
additional fill is proposed.
Upland Development
All major upland development is located on Tract"A". A building that will house the
marina store, bathhouse, and laundry measuring 40' x 240' will be centrally located on the tract
and be accessed via a gravel driveway and parking area that will total 12,499ft2. The diesel fuel
tanks will be located on the eastern edge of the property in a 10' x 30' containment area
approximately 165' south of the fueling station.
Docks and Piers
A dock"Dock A" constructed of concrete "hogslat"will be landward of the bulkhead 6'
wide around the perimeter of Tract"A"measuring 985' in length. "Dock B" measuring 265' x 6'
will extend into Battallina Creek at its confluence with Baker Creek and then turn to the east
terminating in a 16' x 24' platform with a 16' x 16' Gazebo; this will create an open water basin.
"Pier A" starting at the end of"Dock A" will be 8' wide as it extends into Battalina Creek 70'
before turning east and becoming "Dock C', also 8' wide, for 90' at which point it will narrow to
6' and turn up the Sargent Canal for 420' landward of the proposed bulkhead. Fueling and
sewage pumpout stations will be located near the western end of"Dock C"where it intersects
with"Pier A". An 8' x 120' open slatted walkway will connect Tract"A" and Tract"C" near the
middle of the property to cross the wetlands on Tract"B".
Anticipated Impacts
The project as proposed would deepen 73,362ft2 of shallow bottom habitat to -6ft below
NWL in Boat Harbor Canal, Baker Creek, Battalina Creek, and the Sargent Canal. Convert
36,335ft2 of uplands to open water. The docks placed waterward of NWL would shade 3,280ft2
of shallow bottom some of which will be converted uplands. Turbidity and noise are expected in
the adjoining waters during all phases of the in-water. The applicant has proposed constructing
the bulkhead prior to excavation as an effort to minimize impacts to the adjoining water.

The canal off Battalina Creek adjacent Tract"C"will be widened 10' for the purpose of providing
more space to moor vessels "side to" the proposed dock while maintaining navigation. The spoil
bank will be cleared up to the landward edge of Zone 1 adjacent Battalina Creek. A work corridor
for the installation of the proposed bulkhead will be cleared in Zone 1 on the spoil bank. Woody
debris generated from the clearing activities will be hauled to the spoil disposal area behind TJ
Marine Construction business. The shortest distance across the 404 wetlands to access the upland
spoil bank is adjacent the driveway intersection with Pantego Street. Wooden equipment mats will
be utilized to minimize impacts of equipment crossing the wetland. The bulkhead will be
constructed prior to the canal widening. A retaining wall will be constructed along the
upland/wetland interface on the landward side of the spoil bank. The resultant spoil material will
be placed landward of the proposed bulkhead, and retaining wall then sloped, graded, and seeded
and mulched to facilitate establishment of a vegetated ground cover.
Fueling of boats will be limited to Pier "A". The type of boat fuel will be limited to diesel only.
There will be a designated employee who will oversee and monitor fueling events. The employee
will be trained to know where the fuel spill response materials{absorbent socks,pillows, and pads
as well as a floating containment boom) are located and how to use them. A dock box will be
mounted on Pier" A" near the fueling slip. The employee will be trained to follow the Spill
Prevention,Control and Countermeasure plan(SPCC). There will be a sign posted on the fuel pier
with the contact information for the fuel spill response and clean up contractor and the Town of
Belhaven Fire Department. There will be an ABC all-purpose fire extinguisher mounted on a
piling on fuel pier. The fuel nozzles will have a back pressure shutoff and the latch open device
will be removed. A device designed to.capture fuel discharging from the vent will be put in place
over the vessel's tank vent on the vessel's hull prior to initiating the fuel delivery to a boat. The
marina will have a "no topping off' policy and will stop the fuel delivery when the vessel's fuel
tank has reached 95% capacity. Also, there will be an emergency shutoff valve on or adjacent to
Pier "A". All fueling events will be documented and the amount dispensed recorded. Prior to
opening for business, a walk through will be conducted with the Town of Belhaven Fire
Department to ensure that they are familiar with the operation and location and capacity of the
Above Ground Storage tank, emergency shut off valves, fuel dispensers and fuel lines.
