Salisbury Street Raleigh, North Carolina 27699 Dear Ms. Higgins, Reference: Western North Carolina Stream Initiative: Hoyle Creek Stream Restoration Stantec Consulting Services, Inc. (Stantec) has recently entered into an agreement with The Resource Institute (RI) to conduct stream restoration services for the above referenced project. The landowner, Leonard Keever, has enrolled this project in the USDA -NRCS EQIP (EQIP) program. The Resource Institute serves as project manager for this EQIP funded project. The proposed project is located near the town of Lincolnton, Lincoln County, NC, within the South Fork Catawba River Basin (HUC 03050102). The project consists of natural stream design and construction on 2,285 linear feet of Hoyle Creek. Stantec has received authorization for the USACE- Wilmington District (Corps) May 7, 2014 that this project qualifies as an exception to the NWP 27 pre- construction notification, as it is a "voluntary stream or wetland restoration or enhancement action, documented by the NRCS or USDA Technical Service Provider pursuant to the NRCS Field Office Technical Guide Standards ". The Stantec staff that have designed this project are qualified Technical Service Providers and the design elements used are consistent with technical standards established by NRCS. No wetlands were located within the project boundary. Soils are mapped as Riverview (RvAO 0- 2% slope, well drained. Streams assessed included two perennial tributaries to Hoyle Creek. Stantec is requesting 401 certification for the construction of this project. Please find attached the NWP PCN, USGS topo map, soils map, Corps authorization and agent authorization. Also attached are a set of concept drawings, including site location and proposed enhancement /restoration activities. Stantec requests that this letter and supporting documentation serve as the required reporting in support of the proposed activity exception. Your notification proposes 2,285 linear feet of stream impacts to waters of the U.S., Hoyle Creek. Based on the information you provided, your -work is authorized by Nationwide Permit (NV,/,P) 27 for Aquatic Habitat Restoration, Establishment, and Enhancement Activities. This work will not require a pre- construction notification (PCN) due to the binding - agreement with the NRCS and Mr. Keever for this Environmental Quality Incentives Program'funded project for stream' and wetland restoration/ enhancement actions. Please note the proposed work is to be,accomplished in strict accordance with -the attached NWP 27 conditions and submitted notification. Resource Institute can assist in projects in a variety of ways, including, Ir but not limited to, fund- raising, administering project funds, and contracting for services needed to complete a project. Resource Institute currently has adopted a project referred to as the Western North Carolina Stream Initiative to help farmers and landowners address the eroding stream banks that are affecting their loss of property, hazards for livestock, sediment into the stream and aquatic habitat. The farmer/landowner has already signed an agreement with NRCS for partial funding to help resolve those issues. Resource Institute's roles is to help provide the remaining funding, design and construction of the °work on those sites that -are already enrolled' in. r the EQIP program with NRCS Resource Institute will be assisting the farmer/,landowner to help resolve the problem { there by providing the design, planning, pennitting and construction work for stream enhancement of the site, some structure work, and bank stabilization. Resource Institute's objective is to help resolve a water quality issue, but we cannot guarantee the work against future storm events. Resource Institute is working with NRCS, Conservation Districts and the farmer /landowner to help 'reduce those impacts as much as possible with the limited funding available. r In providing services to the farmer /landowner on this tract of land for stream work to be performed we thereby mutually ,agree ,to the following items: 1. The fanner /landowner will allow ingress and egress for all works of improvement, surveys, engineering, construction, monitoring, etc. to Resource Institute and its agents for work to be performed. 2. Farmer /landowner will follow through with the EQIP program that he has signed up for with the USDA, NRCS. 3. Farmer /landowner will maintain installed, stream conservation practices for the period agreed to with NRCS. 4. Farraer/landowner will provide.the Resource, Institute with a copy of the NRCS EQIP contract, this info will be share with Resource Institute's other funders in helping to obtain matching dollars to complete work on property. 5. RI serves-as the.financial manager for all funds, received to the project. 6. RI provides project management services such as, obtaining the�technical resources, bidd ng`and contracting of project elements, and project construction oversight. 7.
