Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant
to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
This final permit contains the following changes to its terms from those found in the draft permit sent to
you on December 17, 2014.
• An entry has been made on the limits and monitoring page referencing the upstream monitoring of
flow, as required in condition A. (4.) of the permit.
• Citations have been added showing the regulatory justification for particular permit requirements.
• Updates have been made reflecting administrative changes within the permitting agency that have
occurred since the draft permit was prepared.
You are also reminded of the new condition requiring electronic reporting of discharge monitoring
report (DMR) data using the Division's eDMR interne application. This new requirement will become
effective on December 1, 2015 (approximately 270 days or nine months following the effective date of
the permit).
Please note that this section of the Broad River is listed as an impaired waterbody on the North Carolina
303(d) Impaired Waters List. This means that the stream does not meet all best uses associated with its
classification. Addressing impaired waters is a high priority with the Division, and instream data will
continue to be evaluated. If there is noncompliance with permitted effluent limits and stream
impairment can be attributed to your facility, then mitigative measures may be required

If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Resources or any
other Federal, State, or Local governmental permits that may be required.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.

Footnotes:

3. The Division shall consider all effluent TRC values reported below 50 µg/L to be in compliance with the
permit. However, the Permittee shall continue to record and submit all values reported by a North Carolina
certified laboratory (including field certified), even if these values fall below 50 fig/L.
4. The monthly average effluent BOD5 and Total Suspended Solids concentrations shall not exceed 15% of
the respective influent.value (85% removal).
5. Chronic Toxicity Ceriodaphnia dubia 7 day pass/fail testing during the months of January, April, July and
October. See A. (3.) for details of toxicity test requirements.
6. Analysis must be performed using EPA Method 1631E, and must be completed within the twelve (12)
months prior to the next permit renewal. See condition A. (5.).

There shall be no discharge of floating solids or visible foam in other than trace amounts.

A. (3.) CHRONIC TOXICITY LIMIT (QUARTERLY)
[15A NCAC 02B .0200 et seq.]
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant
mortality to Ceriodaphnia dubia at an effluent concentration of 10.4 % at the 0.495 MGD permitted
flow level, and 19 % at the 0.995 MGD permitted flow level.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in
the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December 2010, or
subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure"
(Revised- December 2010) or subsequent versions. The tests will be performed during the months of
January, April, July and October. These months signify the first month of each three-month toxicity
.testing quarter assigned to the facility. Effluent sampling for this testing must be obtained during
representative effluent discharge and shall be performed at the NPDES permitted final effluent
discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV
below the permit limit, then multiple -concentration testing shall be performed at a minimum, in
each of the two following months as described in "North Carolina Phase II Chronic Whole
Effluent Toxicity Test Procedure" (Revised -December 2010) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter
code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWR Form
AT-3 (original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Water Sciences Section no later than 30
days after the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate
signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if
chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number, pipe number, county, and the month/year of the
report with the notation of "No Flow" in the comment area of the form. The report shall be submitted
to the Water Sciences Section at the address cited above.

A. (3.) CHRONIC TOXICITY LIMIT (QUARTERLY), continued
Should the permittee fail to monitor during a month in which toxicity monitoring is required,
monitoring will be required during the following month. Assessment of toxicity compliance is based on
the toxicity testing quarter, which is the three month time interval that begins on the first day of the
month in which toxicity testing is required by this permit and continues until the final day of the third
month.
Should any test data from this monitoring requirement or tests performed by the North Carolina
Division of Water Resources indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls,
shall constitute an invalid test and will require immediate follow-up testing to be completed no later
than the last day of the month following the month of the initial monitoring.
A. (4.) LAKE LURE DAM DISCHARGE
[G.S. 143-215.66]
The Town of Lake Lure controls the discharge rate of impounded water from Lake Lure. The Division
has modeled the treatment plant's environmental impact based on flow parameters assuming a
minimum discharge of 6.6 cfs. Therefore, as a Special Condition of this permit, the town shall record
weekly (on the Upstream DMR) the Lake Lure Dam discharge to further evaluate the validity of these
flow -based assumptions.
A. (5.) EFFLUENT MERCURY ANALYSIS
[15A NCAC 02B .0400 et seq., 02B .0500 et seq.]
The Permittee shall provide one effluent mercury analysis, using EPA Method 1631 E, in conjunction
with the next permit renewal application. The analysis should be taken within 12 months prior to the
application date. Any additional effluent mercury measurements conducted from the effective date of
this permit and up to the application date shall also be submitted with the renewal application.
If the result of the mercury analysis is not provided with the application, the application may be
returned as incomplete and the Permittee considered non -compliant.

