ROJE `T ,SETTING The Town of Windsor has submitted a Mayor CAMA permit request for development on a leased property on the Cashie River. The Town of Windsor,has leased the property from Stanely Thompson for 25 years. The site has historically been utilized for fishing access during the Hickory shad migration. The lot is a 0 6 acre site north of the Town of Windsor off Hoggard Mill Road (SR 1303) downstream of the'North Carolina 'Division of Transportation Bridge. There is an existing gravel parking lot with no other upland structures present. The parking lot was permitted to fill wooded wetlands in 2013 and occurred outside of any of the North Carolina Division of Coastal Management Areas of.Environmental Concern. The natural shoreline consists of wooded wetland's comprised of cypress, black gum, and river birch with emergent plants just water ward of Normal Water Level (NWL). At the time, of the site}visit there was no SAV observed at the location of the proposed structure. The adjacent properties up and down stream are currently undeveloped wetlands Water depths 20' water ward of NWL are ± - 10'NWL. The Cashie River is classified as C SW'by the Environmental Management Commission at the project site. The,proj ect site is located in inland waters and is designated as Anadromous Fish Spawning Area by the North Carolina Wildlife Resource Commission. BIZ ®.iECT ` SE TTING The applicant proposes'to construct an 18' x 24'' floating;kayak launch connected to4a 70' x 4.75'' shore parallel fishing pier by a 25' x 5' gangway. The upper end of the fishing pier will be doubled' in width to create a 9.5' x 40' area with additional room for shad fishing. The pier will connect to the parking 1'ot by two Walkways (50' x4.7 5' and 45' x 4.75') elevated 2.5' above the wetland substrate. In the existing gravel parking lot, gravel will be removed to create one concrete handicap parking spot and gravel will be used to dissipate stormwater discharge velocity into the adjacent wetlands. ANUCIP A -TED IMP4CT.S The project will result in localized turbidity due to the instal'lation of pilings. The platforms and piers will result in shading ± 1,295 75ft2'of the Cashie River bottom and 228ft2 of wooded wetlands., Kevin Hart-14 July 2014 Washington Regional Office Kayak and ]Fishing Facility 1. Unless specifically altered herein, this permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application No other structure, whether, floating or stationary, may become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures may be conducted on, in or over public trust waters without permit modification. 2 No attempt will be made by the permittee to prevent the full and 'free, use by the public of all navigable waters at or adjacent to the authorized work. The site is neither within the Town of Windsor's corporate limits nor their E.T.J. The Town of Windsor is very committed to providing safe shoreline fishing opportunities to the public along the Cashie River at convenient points of access. They'also want to provide boating access to the isolated areas of the Cashie, River and have chosen to promote the use of kayaks and canoes. 'The Town of Windsor has a long term, 25 year lease, with the property, owner, Stanley Thompson. Following recent North Carolina Department of Transportation construction of a new replacement bridge on Hoggard Mill Road (SR 1303), the Town cleared a small access area and had stone placed to'facilitate vehicles having off right of way parking during the peak spanning runs of transient fish. We understand that the work performed on site has been completed under the direction of the applicable resource agencies. The Town of Windsor recognized the site to' be very favorable for a fishing platform and a kayak/canoe launch platform. They�secured grant funding and authorized the design and permitting phase to begin. There is an underlying, mandate that all Governmental' Agencies, Stake Holders, Designers, and Resource Agencies are in completelarmony with, Handicap Access to Recreation Facilities. The useful range of elevations possible with a floating platform can vary dramatically from location to location. The extreme higher elevation possible on the Roanoke River as well the'upper Cashie River will cause the platform to exceed the maximum slope for handicap use The platform's rising is a safety feature to protect it and to avoid having to remove the platform during ,the,storm events that cause a water elevation rise The higher elevations are accompanied by an,increased risk of danger in boating and most likely will not be used by any, boaters during the extreme =events There will be a concrete pad constructed at'the southeast, corner of the parking area for handicap access to the launch and fishing pier. The access ramps, elevated walk over the 404 jurisdictional areas will be below'the thirty inches from the, land surface and railings, will not be required. The pier over the public trust water will also be below the required elevation and rails will not be provided. The structure, pilings, framing, girders, etc. will be treated wood and the decking will be ADA approved hog slats made of concrete. The launch will be aluminum and anchored by four wooden 'pil piling. The ramp is aluminum and pivot anchored to the end of the