Your certified letter was signed for on 6/9/22 and I spoke to Diane Harrison by phone on 6/9/22 as well.
As stated in your Notice of Violation, I notified DWQ staff of the lagoon level being at 18", and the 30-
day Plan was submitted on 3/23/22 also.
Knowing that I would exceed the Small Grain PAN if more water was applied and believing that I could
not put anymore water out until April when Bermuda PAN period begins under the revised permit,the
lagoon level was monitored until it reached 18" and then I notified DWQ,the 30-day POA was put in
place, and airway removal of the water began as soon as it was possible. On 4/18/22, I was able to get
the lagoon to 21". As weather and field conditions permitted pumping continued, and as of 6/9/22, the
lagoon level is at 44".
I will continue to follow proposed actions outlined in the POA and take necessary precautions to keep
the lagoon level in compliance.
Specific Corrective Actions:
-Clarify application time period for begin/end of small grain and Bermuda grass
-Make sure lagoon level is verified as required
I appreciate your understanding that this violation was not committed intentionally, and I believe that I
acted as soon as reasonably possible due to weather and field conditions in my attempts to correct the
situation. I respectfully request that in your review of this violation that no civil penalty be assessed.