A. (6.) ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS
[G.S. 143-215.1(b)]
Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs)
and specify that, if a state does not establish a system to receive such submittals, then permittees must
submit DMRs electronically to the Environmental Protection Agency (EPA). The Division anticipates
that these regulations will be adopted and is beginning implementation in late 2013.

1. Reporting [Supersedes Section D. (2.) and Section E. (5.) (a)1
Beginning no later than December 1, 2015 (270 days from the effective date of this permit), the
permittee shall begin reporting discharge monitoring data electronically using the NC DWR's
Electronic Discharge Monitoring Report (eDMR) internet application.
Monitoring results obtained during the previous month(s) shall be summarized for each month and
submitted electronically using eDMR. The eDMR system allows permitted facilities to enter
monitoring data and submit DMRs electronically using the internet. Until such time that the state's
eDMR application is compliant with EPA's Cross -Media Electronic Reporting Regulation
(CROMERR), permittees will be required to submit all discharge monitoring data to the state
electronically using eDMR and will be required to complete the eDMR submission by printing,
signing, and submitting one signed original and a copy of the computer printed eDMR to the
following address:

If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the
facility being physically located in an area where less than 10 percent of the households have
broadband access, then a temporary waiver from the NPDES electronic reporting requirements may
be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1.1, 2, 3)
or alternative forms approved by the Director. Duplicate signed copies shall be submitted to the
mailing address above.
Requests for temporary waivers from the NPDES electronic reporting requirements must be
submitted in writing to the Division for written approval at least sixty (60) days prior to the date the
facility would be required under this permit to begin using eDMR. Temporary waivers shall be
valid for twelve (12) months and shall thereupon expire. At such time, DMRs shall be submitted
electronically to the Division unless the permittee re -applies for and is granted a new temporary
waiver by the Division.

Regardless of the submission. method, the first DMR is due on the last day of the month following
the issuance of the permit or in the case of a new facility, on the last day of the month following the
commencement of discharge.
2. Signatory Requirements [Supplements Section B. (11.) (b) and supersedes Section B. (11.) (d)1
All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part
II, Section B. (11.)(a) or by a duly authorized representative of that person as described in Part II,
Section B. (11.)(b). A person, and not a position, must be delegated signatory authority for eDMR
reporting purposes.
For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user
account and login credentials to access the eDMR system. For more information on North
Carolina's eDMR system, registering for eDMR and obtaining an eDMR user account, please visit

Certification. Any person submitting an electronic DMR using the state's eDMR system shall
make the following certification [40 CFR 122.22]. NO OTHER STATEMENTS OF
CERTIFICATION WILL BE ACCEPTED:
"I certify, under penalty of law, that this document and all attachments were prepared under my
direction or supervision in accordance with a system designed to assure that qualified personnel
properly gather and evaluate the information submitted. Based on my inquiry of the person or
persons who manage the system, or those persons directly responsible for gathering the
information, the information submitted is, to the best of my knowledge and belief true, accurate,
and complete. I am aware that there are significant penalties for submitting false information,
including the possibility of fines and imprisonment for knowing violations."

The permittee shall retain records of all Discharge Monitoring Reports, including eDMR submissions.
These records or copies shall be maintained for a period of at least 3 years from the date of the report. This

The Town of Lake Lure WWTP is a Grade 2 physical/chemical plant (Grade 3 biological) with 0.995
MGD design flow. The permit was last reissued on June 11, 2009. The Permittee submitted EPA Form
2A on February 28, 2013 in order to request renewal of the permit. Since the flow of this plant is below
1.0 MGD and consists entirely of domestic flow, the extended effluent testing and second species
toxicity tests do not apply.
The existing WWTP consists of:
• Mechanical bar screen
• Flash mixer

RECEIVING STREAM
Discharge is to the Broad River just downstream of the Lake Lure dam. The Town of Lake Lure is the
only NPDES permitted discharger in the subbasin. This subbasin includes the headwaters of the Broad
River from its source in Buncombe County to the confluence with Cove Creek in Rutherford County.
The segment of the river where the discharge occurs has been placed on North Carolina's 303(d) list,
indicating that it does not support all designated uses. In this case the stream has been placed on the