Two above ground fuel tanks will be constructed at or above the 100-year flood elevation. The
15,000-gallon tanks are doubled walled and certified as an outdoor tank. It is anticipated that this
tank size will reduce the number of refill events to once a month or longer thus reduce the potential
for a spill during fuel delivery events. Again, a designated and trained employee will monitor the
fuel delivery and will be well versed in the overfill device/alarm on the tank. They also will be
trained on the Spill Prevention, Control and Countermeasure plan (SPCC). A sign will be posted
with the same information provided on the fuel pier with the contact information with the fuel spill
response and cleanup contractor and the Belhaven Fire Department. A storage box will be adjacent
the storage tank with fuel spill absorbents such as socks,pillows,and a granular fuel absorbent. A
concrete pad will be constructed under the tank

with a low wall to contain any small spill and to facilitate the monitoring of any leaks. Bollards
will be strategically placed to prevent vehicles from backing into the structure. There will be
monthly inspections of the fuel system to look for any fuel leaks, abraded fuel hoses, etc.
The upland development has been designed to remove existing impervious surfaces out of the Tar-
Pamlico River Basin Buffer. The redevelopment of the uplands maintains a 50' vegetated buffer
off all surface waters except for the docks which will be pervious,open and slated and the existing
driveway entrance which will not be expanded in the buffer. The bulkhead construction will
maintain flat slopes and diffuse flow through the 50' wide vegetated buffer. The proposed
redevelopment proposal will result in a reduction of existing impervious surface coverage with a
net coverage totaling 15.1 %. If required, an application for a low-density stormwater plan will be
submitted under a separate cover. Once completed and prior to completion of the Major
CAMA/Dredge and Fill application review, an erosion control plan will be submitted to DEMLR
for approval.

Creek to the landward edge of the basin. A long reach excavator on a barge with a spoil
containment structure will complete the channel excavation before the adjacent upland excavation
begins in Battalina Creek. Excavation below the NWL in Baker Creek and Boat Harbor Canal will
be undertakers 'to establish a consistent minus 6.0' water depth. The "corner located at the
confluence of Baker Creek and Boat Harbor Canal will be excavated 40' landward to improve
navigation in this area. The excavation work in Baker Creek and Boat Harbor Canal will be
accomplished with a long reach excavator working from the canal bank. All unsuitable spoil
material form excavation activities will be hauled by dump truck. A rock construction entrance
will be constructed at the driveway entrance to Tract "A" prior to the beginning of hauling
activities using 2-3 inch washed stone, placed 6 inches deep for a distance of 50' and 12' wide.
The offsite spoil area is a 3.3-acre upland disposal area located at 27159 US HWY 264 East in
Belhaven. The spoil area is an agricultural field located behind TJ Marine Construction. The spoil
material will be stockpiled and allowed to dry. Once the spoil material has dried, the stockpiled
material will be stabilized with a permanent vegetated cover if the material is to be left idle for
longer than 2-weeks. A 2.5' tall earthen berm will be pushed up around the perimeter of the area
and provided a permanent ground cover prior to spoil hauling activities. A rock construction
entrance to the spoil area will also be in place.
The excavation activities are a contiguous widening of an existing canal system with design
elements to increase or maintain the ability for the canal system to flush. The depth of excavation
activities below NWL will not exceed the connecting water depths in Battalina Creek. The largest
area of excavation for mooring is located at the entrance to the canal system. The existing 90°
angle at the confluence of Baker Creek and Boat Harbor Canal will be widened by 40' thus
increasing the surface area and ability to move water into and out of Boat Harbor Canal.
