A review of the May 2022 Discharge Monitoring Report (DMR) for the subject facility revealed the violation(s)
indicated below:

A Notice of Violation/Intent to Issue Civil Penalty is being issued for the noted violation of North Carolina General
Statute (G.S.) 143-215.1 and the facility's NPDES WW Permit. Pursuant to G.S. 143-215.6A, a civil penalty of
not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or
fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S.
143-215.1.

Fourth Creek WWTP
Dear Mr. Basinger,
Upon reviewing the data for the month of May 2022 and discussing the overall operations of the Fourth
Creek WWTP with the Supervisor, we believe that several rain events throughout the month of May
made an impact to the effluent Ammonia Nitrogen permit violation.The heavy rain events caused an _
increase in the raw influent coming into the WWTP.
The rain events coupled with some process control issues that we discovered inside the Fourth Creek
WWTP have contributed to this NOV. The Fourth Creek WWTP Supervisor has taken the necessary steps
and made the needed changes in the process control to address the issues mentioned above. In
reviewing the effluent data for the last month and continuing into July,we are tracking to meet all the
permitted parameters. We will continue to monitor the process control issues and fully expect any
future permit violations to be a minimum.
The City continues to monitor the I&I issues that contribute to the problems listed above and we are
currently taking steps to repair some of the collection lines that have been neglected over the years
that would play a factor in all of this.
The City is committed to effective operations to maximize reduction of the amount of all permitted
parameters distributed into the receiving stream for the Fourth Creek WWTP.

Wes, I wanted you to be aware of a monthly violation at the Fourth Creek WWTP for May 2022. Please see below.
• Ammonia Nitrogen monthly average for May 2022 = 2.3 mg/I. The limit is 2.0 mg/I
Looking back at rain fall data, we had a total of 5.26 inches of rain for the month of May. This is the contributing factor
for this violation.
Please advise if you need more information.
