PROJECT DESCRIPTION: The project location encompasses essentially the entire oceanfront shoreline, of Figure 8 Island, adjacent to the Atlantic Ocean, in New Hanover County To locate the project sites from the Wilmington Regional Office (WiRO), turn right onto Market Street (NC Highway17) and travel approximately 5 miles north until you reach Porter's Neck Road Turn right onto Porter's Neck Road and travel approximately 1 mile east Turn Right on Edgewater Club Road at the round -about and continue east for approximately 1 5 miles until you reach the guard gate to the island dust before the turnstile bridge The island is accessed from the mainland at the end of Edgewater Club 'Road (SR 1402), by private bridge over the Atlantic Intracoastal Waterway (AIWVV) and an earthen causeway (Bridge Road), which traverses Middle Sound Heading east on Bridge iRoad, the road then splits into Beach Road South and Beach Road North The southern project limits is approximately 3,000 linear feet, which, extends from 186 to 128 Beach Road ,South The northern project limits is approximately 5,000 linear feet, which extends from 276 Beach Road North to 10 Inlet Hook Road Based on permit review, there are currently 18 properties along Comber Road to Inlet Hook on the north end within the project area, which have existing sandbags These sandbags are currently partially covered or entirely covered with sand and vegetation According to the NC Division of Coastal Management (DCM) database, these properties with existing sandbags are currently in compliance with their CAMA Permits, respectively It should be noted that to date there are currently no threatened structures along the project location on Figure 8 Island The applicant received State Permit No 2 -90 on January 4, 1990 to allow•for,performing beach bulldozing for the entire oceanfront shoreline of the island State Permit No 2 -90 was later renewed, in 1994 and 1996, which was due to expire on December 31, -2001 The application states that due, to oversight, the federal permit (,Action ID 199000033) was not-renewed during the renewal process of State Permit No 2-'90 The application also states that the applicant decided to retract its application in 2001 Further, since 2000 numerous individual CAMA General Permits and Certification of Exemption from Requiring a CAMA Permit have been issued to private property owners to allow for beach bulldozing to repair damaged dunes along the island and to protect immediately threatened structures (See Sheet 1 of 7, State Permit No. 2. =90, Action ID 199000033, Project Narrative and Individual Homeowner Permits Table) A scoping meeting for the proposed project was held at WiRO on June 25, 2014, which included the applicant and their agents along.with the unterested review agencies Highground vegetation consists of maintained landscaping adjacent to the private properties The oceanfront beach area consists of dune vegetation such as American Beach Grass (Ammop'hila brevdigulata), Bitter Panicum (Pan1cum amarum)„ Pennywort (Hydrocotyle bonariensis), Trumpet Vine (Campsis radicans) and Sea Oats (Uniola panrculata) The Wilmington /New Hanover County Land Use Plan 2006 Update classifies the adjacent waters and high ground portion of the project site as Conservation. The waters of the Atlantic Ocean are classified SB# by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N C Division of Marine Fisheries and they are OPEN to the harvest of shellfish The project location is within the areas of,Figure 8 Island that undergoes regular beach renounshment °from the maintenance events of Mason Inlet system, Nixon Creek, which is, located on the back side of Rich Inlet, and Banks Channel The Long_ Term Average Annual Shoreline Change Rate is 2' per year, as designated by the DCM in the 2012 update PROPOSED PROJECT: The applicant is proposing an island wide permit to allow for beach bulldozing from 10 Inlet Hook Road to 186 Beach Road South to address dune erosion along multiple private property boundaries The application states that the southern,end'of the project area (approximately 3;000 linear feet) would extend from 186 Beach Road South to 128 Beach Road South and the northern end of the project area (approximately 5,000 linear feet) from 276 Beach Road North to 10 Inlet Hook Road Figure 8 Beach Homeowners Association c/o David Kellam Page Three The application also states that there properties within the project location that currently needs work to existing eroded dune system The application states that traditional 'beach bulldozing methods are proposed, which would push the material from `the mean lower low water .line (MLLW) ( -2 58' NAVD88 on Figure Eight Island) landward along the beach profile @ -10' below grade to even out the escarpment and rebuild the existing eroded dune system The application also states that beach bulldozing would aim to provide ,a small scale immediate repair to badly damaged'dune systems after coastal- storms and northeasters-and between the large scale inlet dredging and beach nourishment projects The project limits would be approximately 8,500 linear feet by 150' in width below MHW and approximately 75'. in width above MHW Dune restoration elevation would range from approximately 12' to 15' NAVD88 from the existing level of the dry sand beach, with a 2 1 slope As stated above, the north end of Figure 8 Island contains 18 properties with existing sandbags in place as a form of property protection The application states that if the sandbags are in compliance-with their LAMA Permits when beach bulldozing is proposed, pushed sand would be filled to grade and partially ,cover the sandbags to avoid creating a back -dune gully between the dune and existing sandbags The application also states if