All dockage will be "side to" the proposed dock system with no outboard tie pilings. For this
application and agreed to at the May 31,2022,scoping meeting in the Washington Regional Office,
slips will be counted every 50 linear feet of contiguous dock absent of an angled turn. Power
pedestals will be installed every 30 linear feet to allow boats requiring multiple hook ups adequate
power. A fender piling will be driven every 8' against the bulkhead. There will be a 50' section
of bulkhead and dock constructed on the TJ Transient Marina property that will be leased by the
boatyard owned by William Axson Smith Jr. across Boat Harbor. This 50' section of dock is
located directly across from the haul out slip on the Smith property. A sign will be installed
notifying customers of TJ's Transient Marina not to tie their vessels in this area.
Pier"A" and a portion of Dock" C"will be designated for the fueling of boats and the location for
the marine pump out. An 8' x 80' section of this pier will be constructed over delineated 404
wetlands vegetated with Phragmites sp. A retaining wall will be constructed along the wetland
/upland interface from Pantego Street to Battalina Creek. There will be an 8'x 116' walkway over
this wetland to Tract "C" and a 6' wide dock adjacent and landward of a bulkhead adjacent the
canal on Tract "C".

Enclosed is a Major CAMA/Dredge and Fill permit application for development of a transient boat
marina on property owned by TJ Land Development LLC located at 975 Pantego Street adjacent
a manmade canal system, Baker Creek, and Boat Harbor Canal, at the head of Battalina Creek off
the Pungo River, in the Town of Belhaven, North Carolina. The project site consists of three
separate parcels totaling 4.1 acres. One of the parcels is adjacent a separate canal off Battalina
Creek that was subject of a recent Major CAMA permit review and issuance of permit no. 35-22
on April 4 to Sargent Investment Properties LLC that included excavation of a channel into the
canal. Also, Major CAMA/Dredge and Fill permit no 115-18 issued to TJ Land Development
authorized development of a boat maintenance yard that include channel maintenance in Battalina
Creek and Baker Creek to minus 6.0' below the normal water level (NWL), excavation to widen
existing canals, slips, and travel lift. This permit was also modified to allow the installation of
channel markers to improve the safety of transient boats accessing the boatyard. The Section 404
wetlands have been delineated on all tracts, approved by the US Army Corps of Engineers, SAW
2022-00416. The Division of Coastal Management did not assert the Coastal Wetland Area of
Environmental Concern jurisdictional authority on the wetlands because of the lack of coastal
wetland species as the wetlands are dominated by Phragmites(Common Reed). The project design
avoids significant impacts to wetlands other than some shading for a pier and boardwalk.
The primary purpose of this development proposal is to establish a transient boat marina to attract
boats traveling the Intercoastal Waterway(1CW)located in the Pungo River approximately 2 miles
from the project site. In addition to mooring of vessels, amenities offered to boaters will include
a bathhouse, laundry room and marina store. Wastewater generated form the bathhouse and
laundry room will be handled by the Town of Belhaven sewer system. Fueling services and a
marine pump out will also be provided. Boat maintenance activities will be restricted to the TJ
Marina and Boatyard on the other side of the canal. A 40' wide x 240' long building will be
constructed on Tract "A"to house the amenities. The building avoids impacts to the Tar-Pamlico
River Basin Buffer as does the associated gravel parking area. The building will be elevated on
pilings with parking underneath.
The canal system around the perimeter of Tract "A" will be widened from 15" to as much as 65'
to improve navigation in the canal system and to facilitate "side to" mooring of vessels to a dock
to constructed on the landward side of the bulkhead around the perimeter of Tract"A". The dock
constructed over land will be 6' wide. The widest and largest area of upland excavation is at the
entrance to the canal system where an area 50 ay. X 295' long basin will be excavated. A dock 8'
wide x 284' long will be built in the basin and extend into Battalina Creek and will maintain
consistency with the "'/4" rule prior to and after undertaking the excavation. Excavation will be
taken below the NWL to establish a consistent minus 6.0' depth from the channel in Battalina
