Division of Water Resources’ Central and Regional staff has reviewedthe application package
receivedDecember 21, 2022. However, additional information is required before the review may be
completed. Please address the items on the attached pages no later than the close of business on April 18,
2022.
Please be aware that you are responsible for meeting all requirements set forth in North Carolina
rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant’s responsibility. In addition, any omissions made in responding to the outstanding items
in SectionsA through C, or failure to provide the additional information on or before the above requested
date may result in your application being returned as incomplete pursuant to 15A NCAC 02T .0107(e)(2).

A. Attachment A – Site Map:
1. The current permit mentions that there is a water supply well within 100 feet of the treatment units.
However, I couldn’t find a map to relate the water supply well to the irrigation facilities. No water
supply wells shall be operated within the compliance boundary of a disposal system in accordance
with 15A NCAC 02L .0107(d), which is established 250 feet from the waste boundary, or 50 feet
from the property boundary, whichever point is closer to the waste boundary. Please provide a map
relating the water supply well to the waste boundary. If it is determined that the well is within the
compliance boundary of the disposal system, a redefined compliance boundary shall be established
in accordance with 15A NCAC 02T .0105(h).
B. Attachment G – Easement, Encroachment, and Lease Agreements:
1. The irrigation fields are located on parcel #248300967839 owned by Brown’s Realty Partnership,
who is not the permittee. In accordance with 15A NCAC 02L .0107(f), if the permittee is not the
owner of the land within the compliance boundary, the landowner of the land within the compliance
boundary shall execute and file in the Register of Deeds in the county in which the land is located,
an easement running with the land which:
a. contains:
i. either a notice of the permit, including the permit number, a description of the type
of permit, and the name, address and telephone number of the permitting agency; or
ii. a reference to a notice of the permit with book and page number of its recordation if
such notice is required to be filed by statute;
b. prohibits the construction and operation of water supply wells within the compliance
boundary; and
c. reserves the right to the permittee and the State to enter on such property within the
compliance boundary for groundwater monitoring and remediation purposes.
An easement shall be executed and recorded in the Duplin County Register of Deeds that fits the
above requirements.
2. The Non-Discharge Wastewater System Waiver from Pelmon Jart Hudson, Jr. for parcel 01-765
(Duplin County Deed Book/Page 1850/1002) has a clause the that the setbacks shall be waived for
a period of five years. The document was signed by Mr. Hudson and dated May 24, 2017, so the
waiver would be set to expire on May 24, 2022. Please re-execute this setback waiver so that it
meets the requirements set forth in 15A NCAC 02T .0106(d).
C. Existing Permit:
1. Condition III.17. of the existing permit incorporates the Waste Utilization Plan by reference into the permit.
Please provide the most current version of this plan for reference.