list due to a downstream site receiving a "fair" classification resulting from a benthic stream
assessment in 2005. There was some speculation that the lower rating was a function of the assessment
being performed later in the season than had been done previously. A 2010 evaluation at the same site
yielded a classification of "good," and found water quality to be much improved. The WWTP has not
been cited as a contributor to any degradation of water quality in the Broad River. Excellent water
quality conditions have been found within the basin above Lake Lure. Most of the high gradient
tributary streams in this subbasin are classified as Trout waters and are capable of supporting wild trout
populations. Water quality in Lake Lure is also good.
PRETREATMENT
The facility has no permitted discharging Industries and no pretreatment program.
EXISTING PERMIT CONDITIONS
The discharge from the facility currently has limits for flow, BOD, TSS, Ammonia, pH, Fecal
Coliform, and TRC. The facility monitors the effluent and reports for Temperature, Total Iron, Total
Nitrogen and Total Phosphorus. Influent monitoring is required for flow, iron and alkalinity.
Upstream and downstream monitoring is conducted for dissolved oxygen, pH, temperature and fecal
coliform.
COMPLIANCE SUMMARY
The facility faces ongoing operational challenges relative to its being able to consistently comply with
permitted effluent limitations, including:
• Much of the Town's collection system is under the lake, creating a situation where the potential
impacts of small leaks are exacerbated and I&I remains a constant concern.
• The influent to the WWTP is usually quite diluted with extraneous flow, especially in winter
when the tourist population is reduced.
• The location of the collection system causes flow to the plant to chilled throughout the year,
inhibiting biological activity.
• Between the characteristics of the lake water and the contribution provided by the cast iron pipe
of the collection system, the influent contains high concentrations of iron. With the addition of
chlorine during the treatment process the iron oxidizes and falls out as a solid, leaving the
Town with high volumes of inert solids that can interfere with disinfection, and must be
disposed of for reliable operation.
• As a result of its unique circumstances the Town attempted to operate the WWTP as a
physical/chemical plant for a number of years, with mixed results. The Town states it is
currently operating the WWTP as a biological plant (or at least a hybrid plant).
Throughout the last permit cycle the WWTP has experienced effluent limit violations, most notably for
TSS, fecal coliform and ammonia. Improved operational oversight has greatly reduced the frequency

of violations of TSS and fecal limits. However, the WWTP remains in consistent noncompliance with
both monthly and weekly average limitations for ammonia.
From April 2012 through March 2013, the WWTP operated under the terms of a settlement agreement
that required the Town to perform studies and activities that would bring about a return to consistent
compliance at the WWTP. While most of the requirements of the agreement were satisfied, the Town
has not returned to consistent compliance, especially with respect to ammonia.

CHANGES SINCE LAST PERMIT RENEWAL
The Town has benefitted from a collection system pipe wrapping project that has dramatically reduced
the amount of I&I entering the system and reaching the WWTP.
The Town has experimented with various pilot projects in efforts to improve effluent quality from the
WWTP.
The Town has investigated the possibility of construction of a sewer line to connect its system to
another municipal WWTP, resulting in elimination of the discharge from the Lake Lure WWTP.
Nothing has moved beyond the investigation stage.
PROPOSED PERMIT CHANGES:
• Influent monitoring of Total Iron and Alkalinity have been removed from the permit. Both were
added to the last renewed permit pursuant to the recommendation of the hearing officer. The iron
monitoring was to help characterize sources of iron, and alkalinity monitoring was to assist in
process control for alkalinity addition. At this time, the issues involving iron are sufficiently
known, and process control testing will be left as the responsibility of the permittee.
• The WWTP's existing flow limit was established as a result of the large volumes of inflow and
infiltration that were reaching the plant. With the recent I&I reduction work being so effective,
flows to the WWTP are dramatically less than in previous years. As a result, the permit has been
written with tiered limit (0.495 & 0.995 MGD) pages reflecting the current operational status. The
changes in flow also affect allowable ammonia limits at the lower permitted flow.

• Ammonia limits have been slightly modified due to a change in the input for background ammonia
concentrations in the toxicity model. The model assumes a 0.2 mg/L background concentration.
Studies of Lake Lure have shown ammonia concentrations are consistently <0.02 mg/L.
• The WWTP has in the past been operated as a biological treatment system, and more recently as a
physical/chemical plant (due primarily to the high flow of low strength, diluted wastewater). With
reduced flow, the WWTP is currently operated as something of a hybrid between the two. By
definition, the WWTP is a Grade 2 biological WWTP and a Grade 3 Physical/chemical WWTP. At
the last renewal, the permit was given 3/week monitoring frequencies for most parameters
(consistent with that for Grade 3 facilities), whereas the same monitoring had been weekly in all
previous versions of the permit. The Town requested the monitoring frequencies be restored to
weekly. In light of all the circumstances, a compromise has been made, where monitoring for most
parameters will be established at 2/week, except for ammonia and fecal coliform, which will retain
3/week monitoring based upon historical noncompliance and the presence of an outdoor recreation
establishment that uses the river not far downstream of the discharge.
• Monitoring for mercury (once per permit cycle) has been added to the permit pursuant to the
permitting strategy for the statewide mercury TMDL.
• The eDMR reporting condition has been added to the permit, with eDMR reporting to begin no
later than December 1, 2015.

