Department of Environment and Natural Resources.(DENR) staff Cyndi Karoly and Amy Chapman, and your client Ross Lampe. As agreed at the conclusion of the meeting, I am writing on behalf of DENR to state DENR's decision after consideration of the information you submitted. The purpose of the meeting was reconsideration of DENR's vested right determination for the above- referenced property from the Neuse River Suffer Rule; (] SA NC AC 2L.0233)..A± our meeting you presented additional information - - a legible recorded subdivision plat dated before the adoption of the Neuse Buffer Rules - - which shows that the lot was for a residential structure that would be serviced with water and sewer. Based upon that reconsideration DENR has determined the above - referenced property is exempt from compliance with the buffer requirement of 15A NCAC 2B.0233 and that Mr. Lampe acquired a "vested right" to utilize Lot 23 of the Carriage Hills Subdivision as originally platted for a single family residence. This letter only addresses the applicability of the Neuse River Buffer Rules (15A NCAC 2B.0233) and does not authorize any activity within the buffer. Thank you for your time in this regard.