the sandbags are not in compliance at the time of proposed 'beach bulldozing, then the, pushed material would be located seaward of the existing toe of the sandbags(See Sheet 1 through 7 of 7 and Project Narrative) 10. ANTICIPATED IMPACTS The proposed project would impact approximately 637;500 sq ft. (14 6 acres) of the dry sand beach area above MHW and approximately 1,275,000 sq ft,' (29.2 acres) `below 'MHW within the inter -tidal zone The beach bulldozing push would result in the relocation, of approximately 1„597 cubic yards of sand from the unvegetated beach to the dune system and approximately 40,351 cubic yards of sand within the intertidal zone Placement of sand on the beach would result in temporary mortality for intertidal micro fauna, such as crabs and worms, and would result in temporary turbidity within the nearshore waters of the Atlantic Ocean, potentially affecting fish in the project area at,,the time Limiting the work to the winter season should reduce potential adverse impacts to fish communities Submitted by: Robb'L Mairs Date: July ,11, 2014 Office: Wilmington III- Figure g Beach Homeowners Association Beach Scraping Permit Project Narrative 9une 25, 2014 Location Figure 8 Island is,a 1300 acre island with approximately 475'privately,owned single family homes and no commercial development. The only access to the island is via the gated bridge across the Atlantic Intracoastal Waterway, From NC-Business Route 17, turn onto Porters Neck Road'until you reach the traffic circle. Bear right-at the circle onto Edgewater Club Road. This road�will, make a hard left hand, - then right hand turn and becomes Bridge Road. The entry gate for Figure 8 Island is located approximately a quarter'mile past this turn. An overall vicinity map of the area is shown in the previous section, entitled 'Vicinity Map'. Permit History The Figure 8 Beach Homeowners association first applied for a CAMA major permit to perform beach scraping for the entire oceanfront shoreline of the island on October 26, 1989 and the State permit (2- 90),was granted on January 4, 1990. The permit went,through the GP291.process on the federal sid'eand a general permit was issued by the USACE for the project. Permit 2 -90 was renewed by filing a renewal request with the state in 1994 and again in 1996, both of which were granted. The 1996 renewal extended the,permit through December 31, 2001. The Figure 8 HOA believed,the 1994 and 1996 renewal process had been processed through the same federal /state coordinated permit process•as the original permit. However, when work was planned to be conducted in 2000,,the HOA discovered that the federal,permit was never renewed in 1996 despite,the CAMA permit remaining active. After severab attempts to renew the federal permit failed, the HOA decided to,retract its application in 2001. The application for the,,second'renewal of permit 2 -90 was made on August 30, 1996 or about 6 weeks following Hurricane Bertha and before Hurricane Fran made landfall inSeptember 1996. The drastic regional increase in permit,applications after Bertha was perhaps a factor leading to the application being accepted at the State level, but not completing the Federal renewal process. Since 2000, numerous�beach scraping projects have taken place on Figure,8 Island, however individual homeowners were required to submit individual,applications for each project. A detailed list can be found later in the permit application within the section 'Previous State and Federal Permits'. All of the individual permits'issued to homeowners'fell under either a general permit or a certificate of exemption, allowing emergency beach scraping to repair badly damaged dunes and scarped beaches following, coastal storm events. The vision of this - permit remains the same, however, it aims to reduce the amount of paperwork °required to perform°work.along the oceanfront beach as a whole. In addition to the individual permits obtained by individual homeowners in the following section, the HOA received several large scale.authorizations to+perform scraping on the beach. In July of 1996, Figure 8 Beach HOA received a verbal authorization from the NCDNER Wilmington regional office to proceed with emergency berm construction for,the entire oceanfront beach. Following Hurricane Bonnie in August 1998, CAMA issued General Permit No. 017999 -D on September Vt authorizing 'emergency RECEIVED LGM WILMINGIM, NC JUN 2 5 2014 dozing' to push up a berm at "threatened residential structures' and'identifies the�properties that are consideredthreatened by-DE-NR. US,Army Corps of Engineers approval for this project,was dated September 4, 1998. Finally, after Hurricane Floyd in 1999 the Homeowners Association requested a modification to 2 -90 to allow,dozing within the moratorium, dates. On September 23, 1999 CAMA sent a memo to the HOA confirming that all residential structures from 220 Beach Road North to 18$ Beach Road South are,considered'threatened and that, in consultation with the USACE and USFWS, emergency beach scraping may occur at the abovementioned threatened lots. ProposedtProject Figure.8 Island experiences continual erosion along its oceanfront shoreline, and is somewhat remedied by the periodic navigational dredging projects in Nixons Channel and the Mason Inlet Relocation Maintenance Dredging events. These projects place material from within the inlet,system onto the beach creating a larger beach and better storm protection while also,maintaining Mason Inlets position and navigation within Nixons channel These projects occuron a three,to five,year return intervalwhen the position of,the inlet system or shoaling within the navigation channel needslo be addressed., However, within that nourishment project interval, numerous