RE: Response to Violation-Town of Fremont WWTF
Permit#WQ0034102
Dear Mr.Tankard:
Good day and I hope this letter finds you well. We appreciated the recent inspection accomplished by Mr.Sipe and we
look to make our program better because of it. We received your letter on the 16th of July with regard to your
inspection of the Town of Fremont WWTF and was performed to ensure we were operating within the parameters of
our Non-discharge Permit No. WQ0034102. The findings and our way forward are as follows:
1. "Woody vegetation (trees and shrubs) continues to be present on the outside of the western berm of the
lagoons. This is in violation of Condition 111.15 of Permit No. WQ0034102, which states that trees, shrubs, and
other woody vegetation shall not be allowed to grow on earthen berms and embankments, and that these
structures shall be kept mowed."
Town response: Woody vegetation,trees,and shrubs, will be removed from the outside edges of all the berms
surrounding both ponds. We plan on having all woody vegetation removed from the berms by the end of CY-22.
The goal is to perform most of the work outside of the hot growing season and within the relative comfort of the
colder months of the year. This position allows us to move the trees without leafy tops and without the nuisance of
yellow jackets and snakes.
2. "At the time of the inspection the ORC did not have documentation that soil fertility analyses had been
performed on the irrigation sites since December 28,2020. Condition IV.12 of Permit No.WQ0034102 requires
that soil fertility analyses be performed on an annual basis and that soil fertility results be maintained by the
permittee for five years."

Town response: The town will verify soil samples are taken and will retain a copy on file in compliance with valid
permit. Our goal will be to ensure samples are taken before the 30th of November of each calendar year going
forward. Having samples taken before December of each year allows for a variance of one month for scheduling's
sake and to ensure the yearly timeframe is adhered to. We are currently in work on a contract with a local farmer
that codifies and captures our spray field maintenance and care required.