piling platform The section of pier joining the ramp will serve as a platform. The ramp will have rails The launch deck will.have handicap bumpers on its perimeter and a handicap seat, rail and provide Rill access according to the current ADA codes. The Cashie River at Hoggard Mill Road is historically a well used location for fishing. This is especially true during the Spring runs of Herrings and Shad fish. The fishermen use artificial lures and nets depending on the species in season. The castings of lures and nets require more room than fishing with poles and natural baits. The,design addresses handicap and physically impaired access to all the facility. The access is most important during,the peak use periods. The pier has a widened section of an, additional hog slat width. It °is felt that the type of techniques to be used in casting, tackle boxes, cooler, etc that more width of the,pier would provide a better measure of safety and ease of use. During periods of off -peak use, the additional width will enhance the use of chairs and stools without restricting access for other users. There will be very limited earth disturbing activities. The impacts will be limited to construction of the pile driving and placement of the structures,to receive the hog slats The only disturbance in the Cashie River will be for pile driving �and placement of the structures to receive the hog, slats The owners are aware of the February 15`h to June 30th restrictions on construction activities. The design has been driver to avoid the removal of trees and every attempt made to avoid damage or removal. The existing parking lot is considered to be an existing feature and no work,is to be performed to it other than removal of stone and placement of,concrete for the,handicap vehicles. The stormwater management will be reviewed under the rules of redevelopment exclusion There is no additional impervious area planned. However, the points of accumulated discharge from the parking lot to the wetlands,, a stone trench will be provided as a BMP to attenuate the discharge velocity and cause a uniform, level, overflow. The flow from the stone will then pass over the grassed filter strip to help remforcelhe site from erosion. The work will not be- permitted to take place when the site is wet or the conditions unfavorable that may lead to rutting, erosion or off - site discharge. Silt fences and /or other devices will be employed to contain the disturbed material on site. There will be no slips provided nor any boat launching except,boats that can be carried to the water such as kayaks, canoes, or small boats. Thompson and Sharon Thompson, his wife, f Lessors "), and the ,Town of Windsor, whose mailing address is PO Box 508, Windsor, NC 27983, ( "Lessee "). The parties hereby agree as follows: 11. LEASE. Lessor hereby grants to Lessee, and Lessee hereby accepts, from Lessors a non - exclusive lease of that certain lot or parcel of land adjacent to the bridge crossing on Hoggard Mille Road and the Cashie River, which is more particularly described as Schedule A, attached hereto, for purposes of providing a canoe and kayak access site and normal ,recreation purposes and uses. This lot shall henceforth be referred to as "the Property" for purposes of this Lease. It is recognized that Lessors do expressly reserve from this Lease all rights to use the Property for any purposes which do not interfere with Lessee's rights and permitted uses under this Lease. 2, IMPROVEMENTS. Pursuant to this Lease, Lessee may construct at its expense, inspect, maintain, repair, and use a canoe and kayak access site consisting of a vehicle parking area, wooden boardwalk and a small wooden landing dock adjoining the Cashie River. The site may also have information and interpretative signage and such other improvements as Lessee deems reasonably necessary to facilitate use as a canoe and kayak access site (hereinafter collectively referred to as "the access site "). 3. PUBLIC ACCESS. Lessee also shall have the exclusive right to provide the public the use of the Property as a canoe and kayak access site and normal recreational purposes and uses subject to the terms and conditions set out herein. 4. TERM. The term of this lease shall be 25 years from the effective date unless sooner as provided herein. Any extension of this term shall be by written agreements of the parties. 5. OTHER `IMPROVEMENTS. The parties acknowledge and' agree that Lessee's rights to construct improvements are limited to those described in Paragraph 2 hereof. The construction of other improvements would require execution, of an amendment to the Lease or, a new agreement superseding this Lease, whichever the parties deem appropriate. ,6. CONSIDERATION. In consideration of the rights. and privileges granted by Lessee !hereunder, Lessee will pay Lessor an .annual rental ( "Rent ") of one dollar ($1.00). The Rent for each fiscal year shall be paid no -later than July 30th of each year. 2 7. TITLE TO, IMPROVEMENTS. The parties acknowledge and agree that the access site to be built on the Property, including those improvements described in Paragraphs 2 and any additional improvements Lessee may add at a later date with Lessor's agreement, will be and shall remain the property of the Lessee until the expiration of the term of this Lease, including any extensions; at which time they shall become the sole property of the Lessors. 