coastal storms and northeasters occur-, oftentimes leaving largexscarps on the beach.and causing.isolated 'hotspot' erosion. While the erosion on the beach as a whole may not.be °significant enough to warrant afull scale nourishment project, isolated areas need some work to ensure that,personal property is not adversely impacted. Historically, individual homeowners have applied for and been granted individual permits to scrape the beach within their property lines. This work was generally done'in response to isolated coastal storm events and hotspot erosion leaving scarps and dune damage in'localized areas on the beach. Because beach - erosion is not limited to a single property boundary,mumerous permit applications were often .submitted to address a larger scale problem. The goal,of this blanket permit'is to alleviate the burden of the CAMA office receiving 200 individual permit applications and being able to address the issue with one permit. The Figure 8 Beach Homeowners Association is seeking to obtain an island wide permit to address scarping problems that extend along multiple property boundaries. While the permit will be viable for the entire oceanfront shoreline from 188 Beach Road South to 10 Inlet Hook Road, each iteration of a beach- scraping'everft will be limited to the,areas,of need. For this permit application, the problem areas,exist on both the southern and northern end of the island. The southern end needing work is approximately 3000 linear feet and extends from approximately 186 Beach Road South to 128 Beach Road South. On the northern end, approximately 5500 feet of beach needs to be addressed, from 276 Beach Road North to 10 Inlet Hook Road. Each,subsequent permit modification will indicate the problem areas on the;beach, within the defined boundaries of 188 Beach Road South and 10 Inlet Hook ,Road and allow for beach scraping within these isolated areas and across multiple property boundaries. Traditional beach scraping methods are proposed, with a bulldozer pushing material from the Mean Lower Low Water line ( -2.58' NAVD88 on Figure 8 Island) further up-the beach profile to even out scarping and rebuild the eroded dune. Beach scraping will' aim to provide a small scale immediate repair to'badly'damaged dune systems aftercoastal storms�and northeasters and between the large scale inlet dredging and beach nourishment projects: The emergency dune repairs dune with beach scraping rebuild badly eroded dune systems and reestablish personal property protection before the next-coastal REUPI ED DCM WILMINGTON, NC JUI i 2 5 2014 storm Beach repairs and therefore the construction zone will be limited from the dune,system to the lowtide line. While not in use, the bulldozers will be kept:on-the beach above the high tide line until the completion of the project. The north end,of Figure 8, Island contains many properties with�sandbags in-place as a form of property protection. If these bags are in compliance with CAMA regulations, when a. beach scraping project is proposed, scraped sand will be filled to grade and partially cover the bags to avoid creating a back -dune gully between the dune and'sandbags. If any sand bags are out of compliance,, sand will not be placed on the bags themselves and will be placed seaward of the existing "toefof the sandbags. Before the initiation; of a new scraping project under 2 -90, a list of out -of- compliance properties will be'provided by CAMA to dictate where the sandbags may,not be covered with sand. This work is proposed to address beach erosion caused by periodic northeasters and other coastal storm events, Beach scraping'will reestablish personal property, protection within eroded,portions,of the beach, as well as provide a larger,recreational beach for homeowners and visitors. Removing the scarp from the beach reduces a hazard that can cause injury from beachgoers falling off the ledge, and also allows for wildlife to,easily travel1rom the ocean to the upper profile of the beach. All proposed work falls within the developed portion of the beach, from the Mean Low Water Line to the dunes directly seaward of coastal structures and no impact to the hummocky dunes or tidal flats on the north and south end of Figure 8�Island1s proposed. Worktperformed' under this application will occur outside ofthe sea turtle moratorium dates of April 30 ,to,November 15. Should a major,coastal storm event occur within the moratorium dates and cause extensive erosion, all a ppro priate, State and Federal agencies will be consulted prior to any work being performed in front of'imminently threatened'structures. . Notification of'permii Application In accordance to,the major permit application process, the neighboring property-owners to the north and south of the proposed beach scarping area on Figure 8 Island will be notified of the permit, application via certified ;letter. The southern end of the project extends to 188 Beach Road South, and the adjacent property,own_er is the Hutaff Family Trust. The northernmost lot,within the proposed beach scraping area is 10 Inlet Hook Road and 518 Beach Road North,is the adjacent property owner. The remaining oceanfront homeowners within the proposed project area will be notified by letter from the HOA. The next Figure 8 Beach HOA meeting is July 5th °and Figure 8 will include the permit application as an agenda item during that meeting.,The discussion and meeting minutes along with the,permit application and drawings will be mailed to each member of the HOA. Figure 8 will also announce at this HOA meeting thaVa complete permit application and drawings will be posted on their website for review. A comprehensive list of all the homeowners that will be included,on the abovementioned mailing list is attached.