TREATMENT SYSTEMS
(a) The following discharging systems are assigned a classification of Grade I Biological Water Pollution Control
System unless the permitted flow, or operational complexity of the system requires a higher classification:
(1) septic tank/sand filter systems;
(2) biological lagoon systems; and
(3) constructed wetlands and associated appurtenances.
(b) Systems that utilize an activated sludge or fixed growth process with a permitted flow less than or equal to 0.5
million gallons per day (mgd) are assigned the classification of Grade II Biological Water Pollution Control System.

Data Analysis
The site is about 13 kilometers west of Rutherfordton, about 13 stream -kilometers downstream of the reservoir of Lake Lure, and within a 303(d)-listed
segment (AU 9-(22)b) due to the classification of Fair received following benthic sampling at this site in 2005. The catchment is primarily forest, with
some development (Chimney Rock, Lake Lure).
The BAU have benthic data for four sampling events beginning in 1995, all using Full Scale collection methods. EPT Richness in 2010 is much greater
than for the prior high in 2000 (42 versus 31 taxa) and more than double that collected in 2005 (19 taxa). Also, the NCBI value is significantly lower
than for any prior collection event. It was noted in the prior basinwide report that only one stonefly taxon was collected in 2005 while four were
collected during each of the two prior sampling events in 1995 and 2000. Five stonefly taxa were collected in 2010.
The late season collection in 2005 likely contributed to both the depressed EPT Richness and high NCBI value. Compared to results from 1995 and
2000, where seasonal effects should be nearly non-existent, the combination of the significant increase in EPT Richness and decrease in NCBI value
in 2010 is highly suggestive of an improvement in water quality since those two earlier sampling events.
As in 2000, a large mussel bed was noted in the reach sampled in 2010. No such bed was found by the field crew sampling in 2005.

On behalf of the Town of Lake Lure, Please find attached the NPDES Permit Renewal
Application for the Town of Lake Lure WWTP. Current NPDES permit no. NC0025381.
Per our conversation, we would like to propose a two (2) tiered permit. The first tier is a
flow parameter of 0-0.495 MGD. The second tier is based upon the excessive flow of
.496-.995 MGD.

We have attached the NDPES FORM 2A, the current limits, our proposed limits and the
basis of calculations for the limits.
Please note the following items for the proposal of the Tier 1 flows. Please refer to the
existing limits (Attached) and Tier 1 Proposed Limits (attached)
Tier 1
1. Flow is proposed to be 0-.495 MGD based upon our average flow of .389 MGD
2. Total Iron: We propose the removal of total iron measurement. The iron is
evident in the testing and field observation, however the cost of the testing is no
longer justifiable.
3. Alkalinity: We propose the removal of alkalinity as a reportable test. This is
added cost and not necessary as the plant is not run as a physical -chemical plant.
4. Aluminum: We are proposing to remove the aluminum as the plant is no longer
relying on alum as a primary coagulant and flocculation at the plant.
5. Total Residual Chlorine: We propose the reporting to be more in line with
biological plants similar in size. We are proposing to reduce the reporting from
three (3) times a week to once a week.
6. BOD: We are proposing a weekly composite only, a reduction from 3 weekly.
7. TSS: We are proposing a weekly composite only, a reduction from 3 weekly.
8. NH3: Aprill-Oct 31, we are proposing a higher monthly and weekly average
based upon actual loading. Please refer to attached calculations.
9. pH: We are proposing a weekly grab only, a reduction from 3 weekly.
10. Temperature: We are proposing a weekly grab only, a reduction from 3 weekly.
11. Fecal Coliform: We are proposing a weekly grab only, a reduction from 3
weekly.
12. Total nitrogen: No change proposed
13. Total Phosphorus: No change proposed
14. Chronic Toxicity: No change proposed
15. We are proposing that all the up and downstream measurements for the following
be removed, as they implemented in 2009 when it was thought by NCDENR that
the plant should be operated solely as a physical -chemical plant. Since that time
and during the WWTP yearlong study performed in 2012-13, we have learned the
plant operates as a biological plant hybrid.