8. TAXES. During the term of this lease, the Lessors shall pay all taxes and' assessments upon the Property when due, but `Lessee ,sha'll pay as additional Rent ,any increase in real property taxes levied, upon the property, which is attributable to Lessee's improvements to the property. Lessors agree to furnish evidence of such increase to Lessee. 9. COMPLIANCE WITH LAWS. Lessee agrees to obey and comply with all laws, regulations, licensing requirements, rules and ordinances pertaining to its construction of'the access site and the use of the property as described hereunder. 10. USE OF PROPERTY. Lessee shall inform its users and other agents that use of the Property is limited to use of the access site for access and normal recreational purposes and that other uses not incident to access and normal recreational purposes are forbidden, In addition, Lessee shall specifically inform its users and other agents that hunting, discharging of flee-arms and any open fires on the Property are strictly forbidden. Notwithstanding the foregoing provision, if 'Lessors become aware of any use �of the, `Property by the users or other agents of Lessee that is not permitted by this Lease or is otherwise reasonably objectionable to Lessors, Lessors shall inform Lessee, and Lessee shall take steps, ,not inconsistent with the purpose of Lease, to either end the offending use of remove, such users or agents from the Property. 11. MAINTENANCE. Lessee shall maintain the access site in good condition and state of repair. Lessee shall not create or allow the creation of a nuisance on the Property or commit or allow any waste, injury or destruction to the Property. 12. NO WARRANTIES. Lessee acknowledges that Lessors have made no warranties of any kind 'regarding the Property, including the, warranties of fitness for a particular purpose or merchantability, and Lessee takes °the Property as is, with all faults, dangerous conditions and attributes, whether known, to Lessors and /or, Lessee, or not. Notwithstanding the foregoing, if Lessors become aware, of a fault, dangerous condition or .attribute on the Property, they will make reasonable efforts to 'inform Lessee. 3 13. TERMINATION. Except as otherwise 'provided herein, this Lease may be terminated without any penalty or further liability upon written notice as follows: ` a) By either party 'based upon a breach or default of any material covenant or term 'hereof, which breach o'r default is not cured within 60 days of receipt of written notice of .breach or default (without limiting any other rights available to the parties pursuant to any other provision hereof); b) Upon 3,0 days written notice by Lessee to Lessors if Lessee is unable to obtain or maintain any license, permit, or other governmental approval necessary for the construction and operation of the improvements or an insurance policy as required hereunder;, C) 'Upon 30 days-written notice by'Lessee to Lessors if the improvements are destroyed or so damaged as ,to hinder their safe or effective use; or d) Upon 30 days written notice by Lessee to Lessors, at Lessee's option,, if the Memorandum Of Understanding Between the North Carolina Paddle Trails Association, Mid -East 'Resource Conservation And Development Council, Inc., and the Town of Windsor- Concerning the Cashie River Paddle Trail, dated Qc- ,s, --e \0 2013, is terminated by any party thereto. 14. INDEMNIFICATION. Lessee agrees to indemnify and hold Lessor harmless from all actions, claims, lawsuits, judgments, and cross or counter claims imposed upon or asserted against Lessor and arising from Lessee's use of the Property or any such breach by Lessee of the terms of this Lease. 15. INSURANCE'. iLessee shall at its expense maintain ,in full force and effect throughout the Term comprehensive gener6l liability insurance covering its activities on the Property, including construction on the Improvements and the_ rental of the same, with a combined single limit of no less than $2 million dollars. Lessee shall add Lessors to the above- described policy as an additional insured and shall provide a certificate of insurance to Lessee each year at policy renewal. 16. NO ASSIGNMENT. Except for the right to allow the public to use the access site for its intended purpose as provided herein, the Lessee shall not have the right to assign this lease to a third party without the prior written permission of Lessors. 17. SUCCESSORS AND ASSIGNS. This lease shall run with the Property described in Schedule A and shall be binding upon and inure to the benefit of the parties, their respective heirs; successors, personal representatives and assigns, subject to the provisions of Paragraph 16. 4 18. MEMORANDUM OF LEASE. Lessee may file of record in the property records of Bertie County a Memorandum of Lease which sets forth the names and addresses of Lessors and Lessee, the legal description of the Property and the Lease and Easements granted hereunder and the duration of the initial term. 19. SEVERABILITY. If` any term of this Lease is found to be void or invalid, such invalidity shall not affect the remaining terms of this Lease, which shall continue in full force and effect.' 20.
